Pursuant to the provisions of ChaPter 275 and/or Chapter 111 of the Town Code Of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
December 16, 2009, and in comideration of application fee in the sum 0f $250.00 paid by NSHE Williamston

authorizes and permits the following:
Wetland Permit to construct a 14'x35' swimming pool within the western
portion of subject prOperty, With the conditiOns that screening is installed on the west
side of the property, the pool be a saltwater pool, and as depicted on the survey
prepared by Reddan SurveyingI~nc., last dated January 4, 2010, and received on
January 12, 2010.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents'to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee NSHE Williamston, LLC, residing at 220 West Shore Drive, Southold, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be n(~tified by the Permittee of the completion of the work
author/zed.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failur6 to obtain same.

The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, December 16, 2009 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, inc., on behalf of NSHE WILLIAMSTON
LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter
275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated November 4, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: screening is installed on the west
side of the property, the pool be a saltwater pool, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 16, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of NSHE
WlLLIAMSTON LLC to construct a 14'x35' swimming pool within the western portion of
subject property, with the conditions that screening is installed on the west side of the
property, the pool be a saltwater pool, and as depicted on the survey prepared by
Reddan Surveying Inc., last dated January 4, 2010, and received on January 12, 2010.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per ~nspection. (See attached schedule.)

Dear Board Members:
I own the property located at 350 West Shore Dr, in Reydon Shores
which has been in my family since <1956. My property is adjacent on the West
side of the applicant's property. I understand that you will be considering the
applicant's request for a Permit to construct a swimming pool on the West
side of the property with such pool to be situated 5 feet from our common
property line. I am asking that this request be denied, as it will adversely
impact on my use and enjoyment of my property.
From an environmental perspective, I am concerned about the large
volume of chemically treated water, which the swimming pool will contain,
and which will out-gas and be an irritant- 1 have sensitivity to swimming pool
chemicals and will be unable to fully enjoy my patio area as it is adjacent to
the proposed pool.
Being so close to my property line, I believe that use of the pool by
persons, and pump and filter systems which will be situated adjacent to my
property, will result in excessive and undesirable levels of noise, further
diminishing my ability to enjoy the quality and character of my home. My
patio area is adjacent to the proposed pool.
Lastly, while I have no expertise on the environmental Impact of the
proposed swimming pool on the bulkhead, shoreline, my adjacent property,

or the property of the neighbor on the East side of the applicant's property, l
can see no roason to grant any exception to any current regulations which
were put Into place to maintain the quality and character of the community,
the enioyment, comfort and safety of neighbors, and the delicate ecology of
the shoreline.
Please note that the property in question has been listed for sale and
the owner has told me personally of their intention to sell the property as
soon as possible. So it seem that the owners do not plan to make use of the
proposed swimming pool for themselves, but rather, they seek a Permit to
enhance the value of the property for sale.
By way of history, when the applicant purchased the property, they
proposed a renovation to the existing structure which involved building out
on the West side of the properS. I was given notice at that time that a permit
was requested and that a Public Hearing would be held to review the request.
I made no objection and wished them well on their endeavor. Rather than
build an extension as proposed, however, the applicant totally demolished
the s~ucturo and built the large custom home-now for sale.
Please consider my opinions and arguments when you evaluate the
applicant's request for issuance of such a Permit.
Should the petitioners have an alternate plan for pool construcho
such that it will not create any of the problems I have outlined, I would be
happy to agree to it
Thank you for considering my objections on this matter. I am
anticipating that this correspondence will fully represent my position at the
Public Hearing. If you believe that I should be present to more effectively
express my concerns, please advise me such and I will attend.

Suffolk Environmental Consulting, Inc. on behalf of NSHE WILLIAMSTON LLC requests a Wetland
Permit to construct a 14'X 35' swimming pool within the western portion of subject property. Located:
220 West Shore Dr., Southold. SCTM#80-5-4.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions
The top of bluff line or "bluff line" has not been identified pursuant to § 275-2 Definitions; word usage.
of the Southold Town code which defines a bluff as:
BLUFF -- Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body of
water. The waterward limit of a bluff is the landward limit of its waterward natural protective feature.
Where no beach is present, the waterward limit of a bluff is mean Iow water. The landward limit is 25
feet landward of the receding edge or, in those cases where there is no discernible line of active
erosion, 25 feet landward of the point of inflection on the top of the bluff. The point of inflection is that
point along the top of the bluff where the trend of the land slope changes to begin its descent to the
shoreline.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
