Thank you. Before we get to the business of the agenda, I just want to acknowledge, first and

foremost Charlie Zaloom of Mattituck, he is a member of the Mattituck stakeholders. Charlie is
actually volunteering, he is a pilot by license, he has been volunteering in Haiti flying baby
formula and necessary supplies to remote areas. I just want to wish him well on behalf of
everybody in the community. Another thing that I want to mention is that as we all know, our
comprehensive plan has been initiated by this Town Board. We have a public hearing, sony,
public input meetings, informal public input meetings. We have one scheduled for Thursday
February 4th, 11:30 am at the Peconic Landing and Saturday February 6th, 10:30am at the Human
Resources Center in Mattituck. The entire public is welcome to come and participate. The more
public participation we get, I think the better plan we are going to have when it is all said and
done. With that said, I am going to ask anybody that has comments on the agenda to please
come up. Does anybody want to comment on the agenda items? Heating none.

Fiscal Impact:
As requested by George Sullivan, a small additional amount of overtime was earned and paid in 2009,
and office supplies and tax bill processing slightly exceeded the budgeted amounts. Over $12,0OO is
available in the Seasonal clerical appropriation, which is available to cover these over-expended
appropriations.

Town of Southold and the Town of Shelter Island for Calendar Year 2010 Regarding Receiving and
Dispatching Radio Transmissions on Behalf of Shelter Island Town by the Town of Southold at Its Radio
Base Station
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Scott A. Russell to execute the Police Radio Agreement between the Town of
Southold and the Town of Shelter Island for calendar year 2010 regarding receiving and
dispatehlng radio transmissions on behalf of Shelter Island Town by the Town of Southold
at its radio base station, whereby the Town of Shelter Island agrees to pay the Town of
Southold the sum of $43,277.00 for 2010, with annual increases consistent with CPI, subject to
the approval of the Town Attorney.

vehicles that anticipated. Bay Constable overtime earnings: short a Bay Constable for most of the year.

Police Overtime Earnings: Sergeant shortage during the year. Laundry & Dry Cleaning: a contractual

Tour Fundraiser on Sunday, May 23, 2010

Police Department cost for the event = $15.22
RESOLVED that the Town Board of the Town of Southold hereby grants permission to New
York Organ Donor Network {NYODN) to hold a 35 mile North Shore Bike Tour fundraiser
to begin at Osprey Dominion Winery, in Peconic~ ride to Orient Point and back to the
winery on Sunda¥~ May 23~ 2010 beginning at 9:00AM, provided they file with the Town
Clerk a One Million Dollar Certificate of Insurance naming the Town of Southold as an
additional insured and contact Capt. Flatley upon receipt of the approval of this resolution to
coordinate traffic control. Support is for this year only, as the Southold Town Board continues to
evaluate the use of town roads.

RESOLVED that the Town Board of the Town of Southold hereby grants permission to the
Oysterponds U.F.S.D. to hold its Annual 5K Run/Walk race on Saturday~ May 15~ 2010
beginning at 10:00 AM and to use and close the following route and roads: Main Road (at
school) to Platt Road, Halyoke Road, Orchard Street, Narrow River Road, Harbor Street,
Douglass Street, King Street, Village Lane, and Tabor Road, provided they file with the Town
Clerk a One Million Dollar Certificate of Insurance naming the Town of Southold as an
additional insured and contact Capt. Flatley upon receipt of the approval of this resolution to
coordinate traffic control. Support is for this year only, as the Southold Town Board continues to

WHEREAS, the State of New York provides financial aid for household hazardous waste
programs; and
WHEREAS the Town of Southold, herein called the MUNICIPALITY, has examined and duly
considered the applicable laws of the State of New York and the MUNICIPALITY deems it to
be in the public interest and benefit to file an application under these laws; and
WHEREAS, it is necessary that a Contract by and between THE PEOPLE OF THE STATE OF
NEW YORK, herein called the STATE, and the MUNICIPALITY be executed for such STATE
Aid;
NOW, THEREFORE, BE IT RESOLVED BY the Town Board of the Town of Southold:
1)
That the filing of an application in the form required by the State of New York in
conformity with the applicable laws of the State of New York including all understanding
and assurances contained in said application is hereby authorized;
2)
That Supervisor Scott A. Russell, or his designee is directed and authorized as the official
representative of the MUNICIPALITY to act in connection with the application and to
provide such additional information as may be required and to sign the resulting contract
if said application is approved by the STATE;
3)
That the MUNICIPALITY agrees that it will fund the entire cost of said household
hazardous waste program and will be reimbursed by the State for the State share of such
costs;
4) That five (5) Certified Copies of this Resolution be prepared and sent to the NYSDEC
together with a complete application;
5) That this Resolution shall take effect immediately.

RESOLVED that the Town Board of the Town of Southold hereby approves the updated
Recreation Department's refund policy (as approved by the Parks, Beaches, and Recreation
Committee) as follows:
REFUND POLICY
Full refunds will be granted ifa class or program is canceled due to insufficient enrollment or is
canceled by the Recreation Department - no cancellation fee will be assessed. We cannot issue
refunds for trips, special events, or ticketed events unless someone is on a waiting list for said
event and we are able to fill your spot. If this occurs, a $5.00 cancellation fee will be assessed. A
full refund will be issued if the registrant cancels their registration two or more weeks before a
class or program, however, the $5.00 cancellation fee will be assessed to the participant per class
or program. No refunds will be issued if the request is made two weeks or less before the start of
a class or program. Refunds are not offered to registrants after the start of a class or program.
Please note: If you do not show up for a program or class, we cannot give you credit and allow
you to participate in the next session. You must register again and pay the full price. When
requesting a refund, please provide us with your receipt number. Refunds will be mailed out
approximately 2 - 4 weeks following the participant's request and will be issued in the form of a
check. If your class payment was made with a Visa or MasterCard, refunds will be credited back
to the same credit card used at the time of registration.

LOCAL LAW NO. 2010
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 275~ Wetlands
and Shoreline".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose - In order to provide for the health, safety and welfare of the citizens of the
Town of Southold, and to protect the natural protective areas existing within the Town, it is
necessary to make certain amendments to Chapter 275. These amendments are intended to
support the protection of environmental features within the Trustees' jurisdiction, simplify the
permit process, codify and clarify policies and strengthen enforcement.
II.
Chapter 275 of the Code of the Town of Southold is hereby amended as follows:
ARTICLE 1
General Provisions
§ 275-4 Exceptions.

A. The provisions of this chapter shall not require a permit for the following:

The ordinary and usual operations relative to residential horticulture within
Trustees' jurisdiction provided they are limited to the use of noninvasive native
species of vegetation. This exception does not include activity on a bluff. Re-
grading and removal of trees are not considered such ordinary and usual
operations.
ARTICLE II
Permits
§ 275-5 Permit procedures.

B. Administrative permit.

The following operations will be considered for administrative review, in
accordance with the standards set forth in § 275-11. The Board of Trustees may
consider operations for administrative review other than those listed below if the
operations fall within the definition as set forth in § 275-5 B(1):

(g) The demolition, removal, relocation, repair and/or upgrading of existing fuel
tanks of less than 550 gallon capacity, fuel lines, fuel dispensers,
cesspools, septic systems, or sanitary wastewater activities, including
necessary site work, and provided that such activity will not have an
undue adverse impact on the wetlands and tidal waters of the Town.

An application for proposed aquaculture activity that includes surface
mounting gear in an area greater than five square yards.
C. Emergency permits.
The Trustees may issue a temporary emergency permit where specific exigent
circumstances exist that may result in personal or property loss or damage. Upon
expiration of temporary permit or before the date of expiration, the applicant must apply
for a permit as set forth in §§ 275-5,275-6 and 275-7.
§ 275-7 Fees.

Dock and float fee. Every application for a new dock or float shall include a fee equal to
$3 per square foot ~ for residential and commercial docks· Commercial
docks are any structures that are rented, leased or otherwise used to generate income,
including, but not limited to, those structures located on properties zoned MI and M2.

Administrative permits. An administrative permit includes operations that are is-deemed

and a public hearing and notice are not required prior to issuance ora permit. The final

A statement that "The permittee is required to provide evidence that a copy of this
Trustee permit has been recorded with the Suffolk County D~
Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel.
Such evidence shall be provided within 90 calendar days of issuance of this permit."

All applicants for docks, including catwalks and ramps, extending across the
foreshore shall be required to give and maintain a public passing way on the
landward end of the dock, on-the-upland, not less than five feet in width, to enable
persons to pass and repass around said dock or by steps or a ramp allowing
pedestrian passage.
§ 275-12.1. Stop-work orders.
The Bay Constable, Zoning Inspector, or Code Enforcement Officer is authorized to issue
stop-work orders pursuant to this section. The Bay Constable, Zoning Inspector, or Code
Enforcement Officer shall issue a stop-work order to halt:
(1)
Any work that is determined by the Bay Constable, Zoning Inspector, or Code
Enforcement Officer to be contrary to any applicable provision of this chapter, or:
(a)
Any work that is being conducted in a dangerous or unsafe manner in the
opinion of the Bay Constable, Zoning Inspector or Code Enforcement
Officer, without regard to whether such work is or is not work for which a
Trustee permit is required, and without regard to whether a Trustee permit
has or has not been issued for such work; or

B. Stop-work orders shall:
(1) Be in writing;
(2)
Be dated and signed by the Bay Constable, Zoning Inspector, or Code
Enforcement Officer;

The Bay Constable, Zoning Inspector, or Code Enforcement Officer shall cause the stop-
work order, or a copy thereof, to be served on the owner of the affected property, and if

the owner is not the permit hold~r, on the p~rmit holder, personally or by certified mail to
the owner or permit holder and posting at the work site. The Bay Constable, Zoning
Inspector, or Code Enforcement Officer shall be permitted, but not required, to cause the
stop-work order, or a copy thereof, to be served on any or all of the following: builder,
architect, tenant, contractor, subcontractor, construction superintendent, or their agents,
or any other person taking part or assisting in work affected by the stop-work order,
personally or by certified mail and posting; provided, however, that failure to serve any
person listed above shall not affect the efficacy of the stop-work order.

ARTICLE III
Administration and Enforcement
§ 275-15. Coordination and enforcement.
The Director of Code Enforcement, Zoning Inspector, and/or the Bay Constable are responsible
for coordination and enforcement of the provisions of this chapter. The Director of Code
Enforcement, Zoning Inspector, and Bay Constables have the authority to issue violations of this
chapter.
§ 275-16. Compliance requirements; penalties for offenses.
It shall be unlawful for any carter, owner, occupant, builder, architect, contractor or their
agents or any other person to fail to comply with any provisions of this chapter or to fail
in any manner to comply with a written notice, directive or order of the Director of Code
Enforcement, Zbning Inspector, or Bay Constable or to conduct any operation in a
manner not in compliance with a permit issued pursuant to this chapter.
For each offense against any of the provisions of this chapter or any regulations made
pursuant thereto, or failure to comply with a written notice or order of any Director of
Code Enforcement, Zoning Inspector, or Bay Constable within the time fixed for
compliance therewith, the owner, occupant, builder, architect, contractor or their agents
or any other person who commits, takes part or assists in the commission of any such
offense or who shall fail to comply with a written order or notice of the Director of Code
Enforcement, Zoning Inspector, or Bay Constable shall be subject to the following fine
schedule. Each day on which such violation occurs may constitute a separate, additional
offense.

Other offenses. For an offense against any of the provisions of this Chapter not
specifically designated above, a violator shall be subject to a fine of not more than
$1,000.00.

IlL SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as

Manor Grove SEQRA & Elect to Purchase Open Space
WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of
the purchase of open space fee title on certain parcels of property from The Nature Conservancy,
contract vendee for the properties owned by Manor Grove Corp. on the 2nd day of February,
2010, at which time all interested parties were given the opportunity to be heard; and
WHEREAS, said property is identified as part of SCTM #1000-53.-1-1.3 and part of SCTM
#1000-53.-1-1.2. The addresses are 650 Albertson Lane and 68775 Route 25, respectively, in
Greenport. The properties are located in the R-80 and LB zoning districts at the northeasterly
intersection of NYS Route 25 and Albertson Lane in Greenport, New York; and
WHEREAS, the purchase comprises a part of the properties consisting of approximately 27.36±
acres (subject to survey) of the total property area, which excludes from the purchase an area of
approximately 0.72± acre which includes the existing residential building and 2 accessory barns,
as well as an area of approximately 0.38± acre which is involved in a lot line modification. The
exact area of the open space fee title purchase is subject to a survey acceptable to the Land
Preservation Committee, the County of Suffolk, and The Nature Conservancy (contract vendee);
and
WHEREAS, the proposed acquisition is for the Town of Southold to acquire a fifty percent
(50%) undivided interest in and to the approximately 27.36± acre property and for the County of
Suffolk to acquire the remaining fifty percent (50%) undivided interest in and to the
approximately 27.36± acre property, as tenants-in-common for open space purposes. The total
purchase price is $1,125,000 (one million one hundred twenty-five thousand dollars) and such

purchase price will be divided equally in the respective amounts of $562,500 by the Town of
Southold and $562,500 by the County of Suffolk. The purchase will be funded by the Town's
Community Preservation Fund and the County of Suffolk in a 50%/50% partnership which will
include the purchase price and any related acquisitions costs associated with the purchase of
these parcels; and
WHEREAS, the properties are listed on the Town's Community Preservation P'roject Plan as
properties that should be preserved for purposes of open space, nature preserves, passive
recreational areas, wetland protection, significant biological diversity protection and furtherance
of a greenbelt. The purpose of this acquisition is for open space protection, passive recreational
purposes, wetland and biological diversity protection and to expand the existing preservation and
protection efforts of the Town and County within the Pipes Cove Area. Proposed uses of the
property may include the establishment of a nature preserve, passive recreational area with trails,
and limited parking for access purposes, all subject to a Management Plan which will be
developed for this property; and
WHEREAS, the Land Preservation Coordinator has reviewed the acquisition in accordance with
Chapter 117 (Transfer of Development Rights) of the Code of the Town of Southold, Section
117-5. Sanitary Flow Credits may be available for transfer from the properties upon the Town
and County's purchase of the properties. The County of Suffolk will determine the number of
Sanitary Flow Credits available from the properties. The Sanitary Flow Credits will be divided
equally between the Town and County. The transfer of the Sanitary Flow Credits allotted to the
Town will not be finalized, and shall not occur, until the Town closes on the properties, and the
Town Board passes a resolution allowing the transfer into the Town TDR Bank; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 185 (Open Space
Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
("LWRP") and the LWRP Coordinator recommends that this action is consistent with the
LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire an open space fee title purchase; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase fee title on this open space land; and,
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted

Comments regarding resolution # 161
COUNCILMAN ORLANDO: Because we are partnering with Suffolk County on this to help the cost,
aye.
COUNCILMAN KRUPSKI: I would like to really thank Melissa for her efforts and Randy from the
Nature Conservancy for his efforts. This is part of an assemblage of the Pipes Cove area, it was the focus
made probably 10 or 15 years ago to try to preserve a lot of this watershed that drains into Pipes Cove and
into Peconic Bay and they have done a great job on focusing on this and future generations will really
marvel at the effort that was made there, as they walk through there. And I vote aye.
SUPERVISOR RUSSELL: Yes. I will echo what Vinnie and what Albert said. It wasn't the most
compelling purchase we have made since I have been Supervisor but if you look at the larger issues,
number one the public access issues, the assemblage of parcels that are already there and the partnership
with Suffolk County, those three things make it a very compelling purchase at this point. I vote yes.

COUNCILMAN TALBOT: NOTICE IS HEREBY GIVEN that pursuant to the provisions of
Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands) of the Town
Code, the Town Board of the Town of Southold hereby sets Tuesda¥~ February 2~ at 4:35 p.m.~
Southold Town Hall~ 53095 Main Road~ Southold~ New York as the time and place for a
public hearing for the purchase of properties from The Nature Conservancy, contract vendee
for the properties owned by Manor Grove Corp. Said properties are identified as p/o SCTM
#1000-53-1-1.3 and p/o SCTM#1000-53-1-1.2. The area to be purchased is approximately
27.364- acres of the total property area, which excludes from the purchase an area of
approximately 0.72 acres which includes the existing residential building and 2 accessory barns,
as well as an area of approximately 0.384- acres which is involved in a lot line modification. The
addresses of the properties are 650 Albertson Lane and 68775 Route 25, respectively, in
Greenport, New York. The properties are located within the R-80 and LB zoning districts.
The proposed acquisition is for the Town of Southold to acquire a fifty percent (50%) undivided
interest in and to the approximately 27.364- acre property and for the County of Suffolk to
acquire the remaining fifty percent (50%) undivided interest in and to the approximately 27.364-
acre property, as tenants-in-common for open space purposes. The exact area of the purchase is
subject to survey. The total purchase price is $1,125,000 (one million one hundred twenty five
thousand dollars) and such purchase price will be divided equally in the respective amounts of
$562,500 by the Town of Southold and $562,500 by the County of Suffolk. The purchase will
be funded by the Town's Community Preservation Fund and the County of Suffolk in a
50%/50% partnership which will include the purchase price and any related acquisition costs
associated with the purchase of these parcels.
The properties are listed on the Town's Community Preservation Project Plan as property that
should be preserved for purposes of open space, nature preserves, passive recreational areas,
wetland protection, significant biological diversity protection and furtherance of a greenbelt. The
purpose of this acquisition is for open space protection, passive recreational purposes, wetland
and biological diversity protection and to expand the existing preservation and protection efforts
of the Town and County within the Pipes Cove Area. Proposed uses of the property may include
the establishment of a nature preserve, passive recreational area with trails, and limited parking
for access purposes, all subject to a Management Plan which will be developed for this property.
The Land Preservation Coordinator has review the acquisition in accordance with Chapter 117
(Transfer of Development Rights) of the Code of the Town of Southold, Section 117-5. Sanitary
Flow Credits may be available for transfer from the properties upon the Town and County's
purchase of the properties. The County of Suffolk will determine the number of Sanitary Flow
Credits available from the properties. The Sanitary Flow Credits will be divided equally between
the Town and County. The transfer of the Sanitary Flow Credits allotted to the Town will not be
finalized, and shall not occur, until the Town closes on the properties, and the Town Board
passes a resolution allowing the transfer into the Town TDR Bank.

We have the notification by the Town Clerk's office on the bulletin board, it has been noticed in
the legal section of the local newspaper. There is memorandum note from the LWRP
coordinator, another one from the Town Board of the Town of Southold regarding the principal
planner, LWRP coordinator, just information from the Town Board.
SUPERVISOR RUSSELL: At this time I would invite anybody to come up and address the
Town Board on the issue of this particular acquisition. I see Randy here, Melissa. Melissa first.
MELISSA SPIRO, LAND PRESERVATION COORDINATOR: Melissa Spiro, Land
Preservation Coordinator. Not to repeat everything but I would just like to point a couple of
things out. Both the Town and the County have been working for years towards the purchase of
these properties and others within the Pipes Cove area. The Manor Grove property is adjacent to
and in the vicinity of other preserved lands but we just show the Pipes Cove area and the Pipes
Cove greater area. We show that on this map or these maps up here. Purchase of the property
will further the preservation efforts we have been doing in this area, in addition to allowing for
the expansion of existing nature trails that we have in the area. The Nature Conservancy has
been facilitating this project under a contract the town has with them as they have been doing the
same for most of the properties in the Pipes Cove area. The property includes a residential
dwelling, it is not part of the purchase. The Nature Conservancy is already in contract to
purchase the entire property from Manor Grove corporation with the intent to sell the property
back to the Town and the County for open space purposes after subdividing the existing dwelling
out. The purchase will be shared equally by the Town and the County and the Town is funding it
or will be funding it through the Community Preservation Funds. The Land Preservation
Committee is in favor of continuing the efforts we have had in the Pipes Cove are and they
recommend that the Town Board proceed with this purchase. Randy Parsons from the Nature
Conservancy is here, he has put a lot of effort into this and he is here to address any questions or
concerns the Town Board or the public has in regard to this project. Thank you.
SUPERVISOR RUSSELL: Thank you. Would anyone else like to come up and address the
Town Board on the issue of acquisition of this parcel?
BENJA SCHWARTZ: If nobody else is interested? I am Benja Schwartz from Cutchogue and
the Pipes Cove area, I have spent some time sailing by there and the Greenport harbor and I am
in favor of any natural preservation, preservation of property on the north fork. I don't really
have anything particular specifically to say about this property except it is part of our region
which is, you know, includes marshes and wetlands which are second only to rain forests in their
biological productivity and I was at the meeting on the new comprehensive plan for Southold
Town last night and I happened to talk with a real estate agent there. When I proposed that we
should perhaps try to encourage eco-tourism, she responded what are we going to give them,
tours of the dump? Well, you know, we have got a lot more important environments here,
although the area at the landfill is part of our natural or environmental although it has been

corrupted by a lot of waste there, I think that in the past we had an idea that we could just keep
dumping our waste, dumping our waste. Well, thank god we have moved past that idea. The
dump filled up and New York State put an end to our dumping, so now we have a transfer
station. Unfortunately in town we still have a long way to go and we will be talking later about
the comprehensive plan but this is an important part of the programs which may lead to a
sustainable environment and economy here in Southold Town. I am in support of this. Thank

MS. SPIRO: Well, this whole area is all Pipes Cove here. Here is Pipes Neck Road (inaudible)

MR. COPERTINO: Is that preserved now? The property just noah of Pipes Cove?
MS. SPIRO: These properties in green are all preserved properties.
SUPERVISOR RUSSELL: Would anyone else like to address the Town Board on the issue of
this acquisition?
JIM DUGGAN: Jim Duggan, East Marion. Have you noticed the tree pruning services coming
from Orient to Southold?
SUPERVISOR RUSSELL: The what services?
MR. DUGGAN: The tree pruning services that is going on.
SUPERVISOR RUSSELL: The state? Because the town is out pruning now.
MR. DUGGAN: Well, whoever is doing it. Do we have any input at all?
SUPERVISOR RUSSELL: We tried to. We actually have a gentleman who works in the
highway department that has been very active in trying to get the state and in some cases,
subcontractors, to do the fight thing. Unfortunately it is their right of way. And they maintain
stewardship of their fight of way. But we certainly try to have as much input as we can. We
have a very active tree committee that tries to also guide them in the right direction but make no
mistake, they are not artists when they are out trimming trees, we know that.
MR. DUGGAN: I know nothing about horticulture or anything like that but it really, really
looks like they are decimating our trees along that route. So maybe we could just check up on
them ....
SUPERVISOR RUSSELL: Absolutely.

MR. DUGGAN: And see if they are actually tree experts and just not people because it doesn't
appear to me, who is certainly untrained, that they are doing a great job.

acquisition?
CARA WELLS: My name is Cara Wells and I think this ~s a very important extension of the
Nature Conservancy's Pipe Cove project and instrumental of the maintenance of clean water and
sustainable fisheries, so I really think this is an important acquisition and I heartily agree with it.
And they are butchering the trees.

SUPERVISOR RUSSELL: That concludes the public hearing, the business of the public
hearing. I would now offer anybody the opportunity to come up and address the Town Board on
any issue.
STEVE HUSAK: Good afternoon, Steve Husak, Mattituck. I have to question, what are we
preserving all this land for? I would like an answer. Why do we preserve land in Southold
Town?
SUPERVISOR RUSSELL: Well, there is probably 15 different reasons. First, if we are
preserving farmland, it is to keep farming vital and bona fide. If we are preserving parkland, it is
for this generation and future generations. It is also to protect the environment.
MR. HUSAK: Well, after the last two weeks, I really believe that the Land Preservation
Committee believes we are saving it so we can sit and look at it and not even use it.
SUPERVISOR RUSSELL: Steve, I know what you are going to refer to and I actually agree
with you on that. I don't think there is any reason why a Boy Scout troop should wait or have to
apply for a use of a public asset two months in advance. I am having a meeting, I believe
scheduled later this week with the principal people involved. We adopted a land use plan or
stewardship plan for that parcel, the Laurel Lake parcel, a few years ago that requires a two
month review process for a Boy Scout troop, then we made a fatal flaw and we need to undo
that. This is, we are trying to balance the needs of the parcel and good stewardship with the use
of the community. But no Boy Scout troop should have to wait, nobody period, should have to
wait two months for a review and approval.
COUNCILMAN ORLANDO: You didn't have your event last weekend, Steve?

MR. HUSAK: We held the event, my wife had to take her lunch hour to walk the trails up there
with the Land Preservation Committee to mal~e sure the Boy Scouts did not damage Southold
Town assets. That is an insult to any Boy Scout that ever put the uniform on.
SUPERVISOR RUSSELL: Well, I think again...
MR. HUSAK: And I am speaking as a parent. I am not speaking in any leadership position. I
am speaking as a parent.
SUPERVISOR RUSSELL: I think that there is, again, an effort to try to balance the needs of the
ecosystem there with public use but again, we need to get our act together. I think the suggestion
to you, via email, was you should have applied two months prior and that is not very user
friendly government. We need to change that, at the very least.
MR. HUSAK: And in the past the town has always put a port-a-potty there for us. It cost us
almost $100 with tax this year. That is money we could have spent for the child use. Parents are
going through hard times, that would like to go on a trip. You know, $100 is $100 in this day
and age. And I don't see why, for three years, we had a port-a-potty from the town and this year
we were forced to purchase one.
SUPERVISOR RUSSELL: I don't remember anybody requesting one.
MR. HUSAK: We requested it and we were told it was our responsibility. If you look at
Strawberry Fields, how much does the town spend on the maintenance of that field for the illegal
alien soccer league on Sunday's up there. The town is up there mowing that field every week,
emptying the garbage cans up there every week and probably paying for the port-a-potties up
there. This is for people that don't even live in this town. And anybody that doesn't believe it,
come up to the Strawberry Fields every Sunday and see the 300-400 soccer players up there and
most of them are from outside of Southold Town because they have been kicked out of their own
towns and their own fields and they are using our fields and we can't get a port-a-potty for the
Boy Scouts? Come on. My next thing, two years ago I came to you when the traffic light went
in at the comer of Cox Neck and 48 there and I asked you for a no turn on red eastbound onto
Sound Avenue. It still isn't up and more and more people run that red light heading eastbound.
If there is a truck in the main eastbound lane, people come around the backside of it, don't even
look and go straight through that red light.
SUPERVISOR RUSSELL: We relayed that to the Transportation Commission that made a
request to the Suffolk County Department of Public Works, which has oversight of that road, and
we are waiting for them. Unfortunately, that is not a town road. That is not our light. So all we
can do is request on behalf of the constituents and hope that they ....
MR. HUSAK: Inaudible.
SUPERVISOR RUSSELL: We absolutely will. They might, you know, the answer might be no

but I will request it again.
MR. HUSAK: Technically, that is not a right turn on red there, that is a continuation of Sound
Avenue. Sound Avenue starts at 25A in Baiting Hollow, wherever that is up in that end and ends
at 25 in Mattituck by the Presbyterian Church. That is not a right turn on red, that is a
continuation of Sound Avenue.
SUPERVISOR RUSSELL: Well, I will certainly bring that to their attention. But their
engineers go out and evaluate upon request and look at the site and make a determination. It is
the engineers at the end of the day that are going to make a decision.
MR. HUSAK: Those are the same engineers that can't get the timing of that light right and you
sit there for four or five minutes, when they put a double loop under the concrete to trip it and
now you only get a green light there when westbound traffic comes past Strawberry Fields. I
don't have high hopes for the county engineers.
SUPERVISOR RUSSELL: Well, if they are watching, certainly not tonight.
MR. HUSAK: And the last thing on the list, down at the end of Breakwater Road before you get
to Breakwater beach on the right hand side where the old tank farms used to be, the one
remaining piece of property that the town owns, rumors of volleyball court going in there now?
SUPERVISOR RUSSELL: Not, there has been no request made to me directly for a volleyball,
you are talking about that tiny little piece of property right to the right?
MR. HUSAK: The property where you put the four or five...
SUPERVISOR RUSSELL: No one has made a request to me. I don't know, Vinnie you are
the...
COUNCILMAN ORLANDO: No, I haven't heard anything.
SUPERVISOR RUSSELL: If the request was made to the Town Board, it would be referred to
the Parks and Recreation Committee. Vinnie is the liaison, so then he would discuss with that
committee and then bring it back to the Town Board.
MR. HUSAK: We just heard about it through our civic association up there and when they
found out I was coming, they asked me to ask you if there was permanent...
SUPERVISOR RUSSELL: No request has been made of the town.
COUNCILMAN ORLANDO: If people are talking about it, it didn't get to here yet.
MR. HUSAK: Okay. Okay. It is just a matter of parking down there. Very limited parking.

MELISSA SPIRO: Melissa Spiro, Land Preservation Coordinator. I would just like to respond
to that comment in regard to the Boy Scouts on Laurel Lake. I myself was not involved,
however John Sepenoski who is chair of our Land Preservation Committee as a volunteer, did
volunteer his time and I believe also his lunch hour and after work and maybe even on the
weekend, I am not sure, to go out to meet to make sure that what the Boy Scouts were doing and
the properties they were using were the Town's properties because I believe in the past, we do
own a lot of land around Laurel Lake and that there had been some misunderstandings. We do
have a contract with the water authority and the county and all of those contracts have some
strings attached to them and some restrictions and so John just wanted to go out there and make
sure that everything was in accordance with what the town had to make sure that everything had
in accordance with all of our plan. There is certainly no intent to make people wait two months
for ....
SUPERVISOR RUSSELL: That was the suggestion and that is what I need to react to. But I
understand the goals that he was trying to achieve there.
MS. SPIRO: Right. The Land Preservation Committee meets every two weeks and we try to
keep stuff going on that kind of timely basis. I hope this won't happen in the future with the Boy
Scouts or any other user or intended user of the town's property. Thank you.
SUPERVISOR RUSSELL: Would anybody else like to come up and address the Town Board
on any issue?
WILLIAM GIBBONS: My name is William Gibbons, Orient. I am here to discuss the public
water issue. I noticed at the beginning of the meeting you mentioned that you had some input
meetings, I don't know if that ....
SUPERVISOR RUSSELL: The comprehensive plan? Absolutely. Yes.
MR. GIBBONS: I am 100 percent in favor of public water. I have been asking for it for 10
years now. My nitrate level is like 20, the people that own the property at the other end of my
property found out after they built their house that it was built on a dump and they still have
gasoline in their water. I had gasoline in my water, you can't cook with it. I don't even want to
shower with it. You wake up in the morning, you wash your face, your eyes burn. I know that
there were 14 people that instigated legal action and I just don't understand it. One of the
people, one of the 14, they had a son that died of cancer several years ago and this person told
me that they blamed it on the water. But they are still pursuing the idea of not giving us public
water in Orient and I am really outraged about it. It is an unhealthy situation and I think it
should be corrected. I know a lot of people haven't spoken out about it. And I am going to
continue to do so.
SUPERVISOR RUSSELL: Let me just mention, I am in the process, I was organizing a
community meeting for all of Orient to have discussions like this, public water. I think there is a
lot of hoopla on both sides of the issue and we really need rationale discussion at this point and I

think people need to understand precisely what the town's position is. I had to cancel the
meeting because of my father's death but I plan on having one very soon. We are going to
schedule it out in Orient and go out and talk about the town's position and how this whole
dynamic works. But Southold Town Board has no formal position for or against public water in
Orient. What we have is an agreement with the Suffolk County Water Authority that is a 20 plus
year old agreement that if they are going to amend the water map, where the water goes in
Southold Town, they would make a formal request to this Town Board, we would schedule a
public hearing, you know, order SEQRA and do all those components of a public heating.
Public input, the whole thing. And then make a decision on whether we would agree to amend
the map or not. We do it by local law. We are still waiting. I have gotten promises from the
director up there that we are going to get a letter requesting an amendment to the water map. We
still haven't gotten that. We don't have anything to act on because the water authority hasn't
provided us with a letter requesting the amendment to the water map. Our position at this point is
a neutral position. It is not for us to deny water to people that want it or need it but it is not for
us to go back on what has been a 25 plus year agreement with the Water Authority that both
sides need to honor.
MR. GIBBONS: It just seems silly to me that if stimulus funds are being made available and
they are not being utilized, I think that is crazy. Eventually, somewhere down the line, they are
going to have to have public water out there and they are going to probably have to float a bond
issue. So why not do it now?
SUPERVISOR RUSSELL: That might very well be their thinking.
MR. GIBBONS: If the government can get clean water to Haiti, and I they deserve it, I think we
deserve it in Orient, too.
SUPERVISOR RUSSELL: Well, that might be the Water Authority's thinking. We are just
asking them to adhere to an agreement that has been in place for many years. But we are not
standing in the way of it, we are just simply asking for them to make the request, follow the
formal process. Both sides have adhered to their side of the agreement for 20 some plus years, I
would like to see that continue.
MR. GIBBONS: I understand exactly where you are coming from but you know, the Health
Department told me, they said pregnant women, small children, people with compromised
immune systems, people on chemotherapy; they should not be drinking the water. A lot of
people may not even be aware of that. And maybe there should be little signs on the table in
restaurants, you know, water might be harmful to you.
COUNCILMAN ORLANDO: How often do you sample the water at your house?
MR. GIBBONS: Excuse me?
COUNCILMAN ORLANDO: How often do you sample the water at your house?

MR. GIBBONS: They were coming on a monthly basis.
COUNCILMAN ORLANDO: Oh, they still have to come there? The county was?
MR. GIBBONS: Yes. And they hooked up all kinds of (inaudible) and everything else and I
have filters this big that turn black every month, a terrible situation.
COUNCILMAN ORLANDO: And how long have you lived at that site?
MR. GIBBONS: Excuse me?
COUNCILMAN ORLANDO: How long have you lived there?
MR. GIBBONS: 10 years.
COUNCILMAN ORLANDO: Now did you have your water tested prior to moving in?
MR. GIBBONS: I had to have it tested before I moved in.
COUNCILMAN ORLANDO: Right. How was it then? Just out of curiosity?
MR. GIBBONS: They didn't test for gasoline. I tested it two years later and that is when I
started seeing all these problems. Anyhow, I hope something can be done about it. I appreciate

MR. SCHWARTZ: I don't know if you are all for real but reality is not just about specific issues
and I appreciate the work you have done and the focus that you put on specific issues. I think we
need to look at a broader picture and a longer term picture. There is a question on the website
that is, do you have any issues about the citizens gateway. When you click on it, it just takes you
to the gateway, it doesn't really care if you have any issues. Well, there are issues. One of the
issues is anybody with a Macintosh computer, with an Apple Macintosh computer cannot view
videos on line. Did you know that?
SUPERVISOR RUSSELL: No.
MR. SCHWARTZ: Well, in Southampton, they have a notice on their website that if you are
having problmns and you have a Macintosh computer, you can go to the Microsoft website and
download the software necessary to view Southold Town website on an Apple computer. So I
suggest that we make that information available to people who may have issues on our website.
What else is new? Are any of you familiar with the north fork view? Do you know what I am
talking about?
COUNCILMAN ORLANDO: Yes.
COUNCILMAN TALBOT: Yes, with the website, the gentleman in the back there.
MR. SCHWARTZ: The north fork view. com .....
COUNCILMAN ORLANDO: Joey dot com ....
MR. SCHWARTZ: No, no, it is not him. It is Rob (inaudible) and company. And in addition to
that we have Riverhead local dot corn and let me assure you, you will not read about these
websites in the Suffolk Times. I think you know why. But seriously, they are an important
source of local information, Riverhead local dot com recently had an article about the water
supply in Riverhead. An associate there, Gary (inaudible) runs the water district and they are
following a policy of drill baby drill. No, dig baby dig. Well, you know, they are trying to
provide more watm' for Riverhead. But we are now in competition to them because we are
utilizing water from Riverhead in Southold Town despite the fact that every reputable planning
study ever done for Southold Town on the issue recommended very strongly against that. The
Suffblk County Water Authority has already implemented that program. Well, let me talk about
something I know about, imho. Does anybody know what that means? In my humble opinion. I

believe 2020 is a new age for Southold Town. In my dictionary, the antonym of corruption is
integrity and that is what I am here for tonight, to try and ask you to demonstrate and think in
terms of integrity and wholism and not just focus on individual but focus on the public interest.
And I use the example of the website. Some people have asked my recently why is Southold
Town all of a sudden starting to work on the website? You have been asking them for years and
they haven't done anything, now they are starting to do something. Not really. You are doing
what you have been doing all along, which is add more on top of a foundation, a faulty
foundation. What I have been asking you to do is to look at the foundation of the website and
rebuild it from the ground up. The more you build on top of a faulty foundation, the more
pressure you are putting on that foundation and the more problems you are going to have. Even
Tom Wickham, anybody else miss Tom? But one thing that Tom never did, he was never a big
advocate of websites but as was evidenced to his letter to the editor, the Suffolk Times two
weeks ago, he referred people who were interested in finding out more about the New Suffolk
waterfront fund to their website. Even Tom Wickham is now relying on websites. And I don't
care if you voted for Obama or McCain, the fact is that good portion of the votes for Obama
were probably due to use of the websites, the potential of the internet. And I don't think there is
a real estate agent in town that would say the website hasn't played a role in their business. I
think the web has even greater potential for government. And I would again ask you, as I have
been doing for almost 10 years now, to get real about building a strong website. Does anybody
have any questions? Oh, what else have we got? Well, nobody has mentioned tonight the
Southold Town master plan, comprehensive plan, Southold 2020.
SUPERVISOR RUSSELL: Actually I referred the public right in the very beginning. I don't
know if you were here yet. To the upcoming public meetings that we are having, I discussed all
that at the start of the meeting.
MR. SCHWARTZ: Well, thank you.
SUPERVISOR RUSSELL: You are welcome.
MR. SCHWARTZ: I appreciate that. Did you talk about last night's meeting?
SUPERVISOR RUSSELL: No.
MR. SCHWARTZ: Do you have anything that you would like to share about that? I just ....
SUPERVISOR RUSSELL: It is a work in progress. It is going to take a couple of years, I
would like to see better attendance in the future. I think as the ball gets rolling we will see
bigger assemblages of people participating in the process. What we had last night was a good
group of people but they are the familiar faces that are at all the various community minded
efforts. I would like to see them go out and bring other people in and have good, full rooms with
meaningful discussion.
MR. SCHWARTZ: Well, I get a lot of feedback from people that you know, master plans,
comprehensive plans, they are a lot of hot air to put it politely. It is not exactly what they say but

I can't exactly repeat what they say here. But you know, the material that was distributed at the
meetings this week is happening now. not next year, not 10 years from now, not in the afterlife.
You know, we are having meetings right now to define the vision which is according to planning
department that is writing the plan, the foundation of our plan which will control the content of
all the other chapters and there was a proposed vision statement, would paragraph vision
statement. Well, I don't want to waste your time but does anybody object if I read that vision
statement?
SUPERVISOR RUSSELL: Go ahead.
MR. SCHWARTZ: There are a lot of other things that I can talk about. I will, I am pulling that
up right now. as I pull it up, I would like to mention that there is a video available in the
Cutchogue library called Flow. For the love of water. I got a lot of laughs when I mentioned
that I love my well. But for the love of water is a documentary which is done in a very
entertaining way about the privatization of water on a global basis and it is not a question of
whether one individual has a right to pure, clean water or not, we would like everybody to have
pure, clean water but the question is, is it better to have a private entity or to have some kind of a
public plan and provision of that water. That is one of the issues that hopefully will be covered
in the comprehensive plan. The official draft vision statement for the Town of Southold
comprehensive plan, the new plan 2020 states that the Town of Southold is a community of
extraordinary beauty and resources with a deep and meaningful history. I am not going to, I
don't know what all this means, if it means anything but I mean, I agree with it but beauty is in
the eye of the beholder and what resources are we talking about? And the deep and meaningful
history? What, you know, it is a lot of words and I don't blame the people that are say/ng this is
all a bunch of hokey. Southold benefits from the unique combination of diverse hamlets,
working farmland, open space and productive waters. Our citizens value Southold's rural
qualities and small town feel. Future growth must be designed to balance all of the quality of
rural small town life with the growing local economy to ensure Southold remains a desirable
place to live, work and visit. Now that I have a problem with. I have a problem with balancing
the quality of rural small town life. They don't even mention environment but you know with
the growing local economy because the economy that I have known for the past generation, 45
years that I have been here, have not always been growing. A lot of the parts of the economy
have been dying or in decline and other parts have been growing. But I think we need to take
control of this at this point with a plan. And one thing I would like to see in the plan is that we
recognize that the past is the past and this idea that we can preserve the past, you know, let's get
real. We live in the present. The past is the past. What is real is the present and what will be
real is the future and if we don't prepare for it, then we are not planning for it and we are going
to accept what comes and the reality is that currently we are under a, we are partially rural, we
still have some rural character but we also have a good proportion of this town has become
suburban and the question is, how will this plan guide us in the future. There is no way that we
can ensure future growth must be designed, that is not the role of government to impose a design
but we can guide if we chose to do so and you six people have probably, the most say but
everybody in Southold Town has a say to that and I think that rather than just preserving the past,
if we look towards developing a sustainable economy and I believe that a sustainable economy is
based on a healthy environment and that it is not the environment versus the economy or the

environment and the economy in balance, the economy is built on the environment and depends
on the environment and the environment is the base of the economy and whether we use the
environment or whether we call it a natural resource or whether it is just nature that we respect
and make passive recreation out of it or whatever, I strongly urge you to support nature. I thank
