ACCEPTANCE OF MEETING MINUTES FROM DECEMBER 8, 2009, DECEMBER 22, 2009, JANUARY 12, 2010 AND JANUARY 26, 2010 ?? MOTION made by Chris Baiz, seconded by Lillian Ball, to accept the LPC meeting minutes of December 8, 2009, December 22, 2009, January 12, 2010 and January 26, 2010 Motion carried: 5/0 (Ray Huntington absent from room at time of vote) Applications and Inquiries: ?? John Sepenoski, Chairman moved that the Committee enter in Executive Session and all LPC members present were favorable. Barbara Shinn, David Page and Charles Cuddy, Esq. were asked to leave the meeting room during an executive session discussion between Committee members and their legal counsel. The members entered into EXECUTIVE SESSION. END OF EXECUTIVE SESSION Barbara Shinn, David Page and Charles Cuddy, Esq. re-entered into meeting. The Chairman of the Land Preservation Committee informed Barbara Shinn, David Page and Charles Cuddy, Esq., that after receiving advice from legal counsel, the Land Preservation Committee members determined that the recorded easement does not permit special events such as weddings, parties, and catered affairs with tents and associated parking on the easement area and that the Planning Board would be informed of this determination. In addition, the Land Preservation Committee noted that they would be willing to investigate and review other options. ?? Melissa Spiro, Land Preservation Coordinator, together with Heather Amster of NYS DEC, met with Town Board at their work session held on February 2, 2010. Town Board not receptive to NYS DEC and its request to form a partnership with the Town for the purchase of these MII zoned parcels. Town Board does not want to eliminate property in MII zoned area that would prohibit opportunity for private development of marine commercial businesses. Applications & Inquiries for Uses or Structures on Preserved Property ?? INQUIRY FROM MATTITUCK-CUTCHOGUE CUB SCOUT PACK 39 re: birdhouses A request was made from Pack 39 Cub Scout Leader to permit scouts working on a project towards their World Conservation Award to construct 20 birdhouses for installation at Arshamomoque Pond Preserve to attract bluebirds to this area. Birdhouses would be maintained by the Cub Scout pack. The Committee encourages the use of its Town-owned preserves by its young people for educational purposed and are favorable to assisting Cub Scout Pack 39 in obtaining their objective; however, it was felt that birdhouse installation for attracting bluebirds would be better served at Custer Preserve rather than Arshamomoque Pond Preserve as bluebirds would be attracted more to the meadowlands at Custer rather than the wooded lands around Arshamomoque Pond. Eight to ten birdhouses could be accommodated at Custer Preserve that consists of approximately 6 acres with a condition that installation would have to be kept away from the established overflow parking area located within the preserve. If the troop is set on using Arshamomoque Pond Preserve for their project, it was suggested that their plans be amended to construct birdhouses that would attract birds such as chickadees or wrens that are more likely to establish nesting grounds in a wooded area such as this. This preserve could easily provide accommodation for 20 such birdhouses. John Sepenoski volunteered to be the Land Preservation Committee’s contact with the Cub Scout leader. ?? BITTNER PARKING AREA Review February 2, 2010 plan and memo from Jim McMahon, DPW Lillian Ball, working with Jim McMahon (DPW) and Jamie Richter (Town Engineering Inspector) revised the parking plan into a fan-shaped parking area. It was decided that no further action be taken for making plans and installing a parking area at this site at this time. Land Preservation Committee felt that work priority for all Preserves should be established before focus is on Bittner. In addition, it was noted that additional baseline information needed at Bittner for future planning purposes. General Land Preservation Items: ?? UPDATE re: SUPERVISOR’S STEWARDSHIP MEETING Melissa met with Supervisor Russell, Councilmen Ruland and Krupski, Jim McMahon and Town Attorney Martin Finnegan last week regarding Stewardship of Town owned open space parcels. Supervisor Russell informed Jim McMahon (DPW) that his department was not to do any further work on the preserves until Management Plans adopted. Melissa to bring to next Town Board meeting scheduled for 2/23/10, a list of prioritized projects. Melissa to set up a special meeting with LPC members prior to meeting with Town Board. ?? 2010 STEWARDSHIP REQUEST Discussion re: 1/12/10 handout (Agenda item request from John Sepenoski, Chair) It was suggested that photographs be taken of areas within preserves that require maintenance. Eric Keil suggested that an outside engineering firm be hired to set up a plan. ?? UPDATE re: NEW STEWARDSHIP MANAGEMENT PLANS & TASK LIST Discussion re: 1/12/10 handout (Agenda item request from John Sepenoski, Chair) The Chair called for comments or corrections but there was no new input. Ray Huntington reprised his prior list of written comments to John’s new stewardship management plans and task list. John to re-draft and distribute to LPC members prior to 2/23/10 Town Board meeting, work session on stewardship. ?? UPDATE: re: 2010 DPW WORK PLAN PRESENTED TO TOWN BOARD AS TOWN BOARD MEETING(Agenda item request from John Sepenoski, Chair) Not discussed due to time constraints. ?? PROPOSED AMENDMENTS TO THE SUFFOLK COUNTY PURCHASE OF DEVELOPMENT RIGHTS PROGRAM PUBLIC HEARING ANNOUNCEMENT LPC reviewed the proposed amendments to Chapter 8, “Development Rights to Agricultural Lands” of the Suffolk County Code and are favorable to recommending a change to §8-11 as follows: Section 8-11 B(2): Alternative Energy Systems. The revision restricts the use of the electricity generated by the alternative energy system and does not allow the electricity to be consumed by any residential or other nonagricultural land use or any activity prohibited on agricultural lands. The Committee does not support limiting the consumption as proposed. The Committee supports allowing the electricity generated by the alternative energy system to be used for the entire farm operation, including agricultural production, on-farm processing, and the farm residence. Section 8-11 C: Alternative Energy Systems. The revision requires that in the event that the farm operation changes and the average annual electricity consumption is reduced, that the agricultural land owner disconnect from the utility’s grid. The Committee does not support the requirement that the landowner disconnect from the utility grid in the event that the farm operation changes and consumption is reduced. The LPC recommends that the system remain connected and that the power go into the grid for free. Public hearing set for March 2, 2010 at 2:30 p.m., in the Riverhead Auditorium at the Evans K. Griffing Building in Riverhead. Next Regular Meeting: ?? The next regular meeting will be held on Tuesday, February 23, 2010, at 7:00 p.m., in the Annex Executive Board Room.
