THIS INDENTURE, made the

WILLIAM J. WAGNER and DOROTHY B WAGNER, both residing at 7130 Main Road,
East Marion, New York, as Trustees of the WAGNER FAMILY TRUST DATED 10-26-94
party of the first part, and

60 Ida Lane, Aquebogue, New York
party of the second part,
WITNESSETH, that the party of the first part, duly nominated and appointed Trustees of the
Wagner Family Trust dated 10-26-94, by virtue of the title and authority in me vested by the
terms of said Trust, and in consideration of FIFTY-FIVE THOUSAND ($55,000.00) DOLLARS
paid by the party of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever,
ALL THA T CERTAIN plot. piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Orient in the Town of Southold, County of Suffolk
and State of New York, known and designated as Lot No. 59 on a certain map entitled, "Map of
Orient By The Sea, Section Two", and filed in the Office of the Clerk of the County of Suffolk
on October 26, 1961, as Map No. 3444, said lot being more particularly bounded and described
as follows:-
BEGINNING at a point on the westerly side of Ryder Farm Lane where same is intersected by
the division line between Lots 59 and 60 on said map, said point also being distant northerly
453.85 feet as measured along same from the intersection of the northerly side of Park View
Lane with the westerly side of Ryder Farm Lane;
RUNNING THENCE along said division line, South 88 degrees 26 minutes 00 seconds West,
150.00 feet to land now or formerly ofJoseph Moisa;
RUNNING THENCE along said lands, North 01 degrees 34 minutes 00 seconds West, 140.00
feet to the division line between Lots 59 and 58 on said map;
RUNNING THENCE along said division line, North 88 degrees 26 minutes 00 seconds East,
150.00 feet to the westerly side of Ryder Farm Lane;
RIJNN1NG THENCE along the westerly side of Ryder Farm Lane, South 01 degrees 34 minutes
00 seconds East, 140.00 feet to the division line at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from William 1. Wagner and Dorothy B. Wagner, his wife, dated October 26, ]994, and
recorded in the Suffolk County Clerk's Office on November 18,1994, in Liber 11703 page 149.
TOGETHER WITH all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof;
TOGETHER WITH the appurtenances and all the estate and rights of the party of the first part
in and to the said premises which the party of the second part has the power to conveyor dispose
of; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part
and/or assigns forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been incumbered in any way whatever, except. as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the: party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
