THIS INDENTURE, made the d-["' day of November, two thousand nine
BETWEEN MILES B. ANDERSON, as Trustee of the Kenneth W. Anderson Testamentary Trust residing at
16 Round Pond Lane, Sag Harbor, New York 11963, party of the first part, and
JEFFREY D. ANDERSON and JENNIFER V. ANDERSON, husband and wife, both residing at 840 Rosewood
Drive, Mattituck New York 11952, party of thc second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other good and valuable consid-
eration paid by thc party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, together with the buildings and improvements thereon erected, situate,
lying and being at Mattituck, in the Town of Southold, County of Suffolk, and State of New York, known and
designated as and by Lot No. 14 on a certain map entitled, "Map of Rosewood Estates". which map was
filed in the Office of the Clerk of the County of Suffolk on January 24, 1969 as Map No. 5240, being more
particularly bounded and described as follows:
BEGINNING at point on the easterly side of Rosewood Drive, said point being 402.00 feet from the north-
erly end of an arc of a curve having a radius of 39.80 feet and a distance of 44.32 feet, which said curve is
located 315.19 feet westerly from the intersection formed by the northerly side of Rosewood Drive and the
westerly side of Cox Neck Lane;
RUNNING THENCE along the easterly side of Rosewood Drive, North 22 degrees 26 minutes 50 seconds
West, 117.00 feet to Lot 16 as shown on the aforementioned map;
THENCE along last mentioned lot, North 67 degrees 33 minutes 10 seconds East, 170.97 feet to land now
or formerly of Piraino;
THENCE along last mentioned land, the following two (2) courses and distances:
1. South 23 degrees 23 minutes 30 seconds East, 96.74 to a concrete monument;
2. South 23 degrees 16 minutes 30 seconds East, 20.27 feet to Lot 12 on the aforementioned map;
THENCE along last mentioned lot, South 67 degrees 33 minutes 10 seconds West, 172.85 feet to the
easterly side of Rosewood Drive, at the point or place of BEGINNING.
THE GRANTOR herein is the same person as the Grantee in deed from Jo Anne Ponzio, dated
November 29, 2007, recorded in the Suffolk County Clerk's office in Liber 12532 of Deeds, at
Page 896 on December 7, 2007.
THE PREMISES HEREIN are identified on the Suffolk County Real Property Tax Map as
DISTRICT 1000, SECTION 113.00, BLOCK 02.00, LOT 020.000. This reference is for identifica-
tion only and is not intended to alter or modify the description set forth above.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abut-
ting thc above described premises to the center lines thercoi; ~.
TOGETHER with the appurtenances and all the estate and rights of thc party of thc first part in and to the said prom-
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs, successors and
assigns of thc party of thc second part forever.
AND the party of thc first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such considcration as a trust
fund to be applied first for thc purpose of paying thc cost of the improvement and will apply the same first to the pay-
ment of the cost of the improvement before using any part of thc total of the same for any other purpose.
AND thc party of the first part covenants as follows:
