Present Were: Peter Young, Chairperson Anne Trimble, Member Doug Hardy, Member Audrey Horton, Member John Bredemeyer, Trustee Albert Krupski, Jr., Town Board Member Lauren Standish, Secretary Absent Was: Greta Schiller, Member Jack McGreevy, Member CALL TO ORDER The meeting was called to order at 4:37 PM by Chairperson Peter Young. NEW BUSINESS Chairperson Peter Young attended the Town Board worksession held on February 2na. The Town Board discussed the mooring report submitted by the CAC and agreed to immediately forward the report to the Code Committee for review. Peter, along with Trustee Jill Doherty, discussed the issue of compliance inspections with the Town Board and the Board stated that they would consider allowing the CAC to assist the Trustees with the inspections. Chairperson Peter Young commented that all CAC members need to pitch in and conduct the regular monthly field inspections. Member Doug Hardy expressed his frustration with the lack of response from a reported violation in New Suffolk. Member Audrey Horton agreed that a response is due. Chairperson Peter Young 2 stated that the CAC members are responsible for stating the facts as a repoding agency only and not as an enforcement agency. Trustee John Bredemeyer commented that one advantage of having the CAC perform compliance inspections would be to help tighten up permits, however, feels that enforcement officers should be conducting compliance inspections. Chairperson Peter Young discussed his memo dated February 1st regarding proposed By-Laws, Student Members, Budget Planning, Committees, Assignments, and Special Projects. He requested that all CAC members review the memo in preparation for a more in-depth discussion at the next meeting scheduled for Wed., March 10th, Trustee Al Krupski stated that By-Laws need to be reviewed by the Town Attorney. Chairperson Peter Young distributed a draft of a proposed local law concerning signs on public beaches and the public trust doctrine for comment. After a unanimous vote, the CAC members agreed to forward the draft to the Town Board and the Board of Trustees for consideration. APPROVAL OF MINUTES Moved by Doug Hardy seconded by Audrey Hodon, to Approve the Minutes of January 13, 2010. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit application of ARTHUR CODY to construct an 822 sf. single-family dwelling, 45 sf. deck, 200 sr. driveway, sanitary system and public water service. Located: 630 Dean Dr., Cutchogue. SCTM#116-4-2 Inspected by: Peter Young, Doug Hardy Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Anne Trimble, it was RESOLVED to SUPPORT the Wetland Permit application of MATTITUCK FISHING STATION to remove (1) 3,000 gallon single wall fiberglass gasoline UST, install (1) 3,000 gallon double wall steel UL #2085 Fire Rated A.S.T. with new piping and dispensers along bulkhead. Located: 2275 Naugles Dr., Mattituck. SCTM#99-4-23 Inspected by: Peter Young, Doug Hardy Vote of Council: Ayes: All Motion Carried AMY ORR for the existing dwelling; abandon existing septic system and install new system; enlarge existing deck on eastern side of house by 8'X 13'; permit existing deck structures, wood walk, steps, and outside shower. Located: 625 Terry Lane, Southold. SCTM#65-1-23 The CAC did not make an inspection, therefore no recommendation was made. LUKE & RITA LICALZl to construct a new addition to an existing dwelling with interior renovations to the existing dwelling. Located: 2105 Calves Neck Rd., Southold. SCTM#70-4-46.1 The CAC did not make an inspection, therefore no recommendation was made. EDWARD FERGUS to construct a single-family dwelling and garage 3,725 sf., decking 600 sf., detached garage 288 sf., French drain 160 If., attendant sanitary system, gravel driveway and public water. Located: 1854 North Bayview Rd., Southold. SCTM#70-12-39.3 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by Anne Trimble, it was RESOLVED to SUPPORT the Wetland Permit application of GEORGE BALDWIN to maintenance dredge 25 cy. to maintain navigable water depth. All dredge spoils will be placed to the north on undeveloped land owned Carlucci. Located: 1045 Island View Lane, Greenport. SCTM#57-2-21 Inspected by: Peter Young The CAC Supports the application with the Condition of a 15' non-turf buffer. SCTM#57-2-22 Inspected by: Peter Young The CAC Supports the application with the Condition of a 15' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Anne Trimble, it was RESOLVED to SUPPORT the Wetland Permit application of ROB£RT SWING to demolish the existing structure and include the addition of three (3) courses of concrete block to existing foundation to conform to FEMA. Located: 4295 Bayshore Rd., Greenport. SCTM#53-6-24 Inspected by: Peter Young The CAC Supports the application with the Condition of a 12'-15' non-turf buffer along the southeast side of the property. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Anne Trimble, it was RESOLVED to SUPPORT the Wetland Permit application of PATRIClA & AUSTIN LANCE LAWTHER to construct approx. 85 linear ft. of vinyl bulkhead in place of existing concrete bulkhead; construct a +/-10' westerly return and a +/-12' easterly return in place of existing 7' easterly return; backfill with approx. 25 cy. of clean sand to be trucked in from an upland source; replace (in-place) an existing dock structure consisting of a 3'X 18' fixed timber catwalk, 3'X 12' hinged ramp, and a 6'X 18' float secured by (2) 8" diameter pilings; and replace (in-place) 3'X 12' steps off dock. Located: 705 Wood Lane, Peconic. SCTM#86-6-8 Inspected by: Doug Hardy The CAC Supports the application with the Condition of a 15' non-turf buffer and drywells are installed to contain the run-off from the dwelling. The CAC questions the disposal site of the concrete. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of MARTIN KOSMYNKA to construct a dock consisting of a 3'X 8' ramp and 3'X 28' fixed dock with a ladder at the seaward end, and a piling and pulley system. Located: 5800 Skunk Lane, Cutchogue. SCTM#138-2-25 Inspected by: Peter Young, Doug Hardy The CAC Supports a dock in this area, however, the project was not staked and there were concerns with the size of the lot, location, and navigability. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Anne Trimble, it was RESOLVED to SUPPORT the Wetland Permit application of MATTITUCK PARK DISTRICT to remove a 66' long timber groin, 45' long timber bulkhead and replace an existing timber groin with a new 80' long Iow-profile timber and vinyl sheathing groin and repair 14' of an existing timber groin. Existing deteriorated timber groins and bulkhead to be removed from the site and disposed at an offsite location. The western timber groin is proposed to be reconstructed 12" above the existing grade utilizing vinyl sheathing and 8" dia. timber piles. The damaged CCA sheathing on the eastern timber groin is proposed to be replaced with plastic lumber sheathing. Located: Peconic Bay Blvd., Mattituck. SCTM#126-5-20.1 Inspected by: Peter Young, Doug Hardy The CAC Supports the application with the Condition the signs are removed from publicly owned property and that there be compliance with the LWRP. The CAC also recommends a request is made for a report from a coastal engineer. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND AND COASTAL EROSION PERMITS Moved by Doug Hardy, seconded by Anne Trimble, it was RESOLVED to SUPPORT the application of SPIRO GEROULANOS to Amend Permit #6836 to relocate the proposed swimming pool further back from the edge of the wetlands and modify the proposed retaining wall along the 50' non-disturbance buffer. Located: 2130 Broadwaters Rd., Cutchogue. SCTM#104-9-13 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried JOSEPH & HEIDI BATTAGLIA to Amend Permit #7028 for the revised footprint of the proposed single-family dwelling located no closer than 75' from the wetlands. Located: 2000 Hobad Rd., Southold. SCTM#64-3-3 The CAC did not make an inspection, therefore no recommendation was made. Chairperson Peter Young will attend the next regular meeting of the Board of Trustees scheduled for Wed., February 24, 2010. The next meeting of the Conservation Advisory Council has been set for Wed., March 10, 2010 at 4:30 PM at Down's Farm Preserve.
