WITNESSETH, that the party of the first part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Peconic, in the Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at the intersection of the northeast side of Carroll Avenue and the southwest side
of Middle Road running the following courses and distances:
North 45 degrees 55 minutes 00 seconds East along the south side of Middle Road 50.13 feet to
a point;
North 50 degrees 08 minutes 55 seconds East along the south side of Middle Road 215.82 feet
to a point thereon;
South 38 degrees 34 minutes 10 seconds East along land now or formerly of Konarski 124.67
feet to a point;
South 49 degrees 53 minutes 00 seconds West along land now or formerly of Cormzzo 280.46
feet to a point;
THENCE the following two courses along the east side of Carroll Avenue:
North 40 degrees 07 minutes 00 seconds West 103.94 feet to a point thereon;
North 04 degrees 32 minutes 00 seconds East 25.61 feet to the point or place of beginning.
BEING AND INTENDED TO BE same premises conveyed to the party of the first part by deed
dated October 9, 2004 and recorded October 27, 2004 in Liber 12351, Pages 398 in the office
of the Clerk of the County of Suffolk.
TOGETHER with all right, title and interest, if any, of the party of the first part in and
to any streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the
first part in and to said premises, TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND.the part3/of the first part, in compliance with § 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be applied first for the purpose
of paying the cost of the improvement and will apply the same first to the payment of the
cost o~' the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this ·
indenture so requires.
