THIS INDENTURE, made the ~'~day of /~d~°' , Two Thousand Nine
BETWEEN
CHARLES S. GILBERT, residing at 191 Crest Drive, Tanytown, New York 10591, as to his entire
right, title and interest, party of the first part, and
FRANK C. GILBERT, residing at 5 Aspen Court, Ossining, New York 10562, party of the second part,
WITNESSETH, that the party of the first part, in consideration often dollars and other valuable consideration paid by the
party of the second part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
ALL that tract or parcel of land situate, lying and being at Bayview, in the Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:
BEGINNING at a point marked by an iron pipe set on the northerly line of a 50 foot private road known as
"North Parish Drive", 1122.0 feet easterly along said line from a point on that course of the easterly line of North
Road to Bayview, which runs North 14 degrees 25 minutes 20 seconds West, which point is 372.21 feet from
the southerly end of said course; from said point of beginning running in a westerly direction along the northerly
line of said private road, North 75 degrees 54 minutes 50 seconds West a distance of 100.0 feet to a point marked
by an iron pipe; RUNNING THENCE in a northerly direction on a line at right angles to said northerly line of
said private road, North 14 degrees 05 minutes 10 seconds East a distance of 240 feet, more or less, to ordinary
highwater mark of Peconic Bay; RUNNING THENCE in an easterly direction along the ordinary highwater
mark of Peconic Bay a distance of 100 feet, or more, to a point which is North 14 degrees 05 minutes 10 seconds
East from the point or place of beginning; RUNNING THENCE South 14 degrees 05 minutes 10 seconds West
a distance of 235 feet, more or less, to the point or place of BEGINNING.
SAID PREMISES being known as 1010 North Parish Drive, Southold, New York.
TOGETHER with the right to the use of a right of way (in common with others) over said 50 foot private road
known as "North Parish Drive" from the southeasterly comer fo the premises extending westerly 1122.0 feet to
North Bayview Road.
TOGETHER with the right to the use of a right of way (in common with others) over a 50 foot private road
known as "Dayton Road" extending southerly from the southerly line of"North Parish Drive" about 423 feet to
North Bayview Road.
RESERVING, however, to the party of the first part, her legal representatives and assigns, the right to dedicate
said rights of way over Norih Parish Drive and Dayton Road to the Town of Southold as public highways, and
the parties of the second part by the acceptance of this deed do hereby consent to such dedication and do hereby,
release the said Town of Southold from any liability for damages occasioned by reason of said dedication and
acceptance of said rights of way as public highways.
RESERVING, however, to the party of the first part, her legal representatives and assigns, all rights to
installation, maintenance, repair and replacement of public utility lines, pipes, wires and conduits, along the
surface, above the surface and below the surface of the highways adjoining said premises, and the right and
privilege to enter upon the premises herein described and lay, construct, erect and maintain therein or thereon
sewer pipes, water or gas mains, telephone or electric light poles, wires or conduits, with all ordinary
appurtenances and fittings; provided, however, that sewer pipes mains, poles or conduits shall be laid,
constructed or erected only within five (5) feet of the fight of way or roadway line of said premises.
SUBJECT to the covenants and restrictions hereinafter set forth, (SEE SCHEDULE "A" HERETO ANNEXED).
TOGETHER with all the right, title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of this indenture so requires.
