A Regular Meeting of the Southold Town Board was held Tuesday, January 5, 2010 at the
Meeting Hall, 53095 Main Road, Southold, NY. Supervisor Russell opened the meeting at 4:30
PM with the Pledge of Allegiance to the Flag.

COMMENTS - Current Meeting:
GAlL HORTON: Congratulations, new Board members. I am Gail Horton and I am married to
Dave Horton and his grandfather was Schuyler Bogart Horton, SB Horton. The Horton family
came to Greenport when Greenport was really growing in the early 19th century and they came
from Shelter Island and they were furniture makers and then they became funeral directors. And
Justus Horton was the first, then there was Justus Elbert and SB went into business with him and
he was a very community minded person. And he really typified (inaudible) the community.
That is why I speak just very briefly and I am not going to I promise. And he was married to
Eva Albertson Horton who was from Jamesport and 1 believe they met as debaters, they were
great elocutionists (inaudible) And they met and married and they were both very active in the
community. He was the president of the Greenport Village Board and did many, was one of the
first licensed funeral directors and was the funeral director for (inaudible) so he did a lot of
things and when Dave and I married almost 43 years ago, I went up in the attic of the house and
it was stacked with papers and I have been for the past 43 years off and on going through them.
So I went through a stack of sheet music that I was picking up to decide what to do and I came
across this sheath of tied papers, held together with a straight pin and in it was SB Horton Town
Justice (inaudible) and in it were all these papers, hand written papers and also the chits of what
they paid for livery to bring the justices from Greenport to Southold. 1 don't know where the
court was or anything but they were very interesting to me. There was the one, the case of the
body found on the sound shore and it was just amazing when you read how much people go
through today to solve these things, how you know, summarily it was decided case closed and
everything is okay. And I think he also served as coroner. And the other interesting thing was
that he did, was one of the cases here was from James Henry Young, who was my husband's
great grandfather from Orient and he had some suit with some guy in Greenport, he didn't pay
him for work, so Dave's other grandfather was the justice, but anyway, they are very interesting
and I didn't know what to do with these and then I met Betty at a, what was that meeting, Betty?
TOWN CLERK NEVILLE: That was the Archives celebration week at the Oheka castle.
MS. HORTON: Right. One of my passions has been the preservation of records and 1 spoke to
Betty about them and she said they are really town property, you know, so I said well alright, I
will give you a call. But I did want to, 1 said but the one thing is when I give them one thing 1
want to do is present them to the Board because of this new town passion we have about records
and people preserving records and not selling them. But you know, giving them to the Town
Clerk, the historian at the historical society, so that is why I wanted to come here and speak and
not because it is husbands family so much but they did typify who was here and they told the
history of the age through their eyes. So here you go.

SUPERVISOR RUSSELL: Thank you very much for that, we do appreciate that. And Betty has
been doing an excellent job along with Antonia Booth in making sure all the historic records are
preserved, pristine and readable to everyone through laserfiche. So, thank you. With regard to
the specific agenda, would anybody like to address any of the items? (No response)

Comments regarding resolution # 64
SUPERVISOR RUSSELL: Let me just clarify for the record, that is not a new position or the
filling ora vacancy, that is actually a transfer of an employee from one office to another. It is
Michelle Tomaszewski, who is leaving the Department of Public Works to go to work for the
Police Department with the vacancies we created there with the early retirement incentive.

Comments regarding resolution # 65
COUNCILMAN ORLANDO: Ironically, the first time for this is this Saturday, the 9th at the
transfer station up there. It is a great asset to the Town, to keep those household hazardous
wastes out of the water stream and into the classifications for disposal.

COUNCILMAN RULAND: Mr. Supervisor, would you be willing to address # 71, that you had
addressed the other where we made an appointment of someone?
SUPERVISOR RUSSELL: 71 would be?
COUNCILMAN ORLANDO: Michele Drake.
SUPERVISOR RUSSELL: Oh, Michele Drake. Actually that was, again, that was not a new
position although it is a new hire for appointment to the vacancy that was created by the
retirement of an employee, a long term employee for Southold Town. It is the Justice Court
clerk position, that is in the budget, again not a new position. It is just a continuation of a
position that had been part of the Town's work force for a long, long time.
JUSTICE EVANS: And actually the retiree was a senior.
SUPERVISOR RUSSELL: The retired...
JUSTICE EVANS: A senior justice court clerk.
SUPERVISOR RUSSELL: A senior justice court clerk with over 50 years in public service.

HUGH SWITZER: Hugh Switzer in Peconic. Representing the Group to Save Goldsmiths Inlet.
I just wanted to thank you all for the approval as you can see of the annual dredging down at the
Goldsmiths Inlet. That dredging has started today and it is in process and I just wanted to thank
you all for continuing to focus on that, the problem we have down there.
SUPERVISOR RUSSEI,L: Hugh, we haven't released a press release yet but 1 don't know if
you have been made aware that actually the grant that we had applied for for the restoration of
Goldsmiths Inlet as a watershed, has, we have been awarded that grant through the work of Mark
Terry and you folks. And we are pleased with that and look forward to keeping track of every
hour that you volunteer over the next year so that we can match that grant. And continue to work
together at improving the water quality here.
MR. SWlTZER: Thank you all for that, too.
COUNCILMAN KRUPSKI: Sure.

BENJA SCHWARTZ: Good evening. How are you all doing?
COUNCILMAN KRUPSKI: Happy New Year.
COUNCILMAN ORLANDO: Happy New Year.
MR. SCHWARTZ: Who are you? Where is Tom? Welcome Mr. Talbot. ls it too late to wish
you happy holidays?
COUNCILMAN TALBOT: It's never too late.
MR. SCHWARTZ: Well, in the spirit of the holidays, I was feeling real good last week and I
made a resolution to only speak positively here. I broke, I gave that up already, don't worry.
COUNCILMAN ORLANDO: No time restraints? You didn't get into that part?
MR. SCHWARTZ: Well, it would have been contrary to my own contrarian nature and would
have been unproductive I think. I think we have to, you know, it is nice that we are enjoying
ourselves but we have to be serious also. Sometimes. So it is a new year. What is new in town
hall? Is anything different this year?
SUPERVISOR RUSSELL: No. The fact that the calendar has lapsed into 2010 wouldn't
indicate any, you know, pell mell rush to change anything.
MR. SCHWARTZ: Some people call it two thousand ten, some people call it twenty ten. Have
you made an official determination what you are going to call it?

SUPERVISOR RUSSELL: I will leave that to the better minds than mine.
MR. SCHWARTZ: Well, what about the software that you were in the process of buying?
SUPERVISOR RUSSELL: Municity? That is actually underway now. Betty and Lloyd
Reisenberg have led an effort to get all the departments to fill out worksheets, everything that
would be needed for input for that program. But that's actually, was going to be, will be
purchased with money secured by Betty who had applied for a grant and secured all the funding
for Southold Town.
MR. SCHWARTZ: I looked at the program and it looks very good. Can somebody tell us a
little bit about how Southold Town plans to, what we are going to do with it?
SUPERVISOR RUSSELL: Yes. Well, the first thing we are going to do is integrate all the files,
records and all the information on a tax parcel basis, so that each property in Southold Town will
be able to go to a parcel and then be able to layer all that information from the various
departments, the Planning Board, the Zoning Board of Appeals, Assessors information and
access all that information from, on the ....
MR. SCHWARTZ: I thought that was the way we have been doing it.
SUPERVISOR RUSSELL: Not necessarily. Not necessarily. Everybody's information now,
although you can go to laserfiche and secure a lot of that information, not everything is as
readily available as we would like it to be. In other words, if there is an outstanding code
violation on a particular parcel, all that information will be available. Code violations,
information such as ZBA decisions that were granted to relief to a party but with certain you
know, within parameters and guidelines, everything that the various offices would need will be
available from one location.
MR. SCHWARTZ: Seriously sounds like a significant improvement.
SUPERVISOR RUSSELL: It is.
TOWN CLERK NEVILLE: Yes.
COUNCILMAN TALBOT: That should tie every department together. It will, so you can go to
one department and should get the same answer from everybody. You know, the building
department could tell you exactly where a planning board application is just by looking on the
municity site. I think it is going to be a boon for Southold Town and it will help to get us on the
right direction and a better website as well.
SUPERVISOR RUSSELL: And you know, it sounds almost cliched but getting the left hand to
know what the right hand is doing.
TOWN CLERK NEVILLE: That is the key to it, the one central database for all the

departments, the building, planning, zoning, trustees, land preservation. They all will be
inputting the information into the one central database and this is, this is their applications for
permits. Laserfiche has all of the permanent records that have already been permitted or adopted
but this is going to manage their daily business and prevent them from issuing permits when they
shouldn't because another department hasn't given their approval. It is only through this one
database, get all the information. So it should be a wonderful program. It is progressing well.
MR. SCHWARTZ: It ties in with the laserfiche.
TOWN CLERK NEVILLE: And yes, everything will be linked to laserfiche very easily, so that
they can immediately just click a link and go right to laser and see what the past history is.
MR. SCHWARTZ: Well, we have a new animal shelter this year.
SUPERVISOR RUSSELL: Yes.
MR. SCHWARTZ: Recently opened. And have you all been to visit?
COUNCILMAN ORLANDO: Many, many, many times.
MR. SCHWARTZ: Really? I didn't see you there.
COUNCILMAN ORLANDO: I didn't see you there, either.
MR. SCHWARTZ: Well, we will have to go together. It, seriously, I am very proud of the
Town for creating that building and I think it is a real credit to the previous Board, getting it
finally completed. I was asked to speak about the need to take actions to address the over
population of deer. 1 know you have had a lot of meetings on that but are we doing anything?
SUPERVISOR RUSSELL: We are doing the best we can, given the current landscape and the
regulatory process. Wildlife management is regulated by the State Department of Environmental
Conservation, it is a heavily regulated industry. We are doing the best we can. We are, in fact,
in the next week or two we are I think we are having the wildlife manager from the DEC come
down and meet with the deer management committee. It is something that is not going to be
done or be effective overnight. It is going to take time and we need to change a lot of behavior,
we need to change a lot of action, we need to change a lot of things over the next couple of years
to see any type of sharp decline in the number of deer that are out here.
COUNCIl,MAN KRUPSKI: We are looking at a regional approach, too. We are going to try to
come up with a strategy for Southold and then involve the other east end towns. To put that kind
of political pressure on Albany to change some of the regulations that make it right now, have
made the deer population what it is today.
COUNCILMAN TALBOT: There is also a deer committee meeting on Thursday, correct?

SUPERVISOR RUSSELL: Right.
MR. SCHWARTZ: I am familiar with the hunting programs that are being implemented or
facilitated or permitted on town ....
SUPERVISOR RUSSELL: That is a very, very small contribution.
MR. SCHWARTZ: What other behaviors are you....are you talking about the public ....
SUPERVISOR RUSSELL: Oh, absolutely. Public behavior is very important. There is a
tendency to feed deer, there is a tendency to put food out. 1 have people bringing pictures into
my office of neighbors who put out these troughs of food and you will see 10, 12, 15 head
around you know, the trough eating. Those types of behavior, the idea that maybe we have to be
a little bit shrewder in what we plant. You know, deer eat just about anything. But the plantings,
the landscaping, it is not helping the situation particularly in these suburban areas where hunting
isn't effective or shouldn't even be considered because of the populations there. Access to food,
we need to support farmers who need to fence because it is the only alternative now. We need to
be, we need to embrace those farmers and be more supportive of their efforts to keep deer from
gaining access to the food. It is all of those things.
COUNCILMAN RULAND: I think it is safe to say that we have heard lots of things that we are
trying to do and the environmental conservation law is set by the legislature, our representatives
are very much in favor and helpful to what we are doing but unfortunately Mr. Silver and his
contingent from New York City have no part in wanting to change the environmental
conservation law. And until New York City decides that it is going to be right for us here,
nothing, nothing is going to happen. That is my opinion.
MR. SCHWARTZ: Change the law in what way?
COUNCILMAN RULAND: The law of when you can harvest, how much you can harvest is all
determined, it is set by the legislature and then the Department of Environmental Conservation
promulgates regulations, just like your...
MR. SCHWARTZ: Inaudible.
COUNCILMAN KRUPSKI: Well, methods. You could use the crossbows, baiting, trapping.
There are a lot of different methods you could use to reduce the population.
COUNCILMAN RULAND: And they are not interested. It is not popular with their
constituents in New York City.
SUPERVISOR RUSSELL: And ironically many people say to me, why don't use sterilization
methods, you know, to reduce the numbers or you know, birth control salt licks, things like that?
Ironically, these are the same, these other agencies say you can't do that either. Department of
Health at the state and county level won't allow people to do that because of the, there is still a

large reliance on venison as a food source and the risk of putting chemicals into that food supply
don't outweigh the benefits...
MR. SCHWARTZ: So everybody needs to get a gun, is basically what you are saying.
COUNCILMAN KRUPSKl: Or a Buick.
SUPERVISOR RUSSELL: Regrettably.
COUNCILMAN RULAND: To be honest with you, it is easiest with a car. Unfortunately, the
deer doesn't have insurance but it is easier with a car.
COUNCILMAN ORLANDO: Benja, were you at the last deer management meeting.'?
MR. SCHWARTZ: On a personal note, l was at one of them, on a personal note ....
COUNCILMAN ORLANDO: Well then you notice what the gentleman said was, in the last 20
years, deer practices haven't changed for hunting but what happens is the deer now are having
not just one but two and three babies every year, so we haven't changed our hunting habits but
the deer eating habits are getting so much better, they are eating all my vegetables and flowers
and they are eating Albert's pumpkins. They are having twins and triplets now.
SUPERVISOR RUSSELL: It is also, the change in food supply out here, even since I was in
high school, we used to have traditionally muck crops, cabbage, cauliflower or potatoes,
everything got turned in at the end of the season. Now you have a much wider variety of
agriculture products, you have year round nursery container stock, shrubbery, all of those things
that lend themselves to a more regular food supply to a population of deer that is just getting out
of hand.
MR. SCHWARTZ: Including residential gardens.
COUNCILMAN ORLANDO: Sure.
SUPERVISOR RUSSELL: Certainly.
MR. SCHWARTZ: Which is often very much to the liking...
COUNCILMAN ORLANDO: So they are eating better and having more babies.
MR. SCHWARTZ: I happen to live in a home that was built as a hunting cabin and I don't
know how many people are aware that Southold Town was a winter hunting season resort before
it was ever a summer resort. People didn't bother to come all the way out here, there were plenty
of nice beaches near the city. But I don't think hunting is ever going to come back in a big way
and I think that what, I agree with what Scott has been saying. The problem is basically caused
by increasing the food supply. And I don't you know, I don't want to use my car in that way,

anyway.
COUNCILMAN ORLANDO: But we...
COUNCILMAN RULAND: I wouldn't want to use mine either but I think it is also worth
saying that something has to give. Something has to change. We just can't keep going the way
we are going. One of the things that is most interesting is, if you could get the DEC to give you
a report broke down by their regions of the number of people, general citizens, who are cited for
feeding deer, in our region compared to the north country where if you feed a deer in the north
country, you are going to get a summons. There is absolutely no question about, alright? And
here, 1 am sure they passed out one or two but you don't see many of them in the justice court
report, so I don't think that people really understand, okay, that it is illegal to feed them. Plain
and simple. Yet as more than one person said you know, people make it a practice. They set out
the feed trough for them and they are living high.
COUNCILMAN ORLANDO: And some people really probably don't know that because you
can buy it at the local garden shop, deer feed. They probably think it is fine.
COUNCILMAN RULAND: You are probably right.
MR. SCHWARTZ: Maybe I will come to the committee meeting and see if we can get some
public information going about people who are intentionally and unintentionally feeding the
deer.
COUNCILMAN ORLANDO: But last year we did plant that mountain lion in there but it didn't
work.
MR. SCHWARTZ: I was almost hit by a deer in my car. At the time I was driving a 1950
Pontiac on Flanders Road and the deer came flying across the road and hit the side of my car
right on the drivers side door. There was nothing I could do. of course, that car didn't get hurt.
It was a tank. Do you all have enough air in your tires? The least we can do is keep the tires full
of air. I've noticed on town vehicles that seem to be a little low on air. Thought maybe we
could check on that. But in snowy weather, the best chance you have is if you have high
pressure in your tires. Just like to quickly mention the situation with the gardening and the food
channels on Cablevision. Has there been any mention of that today? Is the town ....
SUPERVISOR RUSSELL: I have gotten calls to my office, people are upset because they have
lost yet two more channels from Cablevision. My understanding is there is a feud brewing
between Time Warner and Cablevision. I can't begin to unravel the business interests there so
there is nothing I can respond to as of yet.
MR. SCHWARTZ: Well, to make a long story short, Cablevision is busy splitting into two
companies. One for the Rockettes and the Knicks and Madison Square Garden and no, not
Rockefeller Center, Radio City; they are going to split that to a separate company and then the
other company is going to be this mammoth cable company that thinks they can just tell

everybody what they are going to pay but you know, we are paying them for these channels.
Now they are not paying for the channels, they are not getting the channels, we are not getting
the channels, we are still paying for them. I don't think that that is right. And I have looked at all
the news soumes that I can find. I don't recommend the stories that have been published in
Newsday which is owned by Cablevision as is News 12 but the other companies that put out
news and you know have been pretty clear and there is plenty of information if you want to go to
companies that are producing the programming. Some of the best programming on tv and it is a
shame that Cablevision has basically said you know, we will keep paying the pennies that we
have been paying you when more people are watching that than ever before and they are not
getting their share of our money. We are paying Cablevision, Cablevision is not giving us a
break, they are not paying for the channels anymore, we are not getting to see the channels, why
don't we get a reduction on our cable bill? That would be nice. Alright, well ....
COUNCILMAN RULAND: That would be a legitimate question as well. Why don't you call
up the Dolan boys and ask them? I am sure they will take your call.
MR. SCHWARTZ: Thank you. 1 thought about that but then I thought I would come here and
talk to you because as individuals, there have been thousands of individuals that have contacted
Cabtevision and those channels and Cablevision says, you know, oh, they are just a couple of
people. But I don't know how many Town Boards or how many towns have taken an interest
and made a statement. That might help to pressure the company to do the right thing. We can't
force them to do the right thing to be, the illusion that there is choice in cable companies is just
that, an illusion. As you all know, they built their business as a government monopoly and
Verizon, who by the way is not being allowed to advertise in Newsday anymore, Cablevision
nixed that, to my knowledge there are no plans, Verizon has no plans to come out here and don't
get me started on the satellite. Thank you very much.
SUPERVISOR RUSSELL: Anybody that might still be left interested in addressing the Town
Board?

COUNCILMAN KRUPSKI: I would just like to say that recently Bill Albertson passed away
and I served with him for years on the Board of Trustees and he was a great man and he will be
missed in the community, he was very active in the community but I just wanted to remember
him tonight.
