does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever, the party of the first paws (Philip J. Kabot's) undivided ONE-NINETH (1/9)
interest in
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Arshamomaque, Town of Southold, County of Suffolk, State of New York, bounded and

BEGINNING at a certain point on the main North Road leading from Southold to Odent at a certain stake
ddven in the ground which said point of beginning is the southwest corner of lands belonging to the Union
Christian Society of Arshamomaque; and running thence northerly by land last mentioned 45 feet running
thence easterly by land last mentioned 35 feet and thence continuing same course by land formerly of Samuel
B. Conklin 62 feet to land formerly of Richard B Conklin at the old division line separating the lands hereby
conveyed from lands formerly of said Richard B. Conklin; thence northerly 680 feet to ordinary highwater mark
of Long Island Sound which point is 28-7/10 feet easterly of the east side of a large boulder lying on the beach
at about ordinary highwater mark of Long Island Sound and running westerly along said ordinary highwater
mark 457 feet to a point at ordinary highwater mark and which ~aid point is distant 14 feet southerly from a
hole drilled in a large boulder in Long Island Sound; running thence southerly by land of Cormick Feeney 65
feet to a stake in the top of the bluff and running thence southerly still along land last mentioned 412 feet to
stake driven in the ground on the north side of the highway; and thence eastedy by said highway 158.5 feet to
the point or Place of BEGINNING.
SUBJECT to land and easement taking areas taken by Suffolk County on June 22, 2000 described
In Map #1 of"Maps showing Properties to be acquired for the reconstruction of C.R.48 Middle Road in the
Vicinity of Chapel Lane, Town of Southold, Suffolk County", Capital Project No. 5518 as follows: "Taking
Area: Parcel "A" = 112+SF or .003 AC."; and "Easement Area: Parcel "B" = 785+SF or .018 AC.".
BEING AND INTENDED TO BE the same premises conveyed to Philip J. Kabot by Liber No. 9762 of
Deeds Page 488 in the Suffolk County Clerk's Office recorded on the 1st day of April, 1985.
.TOGETHER with all dght, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises.herein granted Unto.the party of the second paR, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the. party of the first part, in compliance with Section 13 of the Lien Law, covenants that th~ party of the
first part will receive the consideration for this conveyance and will hold the. dghtto re~iv~ sqch consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
