DECLARATION OF COVENANTS AND RESTRICTIONS
DECLARATION made this

(0 day of Decomber, 198'1, by
SAMUEL K. C. KOPPER and ELIZA P. KOPPER, his wife, both residing at
6 Dexter Road, Westport, Connecticut, hereinafter called the "Owner"
WHEREAS, the "Owner" has title to certain land situate,
lying and being at Peconic, in the Town of Southold, County of Suffolk,
and State of New York, said land hereinafter being more particularly
described; and
WHEREAS, it is the intention of the "Owner" that a portion
of the aforesaid lands be set-off from the remainder of said lands,
and the Planning Board of the Town of Southold having conditionally
approved said set-off on July 14, 1986, on the condition that the
instant declaration be filed,
NOW, THEREFORE, the following described land shall be res-
tricted as hereinafter set forth:
Lot No. 2 on the annexed Proposed Set-off made for
Samuel K.C. Kopper and Eliza P. Kopper and being a
portion of the following described premises:
ALL that certain plot, piece or parcel of land, with
the buildings and improvements thereon erected, sit-
uate, lying and being in the Town of Southold, County
of Suffolk, and State of New York, more particularly
bounded and described as follows:
BEGINNING at a point on the westerly side of Indian
Neck Lane said point being distant 757.02 feet
southerly as measured along the westerly side of
!ndian Neck Lane from the corner formed by the inter-
section of the westerly side of Indian Neck Lane with
the southerly side of Main Road (Route 25);
RUNNING THENCE from said point or place of beginning

along the westerly side of Indian Neck Lane South
24 degrees 00 minutes 00 seconds East 84.30 feet
to a concrete monument and land now or formerly
of Albert M. Garbade;
THENCE along said land the following two courses
and distances: (1) South 66 degrees 00 minutes
00 seconds West 231.46 feet to a concrete monu-
ment; (2) South 24 degrees 00 minutes 00 seconds
East 294.39 feet to a concrete monument;
THENCE South 24 degrees 05 minutes 40 seconds East
278.50 feet through a concrete monument to a con-
crete monument and land now or formerly of Pontino;
THENCE along said land South 61 degrees 21 minutes
10 seconds West 310.86 feet to a concrete monument
and land now or formerly of Koroleski;
THENCE along said land North 21 degrees 47 minutes
10 seconds West 682.84 feet;
THENCE North 66 degrees 00 minutes 00 seconds East
514.50 feet to the westerly side of Indian Neck
Lane, the point or place of BEGINNING.
Declarant does hereby warrant, covenant and represent that
there will be no further subdivision of Lot No.2, consisting of
2.894~ acres, without the prior approval of the Planning Board of the
Town of Southold and any and all other necessary approvals.
Declarant does hereby further warrant, covenant and represent
that the foregoing restrictions and agreements shall bind the under-
signed, their heirs, successors and assigns, and any and all person or
persons who shall succeed to the ownership of said Lot No. 2 shown on
the annexed proposed set-off made for Eliza P. and Samuel K.C. Kopper
by transfer or otherwise.
