WITNESSETH, that the party of the first part, in consideration ofTEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town o£
Southold, County of Suffolk, State of New York, bounded and described as follows;
BEGINNING at a point on the northerly side of Soundview Avenue a distance easterly of
300.00 feet measured along the northerly side of Soundview Avenue from the southeasterly
corner of the lands of H. J. Osborne on a line running North 73 degrees 27 minutes 30 seconds
East;
THENCE along land now or formerly of Fischer in a northerly direction North I0 degrees 56
minutes 40 seconds West a distance of 588.59 feet to the Long Island Sound;
THENCE running in a general easterly direction along the Long Island Sound along a tie
course of North 89 degrees 54 minutes 30 seconds East, a distance of 100.00 feet to land now or
formerly of Feldis and Grant;
THENCE running in a general southerly direction along the last mentioned land South I 1
degrees 04 minutes 40 seconds East a distance of 560.00 feet to the northerly side of Soundview
Avenue;
THENCE running in a general westerly direction along the northerly side of said Soundview
Avenue 73 degrees 27 minutes 30 seconds West a distance of 100.00 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated 10/9/98 and recorded on 3/23/99 in Liber 11952, Page 917 and by deed dated
10/9/98 and recorded on 3/23/99 in Liber 11952, Page 919.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HA VEAND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "panics" whenever the sense of this indenture so
requires.
