I am also enclosing a sketch of the dock as it presently is built. I checked with the Town Trustee records and note that there was no application to modify the dock from what was approved on April 25, 1986. Mr. Wells, who was a previous owner of the referenced property, applied for a permit in 1986 of a dock under the grandfather clause. The Trustees approved a 66' x 3' catwalk, 3' x 14' ramp and a 8' x 10' (80 sq. ff.) float secured by two piles (which on Mr. Wells application were 8" dia.) The present dock greatly exceeds these authorized dimensions in several ways. The present float is approximately 16'7" x 7'10" (131 sq. ff.) secured by a combination of 12" and 8" dia. pilings, a 55'8" x 4' catwalk (with 8 "dia. piles) and a 16' x 2'10" aluminum ramp. I would like that the appropiate town personnel look into this situation and take the necessary action so that the present dock be brought into compliance with that which was approved. It is my understanding that there is a public meeting scheduled on the subject of Mr. Jungblunt's permit application to construct a new dock on his adjacent property. I am unable to attend the Dec 12th meeting as I am on long term active duty orders with the United States Navy and am presently assigned to a post in Washington, D.C. and do not have an opportunity to voice my concerns about this proposed dock. My attorney, David Fallon, and my son Matthew Werner are authorized to speak on my behalf. My concern regarding the proposed dock is that it may encroach upon my right of free passage to and from my dock. Because of the configuration of Mr. Jungblunt's property at and beyond the shore line, being narrower than some of the adjoining properties, his boat and dock come too close to the property line converse to the Town Code and infringe on unfettered access to the waterway and safe navigation of my boat. Additionally, the proximity of proposed dock would preclude securing a larger boat to my present dock. The town legal size limit for a privately docked vessel is thirty six feet. This is possible now, but absolutely impossible with the construction of Mr Jungblut's proposed dock. Should this dock be constructed, my vessel would virtually be locked in between the existing dock to my East and Mr. Jungblut's to my West. This is a great illustration and it demonstrates how difficult any lateral movement would be to enter and exit the dock. Picture Mr Jungblut's 10ft wide boat on the end of his dock and my 8ft wide boat tied to mine. Additionally, each boat exceeds the length of the 20 ft dock since my boat is 25ft and Larry's overall length is 27ft. This also limits my opportunity to dock a larger boat since the longer the boat the less maneuverable space available. This dock, should it be built poses a severe navigational hazard. The only reason I reluctantly consented at one point is that I had only seen the pencil drawing of the new proposed dock. Once I received the new survey I became apparent that I would not be able to move in or out of my dock. Additionally, when I saw the size of Larry's boat tied to my dock after I removed mine for the season, I realized the size of his boat would extend far out into the creek and block my ingress/egress. Mr. Jungblut took a picture of my boat leaving my dock and I only barely cleared the stakes that outlined his proposed dock. Should his 10ft wide boat been in place I would have collided with it. Notice that the average distance between docks is approximately 60' to 80' (feet) thorough out the creek, with the exception of the bottom left corner where the docks are fairly close but seem to be on the same property. Per the map provided by Jungblutt, his dock is to be constructed so that it's approximately 20' from Wemer / Gieckel's dock, significantly closer than most all the other docks in the creek. It is our understanding that there is a public meeting being held on November 14th, 2007 on the subject of Mr. Jungblutt's permit application to construct a new dock on his adjacent property. Unfortunately, we are both unable to attend this meeting, however we'd like this opportunity to voice our concerns about this proposed dock. It is my understanding that there was a public meet held on the subject of Mr. Jungblunt's permit application to construct a new dock on his adjacent property. I was unable to attend that public meeting because I recently reported for long term active duty orders with the United States Navy and am presently assigned to a post in Washington, D.C. and did not have an opportunity to voice my concerns about this proposed dock. Some of my concerns regarding this proposed dock are that it may encroach upon my right of free passage to and from my dock. Because of the configuration of Mr. Jungblunt's property at and beyond the shore line, being narrower than some of the adjoining properties, his boat and dock my come too close to the property line converse to the Town Code and may infringe on unfettered access to the waterway and navigation of my boat. In closing, I want to state that I am not an unreasonable person. I would very much like to offer Mr. Jungblunt the opportunity to have his own dock; as long as it is in accordance to the Town Code and does not interfere upon my property and my navigable rights in the use of my dock. SCTM#70-6-20 The proposed ramp, dock, and float have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally INCONSISTENT with the below Policy Standard and therefore is INCONSISTENT with the LWRP; Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The Suffolk Count~ Tax Map Book (2006) indicates that the property line of the parcel adiacent to Jockey Creek totals 10 feet in width. The surve¥~ dated June 16~ 2007~ submitted with the application does not show the distance of the rear of the property line. The proposed action does meet § 275-11 C~2~a~ 5. Construction and operation standards which states: [5] All docks, including any vessel tied to the dock shall have a minimum clearance of l S feet of the seaward extension of any property line from adjacent parcels so as not to interfere with the neighbor's access to waters, unless the Trustees decide otherwise for navigational or other reasons. Waterside boundaries can be identified using the appropriate method for the shape of the shoreline for Long Island waters specified in 9 N¥CRR 274.5. The proposed dock structure cannot meet the above requirement and will interfere with the neighbor's access to the water. The applicant currently enioys access to public waters via a mooring directly seaward of the proposed structure.
