(631) 765-1809 Fax (631) 765-9064 [~A,q ] 20i0 FINDINGS, DELIBERATIONS AND DETERMINATION ~7~. ~ MEETING OF FEBRUARY 18, 2010 $ou~o~ 'to'wa ¢~er~- ZBA File # 6331 NAME OF APPLICANT: JOSEPH LOGAN & KELLEY WALKER Property Location: 1110 Orchard St., Orient CTM 1000-25-4-10 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated Sept. 21, 2009 stating that this application is considered a matter for local determination as there appears to be no significant countywide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming16,464 square foot lot in the R-40 District. The parcel has a northerly boundary on Orchard St. measured at 100 feet wide, an easterly lot line of 189.89 feet, a westerly lot line of 211.50 feet, and a southerly lot line of 69.00 feet. The lot is improved with a 1,309 sq. ft. two story single-family dwelling and a 775 sq. ft. single story three-car garage as described on the survey by Nathan Taft Corwin Ill, dated July 23, 2009. The property also lies within a Southold Town Agricultural District and Historic District BASIS OF APPLICATION: Request for Variances under Section 280-124, and Section 280-15 (C) for proposed additions to the accessory garage, based upon the Building Inspector's Notice of Disapproval dated July 17, 2009, which states that: 1. Non-conforming lots, measuring less than 20,000 square feet in total size, require maximum lot coverage of 20%. The survey shows the proposed lot coverage at 22.9%. 2. The proposed additions to the accessory garage are not permitted pursuant to Article Ill, Section 280-15 (C), which states that such buildings shall not exceed 660 sq. ft. on lots containing up to 20,000 sq. ft." The survey notes a pre-existing non-conforming accessory garage at 775 sq. ft. with a proposed one-story addition that increases the size to 1,407 sq. ft. "The proposed additions and alterations are not permitted without review and approval by the Southold Town Landmarks Preservation Commission...' and that a 'Certificate of Appropriateness' must be issued before a Building Permit would be approved. LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on Dec. 3, 2009, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The Applicants request a variance to increase lot coverage in order to make additions and alterations to an existing single-family dwelling~ and to a pre-existing non-conforming 3 car accessory garage, and to construct a proposed in-ground swimming pool, which will increase lot coverage from an existing 13.2% to 22.9%, which is 2.9% above the 20% allowed by Town Code. The additional lot coverage as shown on map dated July 23, 2009 by Nathan Taft Corwin III, Land Surveyor including: 1. A proposed 8.5 ft. x 5.5 ft. enclosed entry, and a 12ft x 8.7 ft. covered porch addition on the rear of the existing single-family residence; 2. A proposed conversion of the pre-existing non-conforming accessory garage into a finished and heated artist's workshop by constructing a proposed 12ft. x 22.2 ft. framed addition on the southerly side of the garage which would contain a 12 ft. X 5 ft. half bath, a 12 ft. X 7. 6 ft. "silk-screen" room with slop sink, and a 12 ft. x 8. Two % ft. mechanical storage room; 3. A proposed 12ft. X 30 ft. wooden trellis along the easterly side of the proposed artist's workshop; 4. A proposed 20ft. X 40 ft in-ground pool in the rear yard 5. The Applicants also request an additional variance to expand the size of the pre- existing, non-conforming 3 car accessory garage from 775 sq. ft. to1407.1 sq. ff., then subsequently amended to 1,316 sq. ft. (266 SF addition and 275 SF trellis as amended below) which will exceed the maximum 660 sq. ft. size allowed by Town Code on this parcel. AMENDED APPLICATION: During the hearing on Dec. 3, 2009, the Applicant was asked to bring the plan into more conformity with the code. On Dec. 17, 2009, the Applicant, submitted a revised survey by Nathan Taft Corwin III dated Dec. 14, 2009, which shows a reduction in propose lot coverage from 22.9% to 21.5% by reducing the proposed trellis to 9ft. x 30 ft. and the proposed covered porch addition on the rear of the Page 3- February 18, 2010 ZBA File#6331 - Logan/Walker CTM: 1000-25-4-10 at 1110 Orchard St., Orient dwelling from 8.7 ft x 27.1 ft to 8.7 ft x 12 ft. The Board also suggested a reduction in the size of the proposed 20 ft x 40 ft in ground pool, which was not noted on the revised survey. REASONS FOR BOARD ACTION: Based on testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law ~267-b(3)tb)(3)tt). Granting of the variances as applied for on the amended survey will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's pre-existing non- conforming accessory garage and dwelling are within the Orient Village historic area. The lots in the general vicinity are varied in size, and some properties contain pre- existing non-conforming accessory garages and agricultural structures, some of which are being used as artists' workshops. However, these conditions are not typical, and the Board finds that increasing the size of the pre-existing, non-conforming accessory building as the applicants' amended application proposes, would create a 1316 sq. ft. structure that would be almost twice the size of a conforming structure, and which would be somewhat larger than the applicants' existing 1309 sq ft. single-family dwelling on the property. Moreover, increasing the non-conformity of the accessory garage as proposed is contrary to the intent of Article III, Section 280-15 (C) of the Town code, which regulates the size, setbacks and height of accessory structures in proportion to lot size to insure that accessory structures on residential properties remain incidental to principal dwellings in order to preserve the character of the neighborhood. 2. Town Law §267-b(3){b)¢2). The benefit sought by the applicant for the proposed artist's studio can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The addition of a half bath in an accessory structure is permitted by code and an artist's workshop is a permitted use in an accessory structure. While the Board acknowledges the applicants' written and oral testimony describing the need for an artist's workshop in which large-scale works of art can be created, the pre- existing non-conforming accessory garage is already large at 775 sq. ft and exceeds the 660 sq. ft. size currently allowed by code on this non-conforming 16,464 sq. ft. lot. Therefore, the Board finds that the applicants can accommodate their need for an artist's workshop without significantly increasing the non-conformity of the existing accessory structure. 3. Town Law §267-b(3)(b)(3). The variance requested herein in the amended application for the proposed addition to the pre-existing non-conforming 775 sq. ft. 3 car accessory garage in order to convert it to an artists' workshop will enlarge the accessory structure by 266 sq. ft. of interior space and by another 275 sq. ft. for the proposed trellis for a total of 1,316 sq. ft, which is 99% more than the code permitted maximum of 660 sq. ft and is very substantial. Even without the proposed trellis, the proposed artists' workshop addition alone would be a 58% variance beyond the code permitted maximum size, and is substantial. The proposed increase in lot coverage is not substantial, at 1.5% more than the 20% maximum allowed by Town Code. However, the Board did not reach the merits of the lot coverage variance because a denial of the proposed addition to the accessory structure would bring the application in to compliance with the lot coverage requirements. As such, the Board's consideration of lot coverage is academic. Page 4- February 18, 2010 ZBA File#6331 - Logan/Walker CTM: 1000-25-4-10 at 1110 Orchard St., Orient 4. Town Law §267-b(3)(b}(41. Evidence suggests that a variance in this residential community for the proposed addition to the accessory structure will have an adverse impact on the physical or environmental conditions in the neighborhood. The Board has determined that virtually doubling the non-conformity of the pre-existing non-conforming 775 sq. ft. accessory structure on the applicant's non-conforming 16,464 square foot residential lot in the R40 District will be out of keeping with the smaller building scale and existing character of the neighborhood 5. Town Law §267-b(3)(b)(5). The difficulty has been se/f-created. The pre-existing accessory garage building is already non-conforming at 775 sq. ft. The request for a total of 1,316 sq. ft, which is 99% more than the code permitted maximum of 660 sq. ft is very substantial. The Applicants can accomplish their goal of converting the pre- existing non-confirming accessory garage into an artists' workshop with half bath without significantly increasing the non-conformity of the structure. 6. Town Law §267-b. Denial of the relief requested will enable the applicant to enjoy the benefit of constructing proposed additions to the single family residence, converting an accessory building into an artists' workshop, and constructing a swimming pool on this property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The Board finds that upon applying the balancing test, that the benefit to the applicant in granting the requested relief as applied for does not outweigh the detriment to the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Goehringer, and duly carried, to Deny, the variance as applied for on the amended site survey by Nathan Taft Corwin III dated December 14, 2009 and the architectural drawings by Meryl Kramer, Architect, labeled Logan Walker Residence - Garage, Floor Plan, South Elevation and East Elevation. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The proposed work will enhance the character of the neighborhood by keeping the traditional New England style to blend with the surrounding homes and by keeping the existing setbacks that have been maintained over many years. The windows, materials and general massing of the house and garage are in keeping with that of the original structures. Additionally, the renovation of the house and garage will bring both buildings into compliance with current NYS Residential Building Code and NYS Energy Code. The benefit sought by this project requires an area variance. The odginal house was added to on the east and south sides. The design and construction of the proposed additions are in keeping with the size and scale of the previous additions. The porch addition on the south side of the main house enlarges the existing porch so that it becomes usable and integrates the roof design with the existing roof. On the south side of the existing garage, the proposed addition will house the new powder room, silkscreen booth and mechanical room. In order to make the garage building into a year-round usable space, these support spaces are necessary. The new addition will leave the odginal garage structure intact, and the new design will match the roof slope and building style of the original garage. On the east side, the trellis and patio addition will "soften" the appearance of the garage on the property and provide a shaded area to congregate out of doors for the homeowners. The amount of relief is not substantial because the proposed construction will not impede on the required setbacks and will minimally affect the allowable maximum lot coverage by 2.9%. Part of the proposed project will be to update the existing septic system, which includes a new well. This work will be a substantial improvement to the existing system which does not meet Suffolk County Department of Health Services sanitary system standards. The porch and garage additions are located on the south side of the property and not visible from the street. The swimming pool will be located at the rear of the property, and will not contribute any building mass to the property. The difficulty has not been self created. The benefit sought by this project CANNOT be achieved without an area variance. The existing garage currently has nonconforming area. The new work simply provides support services to the existing garage space while leaving open space of the existing structure intact.
