Project Description: Removal of six (6) dead/diseased trees within a non-
disturbance buffer.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
revised application and as marked with yellow "caution" tape at the site
inspection on December 2, 2009.
Conditions: Trees are to be removed by hand down to the stump, which are to
remain in place, no ground disturbance, re-grading or machinery.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
Inspections: Final inspection.
This is not a determination from any other agency.

KATHLEEN BOWER requests an Administrative Permit to pick up and remove 40+/- dead oak, hickory
and maple trees. Test bore remaining large oak trees for insect infestation and treat as necessary.
Scrape up and remove sedimentation. Located: 12710 Soundview Ave, Southold. SCTM#54-7-1.3
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP.
The proposed description of the action is vaque as the exact number, condition (live or dead), location
of the trees (standinq or fallen) and method of removal (manual or machine) are not identified on the
survey. The number specified could result in the clearinq of the wetland and wetland buffer area.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set fodh in Trustee
permit conditions.
The proposed action does not comply with Board of Trustee Permit Number 5260
issued in 2000 or representations made to retain the ecolo,qical value of the
sensitive parcel stated in the file history.
Protect and restore ecological quality by adhering to the following measures.
1. Maintain values associated with natural ecological communities.
Each natural ecological community has associated values which
contribute to the ecological quality of the Town of Southold. These values
should be assessed on a case-by-case basis.
Retain and add indigenous plants to maintain and restore values of
natural ecological communities.
a. Protect existing indigenous plants from loss or disturbance to the
extent practical.
b. Include use of suitable indigenous plants in the landscaping plans
for new development and in redevelopment projects where loss or
disturbance of existing indigenous plants could not be prevented
during construction.
Maintain ecological integrity of particular locales by maintaining structural
and functional attributes, including normal variability, to provide for self-
sustaining systems.
The wetland system exhibits fluctuatinq hydroperoids, veqetation qrowth and die-off. These
processes contribute to the functions and values of the system; i.e. habitat, nutrient cyclinq,
control of storm water runoff etc.
The proposed clearinq of veqetation (althou.qh va.que in description) is located within the
wetland system and upland buffer areas, therefore, the action as proposed, could result
in si.qnificant impairment of the wetland system. S{qnificant impairment is defined as
reduction in vital resources (e..q., food, shelter, livinq space) or chanqe in environmental
conditions (e.q., temperature, substrate, salinity) beyond the tolerance ranRe of
important species of fish or wildlife that rely on the habitat values found within the
desiqnated area. Indicators of a si.qnificantly impaired habitat focus on ecoloqical
alterations and may include, but are not limited to, reduced carrying capacity, changes in
community structure (e.g. food chain relationships, species diversity, etc), reduced
productivity and/or increased incidence of disease and mortality.
It is recommended that the applicant clarify the exact number, condition (live or dead), location
of the trees (standing or fallen) and method of removal (manual or machine) of the action.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

Ms. Bower, I spoke with Trustee Jim King regarding the removal of dead
vegetation on your lot. He reme~oered being on your lot, and said that it had
been several years since he has visited it. I told him that several large trees
had fallen since his last visit. He said that the Trustees would consider
selective removal of dead vegetation but would want to see the request come
through the application for permit process. I would think that if they only
allowed you to remove several of the larger more recently fallen trees that some
of your desired goals could be achieved in that there would be more open water
for the ducks and more open space ~or turtles and other wildlife. Mr. King said
that once they received the application that a Trustee would revisit the site to
get an idea of how many new trees had fallen since the last visit and make a
~ecision. I understand that this would not be a perfect solution for you but
maybe something is better than nothing. The DEC does not have the authority to
compel the Town to allow you to remove the trees. Please, feel free to call me

After carefully examining the property located at 12710 Soundview Avenue - Southold -
New York, my recommendation would be to clean-up the fallen trees and debris in and
surrounding the vernal pond. By going forward with the clean-up process it would enable
the vernal pond to fill more readily by natural rainfall which in mm would enable the
natural wildlife to have an easier access to drink without having dangerous gasses emitted
by natural decomposition of rotten logs and fallen trees. This work would all have to be
done by hand as to not disturb the natural vegetation ect.

I ha(e reviewed the proposed action for the referenced properly. The proposed action is
vague and unspecified. As you are aware, a small freshwater wetland exists on the north
of the property. The wetland was flagged and verified by the DEC on 12/97 and again on
April 12, 2000 by Eh-Consultants.
Past correspondence in the file references a culvert (since removed) from Sound View
Avenue to the depression. The property owners stated that the runoff from Sound View
Avenue through the culvert was the cause of the wetland. This statement is partially
correct, the wetland is within the watershed for Lily Pond and continues to receive runoff
from Sound View Avenue and the surrounding slopes. An existing cut from Sound View
Avenue contributes standing water to the system, together with, the on-site swale ranging
from 20 N.G.V.D. to 8 N.G.V.D. The construction of Sound View Avenue, interrupted
the natural drainage of the watershed and contributed to longer hydro-periods.
Regardless, the area is still a wetland.
As stated above, the "selective" clearing and grading request is vague and should be
mapped on the existing sun'ey. Ihe action would occur within the 75 buffer and the
extent of the proposed action cannot be assessed. I recommend that the trees that are to
be removed be mapped upon the survey and labeled in the field to avoid illegal clearing
in the future. In addition, a simple grading plan should also be submitted to your office.
In the event that a large area of g~ading or tree removal should occur, I recommend that
hay bales be Installed to prevent adverse impacts to the wetland.
Recognizing that this lot is sensitive, please note that upon the approved survey Note 2
states that "No disturbance on North side" will occur; in addition a 10 foot limit of
clearing was proposed on the west. south and east sides. These statements were
evaluated previously by the Board during the permit process for the residence and should
be weighted in any upcoming decisions,
This action would be within 100 feet and would also require a permit from the DEC as
stated in their letter of Non-jurisdiction. Please let me know if you need anything else.

Thank you for your time and efforts in the
consideration of my permit amendment application. I have
come before the Board essentially for guidance and clarity
with regard to the parameters of my building envelope. I
also hope to find resolve and closure in this matter.
! have followed the parameters of the original permit
that was handed down to me by the previous owner
(Norman Womback) to the best of my ability. ! designed a
home that would fit into the building envelope with room to
spare (5') to the south. Unfortunately, during the surveying
and staking process, my entire foundation was moved 5 feet
to the south. Pushing the house/foundation 5 feet further
away from the wetlands barrier.
When we began the original excavation it was our goal
to leave as many large trees intact around the building
envelope as possible. This is still our goal. Unfortunately,
though, we have a situation in which we must fortify the
land to the north of the foundation either by creating a more
gradual plane of earth between our foundation and the
clearing parameters or the construction of a retaining wall
requiring a footing.

After speaking with the Trustees at the field
investigation on 9/17/03, I believe we will be able to
complete the necessary grading or building of a retaining
wall, while basically staying within reasonably close
proximity to the original building envelope approved by the
Board, as we are allowed to use the clearing parameters
originally approved. :It is my understanding that it may be
necessary to take down a few large trees that fall within
these parameters in order to complete this necessary work.

of house is not specific enough for us. Owners purchased a, environmentally protected,
parcel and placed footprint of house on boarder adjacent property within the town code
but nearest property line. The sketch given to us for perusal gives us the impression that it
could be clear cut and graded to an excess and thus effecting the environments wet lands.
We would not object to clearing dead trees and under bush. We do not want any living
trees moved from site or any grading done to the natural nature oftbe landscape.
It is not our intention to be nasty neighbors and trust an understanding can be made in
that the property when purchased was a. nd still is a wet land parcel. We would like to
preserve our environment for future generations.

I conducted a site visit and determined that t~qe area is a freshwater wetland dominated by red maple and black ash trees.
Standing water was present. The wetland hydroperiod is dependent upon precipitation and hence runoff form the adjacent
slopes and Soundview Avenue...it is the lowest point in a large swale. The trees exhibited stained trunks indicative of long
periods of standing water. The diversion of waler by altering grade is not a good option due to the size of the watershed
conlributing to the welland. I believe that this wetland is not a direct result of a Town Action (culvert) but rather soil
permeability and grade of the adjacent watershed.

Dear Mr. Krupski,
On Friday a Variance application was submitted to you along with a check for $150.00
pertaining to the building permit for my lot on the comer of Soundview Avenue and Hortons Lane.
You will recall conversations Gary Olsen had with you recently, regarding the fresh water wet
lands issue that Soutbold Town insists exist on my property.
When I purchased this property in 1983, I received a Vacant Land Certificate of Occupancy
from Southold Town with no mention of fresh water wet lands. In 1987 1 noticed after rains
storms, substantial rainwater was collecting in part of my lot for a day, then draining into the
ground. Much to my amazement I found that Southold Town installed a culvert into my property
which diverted rainwater off Soundview Avenue from its long incline to the west and east of my
property. At that time I wrote several letters to Raymond Jacobs at the Southold Highway
Department requesting the removal of the culvert. These went unanswered until I confronted Mr.
Jacobs at the Highway Department. Wanting to be cooperative with Southold Town, foolishly
being 'Mr. Good Guy', I allowed Mr. Jacobs to keep the culvert there temporarily. He gave me a
letter on June l, 1987 stating it would be removed upon my request. No water ever stood for long
periods of time, nor did wet lands vegetation ever grow in the area since 1987. Standing water and
wet lands vegetation is criteria for wetland designation, both of which the area on my lot lacks, and
always has.
For about the last two years I have been writing to thc Southold 'rown Highway Department
requesting the removal oftbe culvert, and again, no reply. The culvert was only removed after 1
was forced to hire an Attorney in Riverhead concermng the matter. Another expense put on me by
Southold Town. It was clear to my Surveyor that the so-called 'wetland' spot on my property was
caused by the water from the culvert. You could see a clear path from the culvert to the Iow spot
collecting the rainwater. I also have photographs of the entire area before the culvert was removed
which show this path made by the rainwater. Once the culvert was removed, the DEC returned a
couple of months later as I was applying for a building permit, and found the area dry. They took
the area offoftheir designated wet lands list, and removed the orange flags they had initially
placed in the area two years ago.
It puzzles me as to why Southold Town insists this is wet land area when it is obvious it is
not. [ have been working on obtaining permits regarding a building permit for 10 month now which
all fall back to the wet land issue. So far these permits have cost me $4,528.00 and 1 am not
finished with it yet. Friday I was told by the Board of Health the designed area for the cesspool is
between two enormous oak trees. Because of the Town wetlands designation, this is the only area
the Board of Health will allow the cesspool. To dig the test hole, the two oak trees will have to be
removed at an approximate cost to me of $1,000.00.
My Father was a bayman, operating a party fishing boat out of New Suffolk and Greenport
from 1936 until he retired in 1970. From a child on I remember vividly how he would teach me
environmental conservation regarding Peconic Bay, as well as instructing his fishing parties that
would hire his boat for the day. In addition, he would not allow any item, bottles, cans, and
garbage thrown overboard. He was a conservationist before the word was popular. He was a
friend of Southold Town. I have always followed in his teachings. A few years ago [ volunteered
to assist with the Town Coastal Erosion Project. If you recall, I gave a presentation before the
Town Board, along with a time consuming 5-booklet study [ put together single handedly. At the
time the Board of Trustees was so impressed with it that they requested a copy. Valerie Scropaz
also requested a copy for the Town Archives. I took the time to put another 5 booklets together for
her. This paragraph is to demonstrate to you that my family and I have always supported the Town
of Southold with their issues, and continue to do so. At this point, however, [ feel as ill am being
dumped on by Southold Town, and I don't deserve this.
I am requesting the Board of Trustees take another look at the area in question where you
will find no standing water and no fresh water wetlands vegetation. 1 will be pleased to walk the
area with the Town Board of Trustees at their convenience. On site I will show the photographs of
the rainwater path that used to exist from the culvert that caused the misconception of wetlands,
and also answer honestly any questions the Town Trustees may have.
