THIS INDENTURE, made the 14t~ day of December, 2009 BETWEEN
HELEN E. BOOTH, residing at 405 Fasbender Avenue, Peconic, NY 11958
party of the first part,
HELEN E. BOOTH, as Trustee of the Helen E. Booth Trust dated December 14th, 2009, residing at
405 Fasbender Avenue, Peconie, NY 11958
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Peconic, Town of Southold, County of Suffolk and State of New York, being known and
designated as Lot # 94 on a certain map entitled, "Map No. 2 of Peconic Shores, Peconic, L.I., N.Y.,
property of B.B. Bailey and C.H. Bailey, surveyed by Daniel R. Young, P.E. and L.S. May 21st, 1929"
which Map is duly filed in Suffolk County Clerk's office.
TOGETHER with all right, title and interest of the part of the first part in and to the highways adjoining
said premises.
It is understood that not more than one house is to be erected on said lot and shall not cost less than $1500,
and that the same is to be used for dwelling purposes only and not to he occupied by more than one family.
Said house is to be set back at least fifteen feet from the street line, and a garage may be erected thereon on
the rear of said premises not less than sixty feet from the street line and to be used for the string of not more
than two automobiles used for pleasure only. The property hereby conveyed shall not be used in any
manner which might create a public nuisance.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
February 18th, 2000, and recorded in the Office of the Clerk of the County of Suffolk on March 21, 2000, in
liber 12028 page 916.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.

above written.
