The 2009 year end report to the Town Board outlining the workload and achievements of the Local
Waterfront Revitalization Program (LWRP) follows.
A. Consistency Determinations
A total of 260 applications were received and reviewed in 2009, a 2% decrease from 2008. A re-
interpretation of Policy 6.3 has resulted in more valuable reviews of actions, allowing focus on actions
that may pose impacts to the goals and policies of the LWRP.
Thirty-eight actions were determined to be exempt from review or 15% of the total. In 2008, thirty-
four actions were determined to be exempt from review.
Correspondingly, by not recommending that an action is Inconsistent by merely being located within
the 100' minimum setback to a regulated natural feature; a greater number of Consistency
recommendations were delivered to the discretionary boards. This shift increased the time to
reseamh for restrictive covenant and restrictions and other legal history that assisted the discretionary
boards in reaching decisions.
B. Notable LWRP Implementation Program Changes and Achievements
The Planning Department has secured a total of $1,041,763.23 in potential funding to 2012
from the LWRP/EPF grant programs. A total of $125,841.77 has been submitted to NYSDOS
for re-imbursement for in-kind (staff salaries) hours to date.
In 2009 the Town Planning Department was awarded the 2008/2009 EPF Town of Southold
LWRP Hamlet Revitalization Phase II grant in the amount of $137,136.00 and Goldsmith Inlet
Management Plan Grant in the amount of $222,882.00
The LWRP Coordinator worked with the NYSDOS and Town Attorney's Office to amend the
dredging windows and minor exempt action list of the document. The amendments are in the
process of being scheduled for an upcoming public meeting.

amendments. Proposed definition amendments going to Code Committee once
complete.

Hashamomuck Pond Watershed Management Plan Implementation

Town of Southold LWRP Hamlet Study I
a. Awarded in 2008, still awaiting contract, amending Volunteer hour budget.
b. Prepare year end voucher for submission upon receipt of contract. Target date
March 15, 2010. Voucher expected to total near $300,000.00 for work
accomplished.
Development and Implementation of Transfer of Development Rights Program
a. The work plan has been completed and vouchers have been submitted up to
the task of drafting legislation. The State ~s eager for the draft, however the
Town Board wants the legislation (if any) to be a product of the comp plan.

iii.Emailed DOS to potentially modify work plan and complete task in-
house. Need to extend contract. Awaiting Town Board decision on
how to proceed.

Developing Priority Impaired Waterbody and Subwatershed Management Plans
SGA 22 (Goose/Town/Jockey Creeks) and SGA 26 (Richmond Creek).
a. Awarded in 2009, awaiting contract from NYSDOS.
b. The County resolved contract issue and is proc'eeding with hiring Horsley-
Witten Group.
c. Jennifer Andaloro has drafted a Town Professional Services Contract, once
approved, need to execute between TOS and HWG for Spring work plan.
Stormwater Management in the TOS Phase II
a. Executed contract
b. If contract is in effect submit voucher for Meaghan Burke Summer 2009 work
c. This grant was originally written for CCE involvement. CCE new policy
prevents involvement.
d. An amendment to the work-plan is necessary to restructure the gra~t for
implementation.
e. Town Board approved Intern for 2010.
Pipes Cove Phragmites Eradication
a. Contract EXPIRED November 2009 petitioned for extension October 28,
2009. Requested end date December 2011. Received email that the extension
was approved.
b. Town procurement policy "due diligence" met.
c. NYSDEC has denied aquatic pesticide permit for numerous reasons. Out-of-
state contractor drafted the permit specifications outside of original work-plan.
d. Set up meeting with Comell Cooperative Extension to potentially implement
grant.
8. Goldsmith Inlet Management Plan
a. Awarded in 2009, awaiting contract.
b. Met with Nick Gibbons of Suffolk County Parks and Scott Hilary, Park
Trustee. Meeting was very successful. Mr. Gibbons offered staff and field
support for debris cleanup phase. Expect Spring 2010 start.
9. Implementation of The Town of Southold Hamlet Study II
a. Awarded in 2009, awaiting contract.
