~ BEGINNING at a point on the northerly line of 16-1/2 foot
right of way distant 164.06 feet easterly from the point where the
southwest corner of land of Long Island Lighting Company intersects
the easterly end of the Main (State) Road, Route 25, as measured
along the northerly line of said right of way; running thence North
27° 45' 50" West 165.0 feet; thence North 62° 14' 10" East 132.89
feet; thence South 27' 45' 50" East 168.58 feet more or less to the
northerly line of the aforementioned right of way; thence South 63°
46' 40" West 132.92 feet more or less (132.94 survey) to the point
or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the
party of the first part by deed dated February 17, 1978 and
recorded in the Suffolk County Clerk's Office on February 22, 1978
in Liber 8392 Page 57.
RESERVING, however, to the party of the first part the
exclusive possession and the use and occupancy of the above-
described premises for and during the natural lifetime of the party
of the first part, with the party of the first part to pay for
the electric, fuel oil, bottled gas, telephone and cable and
expenses related to ordinary maintenance of the premises as well
as insurance for personal property. However, in the event the
party of the first part does not reside on the premises for
180 consecutive days, the party of the first part's life estate
shall terminate.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
