THIS INDENTURE, made the(, ! day of July, 2009
BETWEEN
HELEN L'HOMMEDIEU, as surviving tenant by the entirety of Arthur J. L'Hommedieu, who
died a resident of Suffolk County on June 1, 1985, residing at 550 Smith Road, Peconic, New
York 11958, party of the first part, and
BENJAMIN L'HOMMEDIEU, residing at 550 Smith Road, Peconic, New York 11958, party of the
second par~, and
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.O0)--dollars, and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Peconic, in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot 11 and part of Lot 13 on a certain map entitled "Map of Indian
Neck Park" and filed in the Suffolk County Clerk's Office on 5/27/13 as Map No. 551. Said lot and
part of lot when taken together are more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of a private road, distant 500:0 feet southerly when
measured along the westerly side of a private road from the corner formed by the intersection of the
westerly side of a private road with the southerly side of Indian Neck Road;
RUNNING THENCE South 10 degrees 23 minutes 00 seconds East along the westerly side of a
private road, 150.00 feet;
THENCE South 79 degrees 37 minutes 00 seconds West 136.29 feet;
THENCE North 7 degrees 00 minutes 00 seconds West, 150.26 feet;
THENCE North 79 degrees 37 minutes 00 seconds East, 127.31 feet to the Westerly side of a
private road at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated 01/14/77, recorded 01/17/77 in the office of the Suffolk County Clerk in Liber 8175 page 336.
Together with all right, title and interest of the party of the first part of, in and to the private Road
adjacent to said premises to the enter line thereof, with the right of way over said road in common
with other adjoining owners to Peconic Bay and to Indian Neck Road.
Reserving to the Party of the First Part a life estate in the premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the pady of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
