TH1SINDENTURE, made the 17th day of December, two thousand and nine,
between
John J. Feldis, Jr., as Executrix under the Last Will and Testament of Dorothy A.
Feldis, (who died a resident of Suffolk County on May 3, 2009, Suffolk County Surrogate's case
# 2009-34) residing at 15 Lawrence Place, Rockville Centre, New York
party of the first part, and
Elaine F. Feldis, residing at 15 Lawrence Place, Rockville Centre, New York 11570
party of the second part,
WITNESSETH, that the party of the first part, to whom Letters Testamentary were
issued by the Surrogate's Court, Suffolk County, New York on July 16, 2009 and by virtue of
the power and authority given in and by said Last Will and Testament, and/or by Article 11 of
the Estates, Powers and Trusts Law, and in no consideration (a specific bequest) by the party
of the second part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the building and improvements
thereon erected, situate, lying and being north of the Incorporated Village of Southold, in the
Town of Suffolk, County of Suffolk, State of New York bounded and described as follows:
BEGINNING at a point on the northerly side of Sound View Avenue, which point is the
southwesterly corner of tax lot Section 51, Block 1 and Lot 10 on the Suffolk County Tax Map;
RUNNING THENCE north 11 degrees 13 minutes 30 seconds west along land now or
formerly of Dorothy Anna Feldis a distance of 511.4 feet more or less to a high water mark on
the Long Island Sound;
RUNNING THENCE south 85 degrees 00 minutes east along the high water mark of the
Long Island Sound a distance of 100 feet;
RUNNING THENCE south 11 degrees 38 minutes 50 seconds east along land now or
formerly of Richard Louis Hengstenberg, 447.73 feet to the northerly side of Sound View
Avenue;
THENCE RUNNING in a general westerly direction along the northerly side of Sound
View Avenue 100 feet to the point or place of BEGINNING
BEING part of the premises conveyed to the parties of the first part by deed dated June
25, 1965 and recorded in the Suffolk County Clerk's Office in Liber 5769 Page 239.
Said Premises being known as 18305 Sound View Avenue, Southold, New York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and
to any streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances, and also all the estate which the said decedent
had at the time of decedent's death in said premises, and also the estate therein, which the
party of the first part has or has power to convey or dispose of, whether individually, or by
virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.

AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance and
will hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the costs of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day
and year first above written.
