These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of the Town of Southold Board of Trustees after a duly noticed public meeting. Adjoining property owners shall be entitled to notice of such public meeting by publication or as otherwise deemed sufficient by the Board of Trustees but their consent to such modification shall not be required. 4. It is the responsibility of any party having any right, title or interest in the Property to consult Chapter 275 of the Town Code of the Town of Southold, as may be amended, and to obtain from the Town of Southold Board of Trustees review and such approvals as may be required by Chapter 275 for activities regulated therein on the Property. 5. Hulse DATE: July 7, 2011 RE: Fitzpatrick request, 1035 Calves Neck Road, Southold In a letter dated May 24, 2011, Jay Fitzpatrick requested a certificate of compliance with respect to the above-referenced property. In the July meeting, the Board approved transfer of a wetland permit from Mildred DiCarlo to Patricia Fitzpatrick. However, it was noted during discussion at the meeting and at the inspection of the property, that a condition of the underlying permit, namely removal of sections of the bulkhead, was not completed and that a violation might issue. The Fitzpatricks, represented by Cathy Mesiano, indicated that they did not wish to do any work to the bulkhead. Mr. Fitzpatrick met with me and provided written documentation that he was erroneously advised by Ms. Mesiano that the conditions of the permit # 7050 were unenforceable prior to purchasing the property. After conferencing with this Board, and noting that the DiCarlo permit expired prior to the July transfer, I suggest that the removal of sections of the bulkhead be included in the Covenants and Restrictions to run with the property. Any future repair or reconstruction of the bulkhead would require removal of sections of the bulkhead as per the permit. Operations conducted on properties zoned M1 or M2 may be given greater flexibility in these requirements given the water-dependent nature of their use. (1) Bulkheads, retaining walls, revetments and gabions. (h) New bulkheads in creeks and bays are prohibited, unless the operation involves construction of a low-sill bulkhead. Structures extending beyond the minimum necessary for access to navigable waters impair public trust interests and open space values associated with the water's surface.
