WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideqation paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being at East Marion,
in the Town of Southold, County of Suffolk, and State of New York, which plot is known as
and by the lot numbers seventeen (17) and portions of lot numbers forty (40) and forty-one
(41) as shown on a map entitled, "Map of Section Two Gardiner's Bay Estates, situate at East
Marion, Long Island" which map was filed in the Suffolk County Clerk's Office on September
23, 1927, under the number 275, said plot hereby conveyed is more particularly bounded and
described as follows:-
BEGINNING at a point on the westerly side of Old Orchard Lane at the extreme northerly end
of the arc of a curve connecting the westerly side of Old Orchard Lane and the northerly side
of Bayview Drive;
RUNNING THENCE southwesterly along the arc of said curve having a radius of 25.00 feet a
distance of 52.69 feet to the northerly side of Bayview Drive;
THENCE South 89 degrees 44 minutes 10 seconds west along the northerly side of Bayview
Drive, 118.95 feet;
THENCE North 31 degrees 01 minutes 30 seconds west, 86.19 feet;
THENCE North 58 degrees 58 minutes 30 seconds east, 140.00 feet to the westerly side of
Old Orchard Lane;
THENCE South 31 degrees 01 minutes 30 seconds east along the westerly side of Old Orchard
Lane, 125.54 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part as
surviving tenant by the of Carroll B. Rutkowski, his wife, by deed from Charles Bremeier and
Anna Bremeier, his wife, dated May 28, 1970, and recorded in the Suffolk County Clerk's
Office on June 11, 1970, in Liber 6755 page 460.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof~ TOGETHER
with the appurtenances and all the estate and fights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the fight to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
