WlTNESSETH, that the party of the first part, in consideration of ten ($10.00) and other valuable
consideration paid by the party of the second part, does hereby gr~nt and release unto the party of the
second part, the heirs or successors and assigns of the party of the~econd part forever,
ALL that certain p or, piece or parcel of land, With the buildings and improvements thereon erected, situate,
lying and being at East Marion, Town of Southold. County of Suffolk and State of New York, being more
particularly bounded and described on Sched[~le "A" annexed hereto and made a part hereof.
BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part by deed dated
April 13, 1995 and recorded in the Suffolk County Clerk's Office on April 17, 1995 in Liber 11721at Page 920.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and
· all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covena~nts that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the c6st of the improvement before:bsing any part of th~ total of the same for
any other purpose. The wOrd "party" shall be construed as if it~read "parties' when ever the sense of this
indenture so requires.

· to bring all necessary actions against the owner of these premises or
any part thereof~ for the collection of such sums as may be due~ with

its successors and assigns, that they will not use Or permit the
land to be used for any purposes whatever, other than dwelling or
residential purposes. Tbat no huilding of any klnd other than one
dwelling shall be erected on said premises wbich s~all be constructed
for use and occupancy by not more than one family! plans for such
dwelling to be.submitted to and approved by the party of the first part
