TOGETHER1 also, with a dght of way over Stars Road from the northwesterly corner of the premises northerly and then westerly about 830 feet to Cedar Drive; and a dght of way over a 50' private road from the eastedy end of Aquaview Avenue about 33 feet to the easterly line of Costas Stars; and a right of way over a 35' private road from said road running easterly from Aquaview Avenue about 275 feet to Stars Road. ., TOGETHER, also, with the right to use, in common with others, a strip of land 40 in width, the eastedy line of which is the easterly bounder of land formerly of Wm. G. Lenz and which runs from the northerly line of said 50' private road northerly about 275 feet to Long Island Sound, and a parcel of beach about 40' by 90' lying easterly from the above described 40' right of way. BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed from Costas Stars dated May 4, 1963 and recorded in the Suffolk County Clerk's Office on July 8, 1963 in Liber 5374 at Page 328. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected in and to the parties of the first part, ANDREAS WAGNER and ROSA WAGNER, solely for the use and occupancy of said parties of the first part. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so requires.
