PROPERTY FACTS/DESCRIPTIOI~: The applicant's lot is a vacant parcel containing 14,000 square feet, with 100.18 feet along Pinewood Road and depth of 140 feet. A site visit found an approximate 10 foot drop in elevation from the north to the south. BASIS OF APPLICATION: Code Section 280-124, based on the Building Inspector's July 21, 2008 Notice of Disapproval concerning a proposed dwelling on a nonconforming 14,000 square foot parcel, with a lot coverage exceeding the code limitation of 20% for all building area LWRP: This application is exempt under Chapter 268 (95) of the Town Code. FINDINGS OF ["ACT The Zoning Board of Appeals held a public hearing on this application on September 25, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2 - October 16, 2008 ZBA # 6203 Paul Silansky, Applicant CTM 110-5~24 AREA VARIANCE RELIEF REQUESTED: The applicant wishes to build a single-family home containing 3,126 square feet. The lot coverage will exceed the 20% code limitation by 322 square feet, or 2.33%. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change to the neighborhood or a detriment to near by properties. The porches are necessary as enclosed entries during bad weather conditions. The owner stated that he did not realize there were two different calculations for lot coverage in the application, one by his surveyor dated January 30, 2008 showing 18.8% lot coverage, and later calculations on the map prepared by Carmelhill Architects with lot coverage at 22.3%. Although both maps appeared identical, the applicant found that the survey did not include the entries in the lot coverage calculations. The proposed setbacks are conforming to the zoning code, and the new house will be similar in style and size with others in the neighborhood. 2. Town Law §267-b(3)(b)(3)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance for the same reasons noted above. 3. Town Law §267-b(3)(b)(3)(3). The variance requested herein is not substantial at 2.3 % over the code limitation of 20%. 4. Town Law §267-b(3)do)(3)(5). The difficulty was not self created, except that the surveyor made an error and left off the porch and entryway in his original calculations. 5. Town Law ~267-b(3)(b)(3)(4). No evidence has been sub~nitted to suggest that a variance in this neighborhood ~vill have a negative impact. 6. Town Law ~2(;7-b.
