party of the first part, and Jon Nowak, an individual residing at 197 Raymond Street, Rockville Centre, NY 11570,
Janna Rossetti, an individual residing at 110 Gold Place, Malverne, NY 11565, and
Janna Rossetti, as trustee of the Juliana Schillow Trust under agreement dated 12/28/2006, having an address of 110 Gold
Place, Malveme, NY 11565
as TENANTS IN COMMON EACH HAVING A 1/3 INTEREST
party of the second part,
WITNESSETH, that the party of the first part, in consideration of
ten dollars and other valuable consideration dollars
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being
in the Arshamomoque in the Town of Southold, County of Suffolk and State of New York, and known and designated as and
by the lot numbers 19 and 20 both inclusive, on a certain map entitled, "map showing Subdivision of Property known as
Summer Haven, belonging to William G. Herx, near Southold, Suffolk County, New York and filed in the Suffolk County
Clerk's Office, July 5th, 1933 as Map No. 1133, which said lois when taken together are more particularly bounded and
described as follows:
BEGINNING at a point on the southwesterly side of Bayview Avenue where the same is intersected by the dividing line
between lots 20 and 21 on aforesaid map:
RUNNING THENCE southeasterly along the southwesterly side of Bayview Avenue 50 feet;
THENCE south 52 degrees 30 minutes 00 seconds West, 226 feet to the mean high water mark of Arshamomoque Harbor;
THENCE northwesterly along the mean high water mark of Arshamomoque Harbor to the dividing line of lots 20 and 21
aforesaid;
THENCE North 52 degrees 30 minutes 00 seconds East, 223 feet to the sou!hwesterly side of Bayview Avenue, the point or
place of BEGINNING.
SAID PREMISES being known as and by the street number 565 Bayview Avenue, Southold, New York 11971.
BEING AND INTENDED TO BE THE SAME PREMISES conveyed to the party of the first part by Deed dated May 23,
2003 and recorded 4/12/2004 in Liber D00012312, page 828.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it
read "parties" whenever the sense of this indenture so requires.
