SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 10, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter- community impact. LWRP: TOWN CODE CHAPTER 268: This application is exempt from LWRP review pursuant to Code Section 268-3. PROPERTY FACTS/DESCRIPTION: The total area of the property is conforming with 52,360 square feet in this R40 Residential Zone District, as shown on the site plan prepared by Austin, Patterson, Disston, Architects last dated 5/22/08 (revision note # 4). The site measures 50.58 feet along Town Harbor Terrace to the north, 342 feet along the western boundary to a tie line at Little Peconic Bay, 361 feet along the eastern boundary, and 149.92 feet along Little Peconic Bay. The property is improved with a two-story, single- family dwelling, as shown on the survey prepared October 20, 2003, revised March 9, 2005 by Daniel P. Jedlicka, Professional Land Surveyor. BASIS OF APPLICATION: Request for Variances under Section 280-15, based on the Building Inspector's June 13, 2008 Notice of Disapproval concerning a proposed accessory swimming pool structure in a side yard Page 2 - September 4, ZBA # 6193 - Joarm Walker CTM 66-1-33 rather than the code-required rear yard. RELIEF REQUESTED: The applicant seeks a variance to show construction of a 1,113 square foot swimming pool in the westerly side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public headng on this application on August 21, 2008, and September 25, 2008 (after a Resolution was adopted on September 4, 2008 to reopen the hearing) at which trrne written and oral evidence wore presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following fac~s to be true and relevant: REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of a variance authorizing the proposed yard location of a swimming pool will not have an adverse effect on the character of the neighborhood or be a detriment to nearby properties. The pool will be set back more than 25 feet from the westerly side boundary and more 200 feet from the road. It will in the same location as approved for an attached pool under ZBA variance # 5623, however it is to be built without the declHng that was formerly approved in that application, which would have increased lot coverage. 2. Town Law §267-b(3)(b)(2). The benefit of an accessory swimming pool on the property cannot be achieved by means not requiring a variance. Constructing a pool to the rear of the house would have placed it closer than 75 feet from the bulkhead. ~. Town Law §267-b(3)(b)(3). The proposed variance is not substantial. The pool be located more than 200 feet from the front yard boundary and 20 feet from the side boundary. 4. Town Law §267-b(3)(b)(5). The need for a side yard variance pool was not serf created. It is a result of the fact that the house is 75 feet from the bulkhead and approximately 57 feet from the top of the bluff. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that grant of this relief will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Town Law §267-b. Grant of the relief requested is the minimttm action necessary and adequate to enable the apphcant to enjoy the benefit of a Page 3 - September 4, ZBA # 6193 - Joann Walker CTM 66-1-33 swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on site plan last dated 5/22/08 (revision note # 4), prepared by Austin, Patterson, Disston, Architects. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. F. CHASES, CUTTING AND PATCHING 1. Coordinate all chased, furring, cutting and patching with Architect in advance of work. G. AS-BUILT DRAWINGS 1. Provide as-built drawings showing all work performed and any changes from Contract Documents. As-built drawings will be condition of substantial completion. OPERATING INSTRUCTIONS Upon completion of all work and all tests, Contractor shall furnish the necessary skilled labor and helpers for operating the system and equipment. During this period, instruct the Owner or his representative fully in the operation, adjustment and maintenance of all equipment furnished. Instruction period shall equal one (1) eight (8) hour day. Operating instructions may not begin until the equipment has been made fully operational as determined by tile Architect. I. MOTORS AND CONTROLLERS 1. GENERAL The Drawings, the Conditions of Agreement, the Bidding Requirements and the General Requirements are hereby made part of this Section. B. GEOTHERMAL WELL PIPING Piping for the geothermal wells shall be all closed loop. Fiping for the geothermal wells shall be plastic and designed for this applicat, ion. All piping shall be one inch. Well piping shal~ be continuous to each interior mounted wall mount insulated pump "Flow Center". Piping from circulator flow center shall continue to each water source heat pump. Each water source heatpump shall have its' own well and piping system. C. HOT WATER SYSTEM PIPING INSTALLATION Fitch all piping up in direction of flow a minzmum on one (1) inch in forty (40) feet. Vent all high points and all drop points. Provide valves for drainage at all low points. Reduction in pipe size shall be made with eccentric reducers with top side flat. No bushings permitted. 2. Each piping take--off from tops of mains or branches shall be from a tee set at 45 degrees. 3. Use no piping sma~ller than 3/4" unless noted otherwise. 4.
