BETWEEN
JOYCE E. SCHLECHTWEG, residing at 5190 Arbor View Way, Sugar Hill, Georgia,
CAROL A. WOODS, residing at 209 Kearney Avenue, Bronx, New York, and
THEODORE H. BUSHMANN, III, residing at 291 Avenue A, Lake Ronkonkoma, New York
party of the first part, and
CHRISTINE FRANCE, residing at 9 West Gate Blvd., Manhasset New York 11030
party ofthe second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and 16eing at East Marion, Town of Southold, County of Suffolk, State
of New York, described as follows:
BEGINNING at a point on the southwesterly side of West Lane, 150 feet southeasterly of its
intersection with the southerly side of North Lane, and running southeasterly along the
southwesterly side of West Lane, 75 feet;
THENCE at right angles to the southwesterly side of West Lane, 125 feet to land as shown on
"Map of Section Two Gardiners Bay Estates," owned by Gardiners Bay Company, Inc.;
THENCE northwesterly along said land as shown on said map, 75 feet, more or less;
THENCE northeasterly and again at right angles to the southwesterly side of West Lane, 125
feet, more or less, to the point of BEGINNING.
TOGETHER WITH an easement to pass and repass over South Lane, East Lane, West Lane
and North Lane out over Sylvan Drive and Old Orchard Lane to the Main Road for the
purpose of access to said premises from said highway and together with the right to use the
beach along Gardiner's Bay as hereinafter described for bathing and similar purposes with an
easement for a right of way over the path leading from South Lane to said beach.
The beach of which the use is granted to the party of the second part and the right of way
leading thereto is described as follows:
BEGINNING at a concrete monument at a point on the southeasterly line of South Lane which
is distant when measured along said line, 67.34 feet northeasterly of the northeasterly line of
land now or formerly of Flora E. Gernannt; and
RUNNING THENCE South 31 degrees 01 minutes 30 seconds East, 177.68 feet to a concrete
monument;
THENCE southwesterly a straight line 67 feet, more or less, to the point on the northeasterly
line of said land now or formerly of Gernannt, which point is distant 178.94 feet southeasterly
of South Lane when measured along Gernannt's land;
THENCE South 31 degrees 01 minutes 30 seconds East along said land now or formerly of
Flora E. Gernannt, 67.71 feet to the ordinary high water mark of Gardiner's Bay;
THENCE northeasterly along said ordinary high water mark, 150.82 feet, more or less, to the
point of its intersection with a line drawn on the course South 31 degrees 01 minutes 30
seconds East from a concrete monument on the southerly line of South Lane distant 77.75 feet
northeasterly from the point of beginning;
RUNNING THENCE North 31 degrees 01 minutes 30 seconds West, 56.87 feet, more or less,
to a concrete monument;
THENCE southwesterly a straight line 70 feet, more or less, to a concrete monument;
THENCE North 31 degrees 01 minutes 30 seconds West 179.37 feet to a monument on the
southerly side of South Lane; and
THENCE South 42 degrees 46 minutes 30 seconds West along South Lane, 10.41 feet to the
point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Dorothy M. Bushmann, dated February 26, 1993, and recorded June 4, 1993, in the
Office of the Suffolk County Clerk in Liber 11631, Page 652.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
