The following action was taken at the Southold Town Board of Trustees regular meeting
held on Wednesday, October 17, 2018:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Wetland Permit#7206 from Robert O'Brien to Gail Jadow and E.J.
Investment Holdings, LLC, as issued on November 18, 2009,-and Amended on July 21,
2010; with the condition that an inspection be performed upon the installation of the
required 10' non-turf buffer.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any.other agency.

Permit fees are now due. Please make check or money order payable to Town of Southold.
The fee is computed below according to the schedule of rates as set forth in Chapter 275 of the
Southold Town Code.
The following fee must be paid within 90 days or re-application fees will be necessary. You will
receive your permit upon completion of the above.

DECLARATION OF COVENANTS

residing at 115 Geers Drive,

Lebanon, TN, hereinafter referred to as "DECLARANT":
Witness:
WHEREAS, DECLARANT is the owner of certain real property located on 3655
Stillwater Ave, Cutchogue, Town of Southold, County of Suffolk, State of New
York, described in the Suffolk County Tax Map as District 1000, Section 136,
Block 2, Lot 11 which is more particularly bounded and described as set forth in
Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHERE~%S, the Property is situated on lands within the jurisdiction of the
Board of Trustees of the Town of Southold (hereinafter the "Trustees") pursuant
to Chapter 275 of the Town Code of the Town of Southold or its successor, and
various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a permit
pursuant to the Wetlands Law of the Town of Southold to undertake certain regulated
activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake
such regulated activities, the Trustees required that a 10 foot wide "non-turf
buffer" adjacent to and landward of new bulkhead; remove 239' of the existing
dock structure and construct a new 145 foot fixed dock with 42" X 16' seasonal
ramp, onto a 6' X 20' seasonal float, secured by 2 - 8" diameter anchor pilings;
with the condition that the ramp and floating dock are seasonal, to be removed no
later than December 1s' and installed no earlier than April 1~ of each year; the
fixed dock is constructed no higher than 2.5' above grade off bulkhead; the use
of open grate decking on the fixed dock, and as depicted on the site plan
prepared by Costello Marine Contracting Corp., last dated November 30, 2009 and
received June 28, 2010.
NOW, THEREFORE, the DECLARANT(S) do/does hereby covenant and agree as
follows:

These covenants shall run with the land and shall be binding on the
DECLARANT, his heirs, assigns, purchasers, or successors in interest and
may only be modified after a public hearing and upon resolution of the
Trustees.

part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at hisor her own
expense, defend any and all such suits initiated by third parties, and the san Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of

That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should cimumstances warrant, request for

That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to. the Town of Southold.
The Pennittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

I am requesting an amendment to permit//7206 to allow a 145' fixed dock with a 42"x16' and
6'x20' float placed in an "L" configtuation. This structure's overall length is six feet longer than
the permitted dock. The DEC did not feel that the Town permitted dock achieved an adequate
water depth and requested the extension. I have enclosed the DEC permit for your review.
I have also enclosed a Google photograph showing both locations of the Town permitted dock
and the DEC permitted dock. This photograph shows that the six foot extension still keeps the
dock within the neighboring dock line. We will also place stakes on site to show the distance
between the two lengths.
Also enclosed is Town permit #7206 and check #6357 in the amount of $50.00.

SPECIAL CONDITIONS
1. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor
shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of, and
understand all terms and conditions of, this permit. Within 30 days of completion of project, the bottom portion of the
form must also be signed and returned, along with photographs of the completed work.
2. No Construction Debris in Wetland or adjacent A~'ea. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands or protected buffer areas.
3. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined to the
upland area landward of the bulkhead or on a barge.
4. Grade to Match The Adjacent Bulkhead All fill must be graded to match the elevation of the land immediately
adjacent to the bulkhead.
5. Backfilling All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or other approved
shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures.
6. No Equipment Below Apparent High Water Equipment operation below (seaward) of apparent high water is
strictly prohibited.
7. No Seaward Extension of Bulkhead The new bulkhead shall be constructed in place of the existing bulkhead
with no seaward extension of the outermost bulkhead face.
8. Jet-in Bulkhead Bulkheads constructed directly adjacent to vegetated tidal wetlands shall be hand driven or jetted
in with no disturbance to the tidal wetland. Trenching is strictly prohibited.
9. No Structures on Bulkhead No permanent structures shall be installed on the authorized bulkhead without first
obtaining written Department approval (permit, modification, amendment).
10. Excavation for Bulkhead/Structure Prior to construction or removal of bulkheads or other shoreline stabilization
structures, all backfill shall be excavated landward of the structure and retained so as not to enter the waterway, tidal
wetlands or protected buffer area.
11, No Runoff Over or Through Bulkhead or into Wetland There shall be no discharge of runoff or other effluent
over or through any bulkhead or shoreline stabilization structure or into tidal wetland or protected buffer area.
12. Use of Treated Wood The use of W°od treated with pentachlorophenol or other wood treatment not specifically
approved by the Department for use in wetlands and/or marine waters, is strictly prohibited in the construction of
structures that will be in contact with tidal waters.
13. Catwalk Decking The decking of catwalk shall be constructed with NYSDEC-appreved fiberglass grating to
reduce shading impacts from the approved structure.
14. No Floats, Ramps in Vegetated Tidal wetlands Floats and ramps may not rest on or be stored in anyvegetated
tidal wetland.
15. Float Installation The float shall be installed only at the approved location with a minimum water depth of 2 %
feet water measured at apparent Iow tide~
16. No Prop Dredging Prop dredging, or the act of utilizing and/or directing the propeller or propulsion system of a
motorized vessel and/or the water-borne forces created by'said propeller or propulsion system, to excavate or displace
existing bottom sediment and benthic habitat for the direct or indirect purpose of establishing or increasing water depth,
is a regulated activity and is not authorized by this permit. Prop dredging is strictly prohibited without further written
authorization (permit, modification or amendment) from the Department.

SPECIAL CONDITIONS
17. No Dredging or Excavation No dredging, excavating or other alteration of the shoreline or underwater areas is
authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department will issue a
~ermit for such activities in the future.
18. No Permanent Structures on Dock No permanent structures shall be installed on dock/catwalk/float without first
obtaining written Department approval (permit; modification or amendment).
19. Docks at Property Lines Docks/catwalks/floats must not:
A) Extend laterally beyond property lines,
B) Be placed so that docked vessels extend laterally over property lines,
C) Interfere with navigation,
D) Interfere with other landowner's riparian dghts.
20. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or.stockpiled for
longer than 48 hours shall be contained by a continuous line of staked haybales / silt curtains (or other NYSDEC
approved devices) placed on the seaward side between the fill and the wetland or protected buffer area. Tarps are
authorized to supplement these approved methods.

faciJity or facilities authofized by the permit whether in compliance or not in compliance with the terms and conditions of the permit.
This indemnification does. not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under Article 78 of the New York Civil
Practice Laws and Rules or any citizen suit or civil rights provision under federal or state iaws.
Item B: Permittee's Contractors to Comply with Pen'nit
The permittee is responsible for informing its independefit contractom, employees, agents and assigns of their responsibility to
comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities
and such pemons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for
the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be require¢
to carry out the activities that are authorized by this permit.
item D: No Right to Trespass or Interfere with Riparian Rights .
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in orde~
to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or
vested in a pemon not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspectio~ at reasonable hours and intervals by an authorized
representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying
with this permit and the ECL. Such representative may order the work suspended pumuant to ECL 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when
requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the
Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department
representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or
determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or
determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such
application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted
by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste
Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF);
b) 30 days before expiretion of all other permit types.

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the fight to modify, suspend or revoke this permit in accordance with 6 NYCRR Part 621. The grounds
for modification, suspension or revocation include:
a) materially false or inaccurate statements in the permit application or supporting papem;
b) failure by the permittee to comply with any terms or conditions of the permit;
c) exceeding the scope of the project as described in the permit application;
d) newly discovered material information or a material change in environmental conditions, relevant technology or applicable
law or regulations since the issuance of the existing permit;
e) noncompliance with previously issued permit conditions, orders of the commissioner, any previsions of the Environmental
Conservation Law or regulations of the Department related to the permitted a~vity.

If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State. and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse, N° claim shall be'made against the State of NewYork on account of any such removal
or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
3. AIl necessary precautions shall be taken to preclude contamination of anywetland or waterWay by suspended solids,
sediments, fvels~ solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project,
4. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across or along the bed of a waterway or floodplain, deposits within any regulatory floodway,
or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway.
5. There shall be no unreasonable interference with navigation by the work herein authorized.
6. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met.
At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit.. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.
Such approved plans were prepared by C0stello Marine Contracting Corp.(seven sheets), last revised on April 22,
2010 and stamped NYSDEC approved on June 10, 2010.

TERMS AND CONDITIONS
The Permittee Robert O'Brien, residing at 3655 Stillwater Avenue, Cutchogue, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at hisor her own
expense, defend any and ail such suits initiated by third parties, and the saifl Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-enmpliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Pennittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.

The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, November 18, 2009 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of ROBERT O'BRIEN applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated October 27, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with ChaPter 268, said application to remove 239' of existing
bulkhead and construct new in-place and provide a 10' wide non-turf buffer landward of
the new bulkhead was found to be Exempt from the Local Waterfront Revitalization
Program policy standards, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application to
remove existing dock structure and construct a new 125' fixed dock with 42"x16'
seasonal ramp onto a 6'x20' seasonal float secured by two 8" diameter anchor pilings
be found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered the Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the use of open grate decking on
the dock; the dock is to be Iow profile 2.5' above grade off of the bulkhead; the ramp
and floating dock are seasonal, to be removed no later than December 1st of each year
and installed no sooner than April 1st of each year, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 18, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of ROBERT O'BRIEN
to remove 239' of existing bulkhead and construct new in-place; provide 10' wide non-
turf buffer landward of new bulkhead; remove existing dock structure and construct a
new 125' fixed dock with 42"x16' seasonal ramp onto a 6'x20' seasonal float secured by

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the

The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action to remove 239' of
existing bulkhead and construct a new bulkhead in-place is EXEMPT from LWRP
review.
However, it is recommended that the Board employ erosion control best management
practices during construction to prevent the loss of native vegetation seaward of the
existing bulkhead.
The proposed construction of a new 125' fixed dock with 42"X 16' seasonal ramp onto a
6'X 20' seasonal float secured by two 8" dia. anchor pilings, as proposed, is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with
the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and requlatory requirements of the Southold Town
Board of Trustees laws and requlations for all Andros Patent and other
lands under their iurisdiction
1. Comply with Trustee regulations and recommendations as set forth
in Trustee permit conditions.
The current length of the dock is unspecified. Therefore, the length of which the
proposed dock will extend seaward from the current dock length is unknown. Note that
the area where the applicant proposes to re-construct the dock is shallow in depth and
bottom scarring from vessels is evident in aerial photographs.

Further the applicant has not demonstrated to the Board that the proposed action
complies with 275-11. C. (2) Docks outlined below.

(d) Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the following
harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal
fish and wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass
(Ruppia maritime) or shellfish;
It is recommended that the Board consider requiring grid deckinq in the areas over
vegetated wetlands to allow for the re-establishment of the spartina alterniflora or
spartina patens.
[11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action to remove 239' of
existing ~nd construct a new bulkhead in-place is EXEMPT from LWRP
review.
However, it is recommended that the Board employ erosion control best management
practices during construction to prevent the loss of native vegetation seaward of the
existing bulkhead.
The proposed construction of a new 125' fixed dock with 42"X 16' seasonal ramp onto a
6'X 20' seasonal float secured by two 8" dia. anchor pilings, as proposed, is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with
the LWRP.
The current length of the dock is unspecified. Therefore, the length of which the
proposed dock will extend seaward from the current dock length is unknown. Note that
the area where the applicant proposes to re-construct the dock is shallow in depth and
bottom scarring from vessels is evident in aerial photographs.

Further the applicant has not demonstrated to the Board that the proposed action
complies with 275-11. C. (2) Docks outlined below.
275-11. C. (2) Docks
(d) Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the following
harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal
fish and wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass
(Ruppia maritima) or shellfish;
It is recommended that the Board cons der requ r nq qrid decking in the areas over
vegetated wetlands to allow for the re-establishment of the spartina alterniflora or
spartina patens.
[11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

DEVELOPED COAST POLICIES
Policy I Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
This residential waterfront piece of property has an existing bulkhead and dock that is used by the
property owner and his family for water dependent activities such as recreational boating, fishing and
swimming. The characteristics of this property are consistent with the surrounding properties.

Policy 3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
This property has an existing bulkhead and dock. We are proposing to reconstruct both these
structures in an attempt by the property owner to maintain the property. The visual quality will not
change significantly nor with the scenic resources be altered.
NATURAL COAST POI/CIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
Our proposal will have not cause any loss of life, structures, or natural resources from flooding and
erosion. Again, there is an exis'dng bulkhead and dock. We are simply reconstructing these
structures to maintain the integrity of the property.
Policy 5
Protect and improve water quality and supply in the Town of Southold.
Our proposal will have no effect on the water quality or supply in the Town Southold.
Policy 6
Protect and restore the quality and function of the Town of Southold's ecosystem.
Best Management Practices will be used during construction to protect the existing wetlands as much
as possible. Any disturbance that does occur to the wetlands during the initial construction will be
minor and is expected to re-establish itself within one year.
Policy 7
Protect and improve air quality in the Town of Southold.
Our proposal will have no effect on the air quality with in the Town of Southold.
Policy 8
Minimize environmental degradation in the Town of Southold from solid waste and
hazardous substances and wastes.
Our proposal will have no effect on the environmental degradation in the Town of Southold from solid

PUBUC COAST POLICIES
Policy 9 Provide fur public access to, and recreaUonal use of, coastal waters, public lands, and
public resources of the Town of Southold.
We are proposing ff/~ reconstruction of existing structures?R~ere will be no change to public access
or recreational use of coastal waters, public lands and public resources of the Town of Southold due
to our proposal.
WOR#/NG COAST POI.~CIES
Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
This is a residential waterfront piece of property which enhances the upland property owner's ability
to engage in water -dependent activities such as recreational boating, swimming and fishing. Tt also
offers the ability to access larger bodies of water to engage in water dependent activities on a larger
level.
Policy 11
Promote sustainable use of living marine resources in the Town of Southold.
This is a residential waterfront property with an existing bulkhead and dock which are both showing
signs of failing. By reconstructing these structures, the property owner is making an effort to
maintain the property. This property is used by the owner and his family to engage in water-
dependent activities such as recreational boating, fishing, and swimming. Dudng construction there
will be minimal disturbance to the wetlands primarily during the instillation of the piling. Best
Management Practices will be adhered to in an attempt to protect the wetlands as much as possible.
Any disturbed area is expected to re-establish itself within one year. There will not be any ongoing
disturbances caused by our proposal.

Protect agricultural lands in the Town of Southold.
Our proposal with have no effect of the agricultural lands in the Town of Southold.
Policy 13 Promote appropriate use and development of energy and mineral resources.
Our proposal will have no effect on the use or development of energy and mineral resources.
