Box 1179 Southold, NY 11971 Re: Scott Ambrosio, 1940 Mason Drive, Cutcho~ue ~oard of Tru~tee~ August 24, 2010 Dear Mrs. Doberty: The captioned permit, which authorizes construction of a fixed timber dock consisting of a 4' x 12' inclined ramp, 4' x 118' catwalk, 3' x 14' ramp, and 6' x 20' float, was issued on 16 December 2009 a~er two site inspections by members of the Board, a public hearing, and a determination by the Board that the project is consistent with the Local Waterfront Revitalization Program. The New York State Department of Environmental Conservation issued a permit for the identical project on April 1~ of this year. However, staff from the New York State Departmem of State Coastal Resources Division has concluded that the project as approved by the Trustees and NYSDEC cannot properly be considered consistent with the Town's locally adopted LWRP. Specifically, they represented in electronic correspondence to me that despite having issued their own consistency concurrence for a similar dock located three properties away inside Broadwaters Cove in 2006, their Department would disavow itserf from that decision end object to our consistency certification for this project unless the area of catwalk located over the open waterway was reduced. And becausa the Town has a locally adopted LWRP, the U.S. Army Corps of Engineers cannot issue their permit for the project without issuance of a consistency concurrence by the Department of State. Therefore, the Ambrosios were left with no choice but to appeal the Department of State's determination or seek a compromise. In order to avoid a lengthy and burdensome appeals process with the Department of State, the applicants agreed to modify the dock design by relocating the landward origin of the dock farther from their house and reducing the length of the catwalk to 84 feet. As a result, the length of the mowed path through the high marsh grass will need to be extended, but the seaward extent of the dock and location of the float would change only marginally. These changes, which are the subject of the attached application for amendment, are depicted on the revised project plan prepared by Eh-Consultants, Inc., last dated 1 August 2010, (3) copies of which are attached hereto. Box 1179 Southold, NY 11971 2010 Re: Scott Ambrosio~ 1940 Mason Driver Cutcho~ue Dear Mr. King: As discussed during the public hearing on the captioned application, please find attached (3) copies of a project plan prepared by En-Cousultants, Inc., last dated 11 January 2010, which depicts a modified configuration for the proposed dock. Specifically, the previously proposed geosynthetic walkway on grade has been eliminated, and the landward end of the fixed elevated catwalk now begins where the existing path meets the high water line with an inclined ramp leading up thereto. Although the seaward extent of the dock remains essentially unchanged, the structure has been shifted slightly westward to maintain a farther distance from the adjacent spit of tidal marsh. As a result of these changes, the overall length of the catwalk has been reduced from 133 to 118 feet. A new footpath to the proposed dock is also depicted, along with a notation that the curved part of the path intersecting the property line will be abandoned. Finally, a note has been added to specify that the dock will be equipped with a light, which the applicant understands must comply with Chapter 275 rules and regulations. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP and listed policy standards provided below. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, she//fishing, waterskiing and other water-dependant activities; Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; See above comment. [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The proposed action is located within a New York State Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in. critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. It is recommended that in the event the action is approved, a si.qnificant non-disturbance buffer (equal to or .qreater than 30' in width from the tidal wetland line) be established to miti.qate the local impacts from the dock structure. [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; [10] Whetherthe dock will adversely affect views, viewsheds and vistas important to the community; The important views, viewsheds and vistas to the community have not been identified or discussed. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The construction method has not been identified. § 275-11 Construction and operation standards requires that all intertidal construction and excavation employ the installation of a silt boom that will retain all suspended sediments within the immediate project area. As evidenced by the atlached aerial photograph, the shorelines of Broadwaters Cove in this area are characterized by more than a dozen similarly configured private docks. Therefore, the dock has been designed so as not to result in the "fragmentation of ecological communities" or the physical loss, degradation, or functional loss of ecological components and will be consistent with Policy 6.
