WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the ~econd part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL TltAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Orient, Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:-
BEGINNING at a point on the easterly line of Oyster Ponds Lane, 260.15 feet northerly along
said line from the northeasterly comer of land conveyed by N. Alfred Luce to Charlotte L.
Cullen by deed recorded in Liber 2487 cp 164;
RUNNING THENCE along said easterly line of Oyster Ponds Lane, North 28 degrees 13
minutes 00 seconds East, 100.00 feet to land conveyed by said N. Alfred Luee to Winthrop H.
Kellogg and Gertrude E. Kellogg, his wife, by deed dated July 31, 1946;
RUNNING THENCE along last described land, South 64 degrees 19 minutes 00 seconds East,
189.72 feet to the northwesterly comer of land of Lukeman;
THENCE along said land of Lukeman, South 26 degrees 48 minutes 50 seconds West, 84.40
feet to land of Dorman, formerly of Vail;
THENCE along said land of Dorman, South 26 degrees 29 minutes 50 seconds West, 15.50

THENCE along other land of N. Alfred Luce, North 64 degrees 19 minutes 00 seconds West,
192.26 feet to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Frederick Robb and Ruth M. Robb, his wife, dated January 16, 1962, and recorded
in the Suffolk County Clerk's Office on January 18, 1962, in Liber 5113 page 234.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
distributees, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to death, making specific reference to this power of appointment. The
party of the first part may not appoint themselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
TOGETHER with ail right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereo~, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust ~und to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shail be construed as if it read "parties" whenever the sense of this indenture so
requires.
