WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land with the buildings and improvements thereon erected situate,
lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, being more
particularly bounded and described as follows:
BEGINNING at a point on the northwesterly line of a private roadway sometimes called Rabbit Lane
distant in a general northeasterly direction 401.95 feet (402.84 feet deed) from the intersection of the
northwesterly line of said private roadway with the northeasterly line of Bay Avenue;
RUNNING THENCE North 34° 12' 40" West 206.25 feet to Marion Lake;
THENCE North 50° 07' 04" East 38.28 along Marion Lake;
THENCE North 57° 11' 58" East still along Marion Lake 11.32 feet;
THENCE South 34° 12' 40" East 202.11 feet to the northwesterly line of Rabbit Lane;
THENCE South 46° 59' 50" West along said northwesterly line of Rabbit Lane 50.00 feet to the
point or place of BEGINNING.
BEING and intended to be the same parcel acquired by deed dated 12/20/88, recorded by the
Clerk of the County of Suffolk on 2/2/89 in Liber 10792 page 385.
TOGETHER with an easement of ingress and egress from Rabbit Lane to Gardiner's Bay over the
westerly eight foot of a certain parcel now or formerly of Barbe Ramon designated on the tax
map of Suffolk County as Dist. 1000, Sec. 031.00, Block 018.00, Lot 009.000 for the owner, his
or her family and guests, of Sec. 31.00, Block 017.00, Lot 01:!..000 on the same tax map for
pedestrian ingress and egress between the hours of 9:00 a.m. until 8:00 p.m. as reserved in the
Deed from Daniel C. Mooney and Maureen M. Mo,o, ney idated January 29, 1999 and recorded in
the office of the Clerk of the County of Suffolk on '.~, 1999 at Liber of Deeds ](~]q~, pg. 4) I~'
TOGETHER with all right, title and interest, if any, of the party of th~e~:i~St/l~r~in/ a~n~ t~o'an~'~reets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
