THIS INDENTURE, made the 7th day of December, Two Thousand Nine
BETWEEN
JOSEPH A. NELSON and TERRENCE J. JOYCE, as joint tenants with rights of survivorship,
residing at 3045 Rocky Point Road, East Marion, New York 11939
party of the first part, and
PAULINE S. LOFRESE, residing at 6 Spring Hollow Road, Nissequogue, New York 11780
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release tmto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at East Marion, in the Town of Southold, County of Suffolk and
State of New York, known and designated as and by Lot No. 9 as shown on a certain map
entitled, "Map of East Marion Woods," and filed in th~ Office of the Clerk of the County of
Suffolk on June 7, 1989 as Map No. 8759, said lot being bounded and described as follows:
BEGINNING at a point on the westerly side of Rocky Point Road distant northerly 3134.41 feet
from the comer formed by the intersection of the northerly side of Main Road (S.R. 25) and the
westerly side of Rocky Point Road;
RUNNING THENCE South 76 degrees 54 minutes 10 seconds West, 337.66 feet;
THENCE North 13 degrees 05 minutes 50 seconds West, 139.64 feet;
THENCE North 76 degrees 54 minutes 10 seconds East, 347.67 feet to the westerly side of
Rocky Point Road;
THENCE South 8 degrees 59 minutes 50 seconds East along said westerly side of Rocky Point
Road, 140.00 feet to the point or place of BEGiNNiNG.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated January 18, 2002, and recorded February 5, 2002, in the Office of the Suffolk County
Clerk in Liber 12167, Page 521.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

first above written.
