BARTENOPE and THERESA BARTENOPE, husband and wife, residing at 78 Third Place, Brooklyn, New York 11231 party of the second part, WlTNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Orient in the Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a monument on the easterly side of Youngs Avenue, 1440.95 feet northerly as measured along said easterly side of Youngs Avenue from the Main Road, said point of beginning being the northwesterly comer of land now or formerly of Frank Begora, Jr.; RUNNING THENCE North 9 degrees 08 minutes 40 seconds west along said easterly side of Youngs Avenue, 120.00 feet to a monument and land now or formerly of Edward W. Latham; THENCE along said land now or formerly of Edward W. Latham the following two (2,) courses and distances: 1. North 77 degrees 59 minutes 50 seconds east 200.00 feet and 2. South 9 degrees 08 minutes 40 seconds east 120.00 feet to a monument; THENCE South 77 degrees 59 minutes 50 seconds west and still along land or formerly of Edward W. Latham and later along now or formerly of Frank Begora, Jr., 200 feet to the monument on the easterly side of Youngs Avenue and the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Joseph L. Saborido and Dorothea Saborido, dated May 14, 1990, and recorded May 24, 1990, in the Office of the Suffolk County Clerk in Liber 11073, Page 317. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereo~, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the fight to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
