SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration
in this application and determines that this review falls under the Type II category of the State's List of
Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of
Planning issued its reply dated October 6, 2009 stating that this application is considered a matter for
local determination as there appears to be no significant county-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 14,968 sq. ft parcel, measuring 100.50'
on Minnehaha Blvd., and 146.86' on Opechee Ave., as shown on the survey dated June 7, 2002
prepared by Joseph A. Ingegno, Land Surveyor. The lot is improved with a single family dwelling and
accessory garage as shown on a plot plan prepared by OCG Architects, LLP dated 6/24/09.
BASIS OF APPLICATION: Request for Variances under Sections 280-124, based upon the Building
Inspector's Notice of Disapproval dated September 2, 2009 stating that proposed additions and
alterations to the single family dwelling and garage are not permitted at less than the code required front
and rear yard setback of 35 feet, less than the code required minimum side yard setback of 10 and lot
coverage above the maximum code required 20%.
LWRP: This application is not subject to review under Chapter 268 because the variance relief
requested does not involve features that relate to a regulated natural feature or a bulkhead or other
shoreline.
RELIEF REQUESTED: The applicant proposes to attach an existing detached accessory garage to their
single family dwelling with a habitable addition that will make the existing garage's side yard setback of
7.8 ft. non-conforming with the code required minimum side yard of 10 ft. A proposed overhang for a
covered front porch addition to the dwelling will reduce the pre-existing non-conforming front yard
setback from Opechee Avenue by 2 feet to 17.55 feet at the closest point where 35 feet is required. A
rear yard setback variance of 34.5 feet for a 628 sq. ft. at-grade patio is requested, where the code
requires 35 feet. Also requested is a variance for total lot coverage of 23.99% where 20%maximum is
permitted, in order to add the proposed addition between the existing dwelling and accessory garage, a
screened porch on the rear of the dwelling, a front porch entry, and a patio in the rear yard.

FINDINGS OF FACT/REASONS FOR BOARD ACTION
The Zoning Board of Appeals held a public hearing on this application on January 21, 2010, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law §267-b(3)(b)¢'l). Grant of the variance will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The property has two front yards on
a non-conforming lot of less than 15,000 sq. ft. The subject property has existed in a subdivision for
many years that is approximately 95% built out. The applicant's existing dwelling is one story and the
proposed additions are also one story. The proposed changes to the elevation along Opechee Avenue
(an addition linking the accessory garage and existing dwelling and a small covered front entry porch)
will improve the curb appeal of the house without creating any additional adverse impacts caused by the
pre-existing non-conforming front yard setback. The proposed screened porch addition to the rear of the
dwelling has conforming setbacks and will shield the proposed rear yard patio from view along
Minnehaha Boulevard. The existing 7.8 ft. easterly side yard setback will remain the same for the
proposed renovated dwelling, and will have no adverse visual impacts on the neighbor's house or
property since the neighbor's house is setback at a much further distance from the road than the
applicant's
2. Town Law _~267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some
method, feasible for the applicant to pursue, other than area variances, because of the size and depth of
the lot, and the existing significant non-conforming setback of the dwelling and the accessory garage
from Opechee Avenue.
3. Town Law §267-b{3){b){3). The proposed front yard variance is substantial at a 50% +/- relief of
current code requirements, however, the dwelling has existed with the non-conforming setback for 40+
years and the Board finds that the proposed 2ft additional setback reduction for a porch overhang that is
only 13.7 ft. long on a front elevation that is approximately 94 ft. long is de minimus in nature. However,
in granting the minimum relief possible, the Board finds that the proposed lot coverage of 23.99% can be
reduced to 23.5%, by reducing the proposed patio setback of 34.5 ft by 7 inches to conform to the 35 ft.
code required rear yard setback. Lot coverage of 23.5% on a sub-standard lot size of 14,968 sq. ft is not
substantial.
4. Town Law §267-b{3){b){4) No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood. The subject property is fiat and no drainage issues exist.
5. Town Law §267-b{3)Cb)(5). The difficulty has not been se/f-created for the front yard and side yard
variances requested due to the non-conforming location of the existing dwelling, but the variances
requested for lot coverage and a rear yard setback are self-created in that the rear yard setback can
easily conform to the code and lot coverage can be reduced by reducing the size of the proposed patio
which will not have a significant impact on the proposed improvements by the applicant.
6. Town Law §267-b. Grant of the relief as applied for on the side yard and front yard setbacks,
and alternative relief for lot coverage, and a denial of the rear yard setback variance, is the
minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and
alterations while preserving and protecting the character of the neighborhood and the health, safety and
welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member
Schneider, and duly carried, to

GRANT the variances as applied for on the front yard and side yard setbacks, and shown on the plot
plan dated 6124109 and proposed addition drawings dated 8124109 pages D1, D2 and D3 all prepared

GRANT ALTERNATIVE RELIEF for lot coverage of 23.5%
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such
uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration
that does not increase the degree of nonconformity.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accorate plot plan t~ scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon appmval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be oceupied or used in whole or in part for any purpose what so ever until the Building inspector
issues a Certificate of Occupancy.
f. Eveo, building permit shall expire if the work authorized has not commenced within 12 months at~r the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

The public hearing concerning this matter was also held on February 25,
1983.
- Upon application of J. ROYAL AND VIRGINIA GIFFORD, 1515 Minnehaha
Boulevard, Southold, NY for a Variance to the Zoning Ordinance, Article
III, Section 100~32 for permission to build accessory building in the
sideyard area at p~emises known as 1515 Minnehaha Boulevard (a/k/a 60
Opechee Avenue), S~uthold, NY; County Tax Map Parcel No. 1000-87-03-050.
The board made the following findings and determination:
By this appeal, appellants seek permission to construct a detached
accessory garage structure approximately 21' by 24' to be located east
of the existing one-family dwelling structure. The setback proposed
from the easterly property line is five feet, and the setback from Opechee
Avenue shall not be forward of the existing dwelling structure. The
premises in question is a corner lot as defined by Section 100-34 of
the Zoning Code, with 109.5' along M/nnehaha Boulevard and 146.8' along
Opechee Avenue. This lot contains an area of approximately 16,280 square
feet. It is the opinion of the board that this building area shall be
deemed rear yard due to the unique circumstances of this corner lot.
In considerfng this appeal, the board determ/nes that the variance
request is not sUbstantial in relation to the requirements of the zoning
code; that the cfrcUmstances are unique; that by allowing the variance
no substantial detriment to adjoining properties will-be created; that
the difficulty ca~not be obviated by a method feasible for appellant
other than a variance; that the relief requested will be in harmony
with and promote the general purposes of zoning; and in view of the
manner in which the difficulty arose and in consideration of all the
~bove factors, th~ interest of justice Will be served by allowing the
variance as indicated below.
On motion by Mr. Sawicki, seconded by Mr. Goehringer, it was

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before January 7th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well. If any letter is returned to you undeliverable, you are requested
to make other attempts to obtain a mailin,q address or to deliver the letter to the current owner,
to the best of your ability, and to confirm how arran.qements were made in either a written
statement, or durin,q the hearin.q, providin.q the returned letter to us as soon as possible;
AND not later than January 8th: Please either mail or deliver to our office your Affidavit of
Mailin.q (form enclosed) with parcel numbers, names and addresses noted, and furnish to

more than one street or roadway, an extra sign is available for the additional front yard. Please
