ALL that certain lot, piece or parcel of land beginning at
a concrete monument set on the boundary line between land of the party
of the first part and land of "Goose Bay Estates", as shown on a map
entitled "Map of Goose Bay Estates at SOllthold, Long Island, '" filed in
the Suffolk County Clerk's Office Nov. 13, L934 as Map No. 1176: being
the northwesterly corner of land conveyed by the party of the first
party to Rix McDavid by deed dated June, 1949; from said point of
beginning running along boundary line North 17 degrees 34 minutes 30
seconds East 330 feet, more or less, to a dredged canal leadinq to
Goose Creek; thence in a general easterly direction along said dredged
canal about 250 feet; thence in a general southerly direction along the
westerly edge of another dredged canal leading to Goose Creek, about
250 feet, to land now or formerly of Howard A. Toedter; thence along
said land of Toedter,. (now or formerly) Sout.h 17 degrees 40 minutes 30
seconds West 190 feet, more or less; thence along the northerly line of
a cert.ain 30 foot. right. of way (#3 as hereinaft.er described) and along
said land now or formerly of McDavid, North 72 dgrees 25 minut.es 30
seconds West. 320.39 feet to the point of beginning.

1) Toget.her with a right of way 30 feet. in width from a point on t.he
southerly boundary of the property hereinabove described at the
northeast.erly corner of said land now or formerly of McDavid, sout.herly
about 760 feet, thence easterly at. right angles t.o said 30 foot right
of way (#2) as described below).
2) Also with a right. of way 30 feet. in width over said land now or
formerly of Toedter and adjoining the westerly boundary thereof, from
North Bayview Road ncrt.herly about 1620 feet to said dredged canal
leading t.o Goose Creek.
3) Also with a right of way 30 feet in widt.h, the northerly line of
which is said southerly boundary of t.he property hereinabove
described, from said point. on said southerly boundary at said
northeasterly corner of McDavid; (now or formerly) easterly about 170
feet to said land now or formerly of Toedter and to said 30 foot right
of way (#1) as described above).

PlanninJ board of' the Town of Southold, deems it advisable to
impo,;," c.'t'tain covenants and restrictions upon the said real
prOIJCrty.
NOW, THEREFORE, in consideration of the peemises, the
Declarant declares that the above described real property is held
subject to the following covenants and restrictions:
(1) No lot shall be subdivided or changed in any
manner unless authorized by the Planning Board of the Town of
Southold.
(2) ~ll stormwater runoff created by the development
and improvement of this tract shall be retained within the site by
adequate drainage structures and shall not be discharged directly
into the waterways of Goose Creek.
(3) No new sanitary disposal facilities shall be
located within one hundred (100) feet of the waterways of Goose
Creek.
(4) No residential structure shall be located '.vitllin
100 feet of the dredged canal bordering the northerly side of the
parcel.
(5) These covenants and restrictions shall run with
the land, subject to the right of the Planning Board of the Town
of Southold to amend, annul or repeal any or all of the foregoing
covenants and restrictions at any time.
