JOSEPH and JOANNA CHERNUSHKA # 6302. Location of Property: 640 Rabbit Lane, East
Madon; CTM 31-18-20.1 (adjacent to Gardiners Bay). Requests for Variances under Sections
280-116B and 280-124, based on an application for a building permit for additions and
alterations to the existing dwelling, and the Building Inspector's March 13, 2009 Notice of
Disapproval.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
A portion of the existinq residential structure is located seaward of the Coastal Erosion Hazard
Line.

Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and structures away
from flooding and erosion hazards.
Avoid development other than water-dependent uses in coastal hazard
areas. Locate new development which is not water-dependent as far away
from coastal hazard areas as practica/.
Avoid hazards by siting structures to maximize the distance from
Coastal Erosion Hazard Areas.
Move existing development and structures as far away from flooding and
erosion hazards as practical. Maintaining existing development and structures
in hazard areas may be wsrranted for:
c. sites where relocation of an existing structure is not practical.
The rear yard setback on the parcel is 35 feet from Rabbit Lane. From the rear yard setback t~
the existin.q structure is a total distance of 22 feet. It is recommended that the Board assess th~
feasibility of relocatinq the structure closer to Rabbit Lane within the building envelope and
requiring a landscaped buffer landward of the existing bulkhead. A recommended definition fo~
a landscaped buffer is:
LANDSCAPED BUFFER -- a land area of a certain len.qth and width which is planted with indigenous,
drouqht tolerant, veqetation similar to that found within the immediate proximity of the parcel. Veqetatio,,
shall be installed in sufficient densities to achieve ninety-five (95) percent qround cover within two yea,~,
of installation. Survival of planted veqetation shall be (ninety) 90 percent for a period of three yea, ~.
Maintenance activities within the buffer are limited to removinq veqetation which are hazardous to life and

to the water-body.

contravention of water quality standards.
C. Ensure effective treatment of sanitary sewage and industrial discharges by:

groundwater and by providing adequate treatment of septic effluent.
It is recommended that the Board require that the applicant upqrade the on-site-septic system t~

Po/icy 6. Protect and restore the f/uality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wet/ands.
The distance from the bulkhead to the structure is 19 feet; a m~nimum separation
distance of 75 feet is required pursuant to Article XXII Section § 280-116. which
states:
B. All buildings or structures located on lots upon which a bulkhead, concrete
wall, t~prap or similar structure exists and which are adjacent to tidal water
bodies other than sounds shall be set back not less than 75 feet from the
bulkhead. The following exceptions will apply:
It is recommended that the Board amend the application to meet and/or further the above
policies to the greatest extent practicable.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the
proposed action.

Attached, please find 8 copies of the revised site plan, dated June 30, 2009, showing
the lot coverage calculations as determined by our office and signed by Architect
Robert Brown. This plan was used/referenced by the Building Dept in its' amended
disapproval to differentiate "buildable" and "nonbuildable" lots and the existing &
proposed lot coverage, now stated as 30.9% where 20% is permitted.
All other aspects of this project remain the same and the address is corrected to be
640 Rabbit Lane, not the historic address previously referred to.
Due to confusion on the address we will be before the Trustees on July 22ad, which
still pre-dates our hearing with you on the 30th.
I await answers from the building dept on the Flood zone interpretation, in an effort
to keep the proposed lifting to a 9' first floor level rather than 11'... as the
"buildable" area of the property is entirely in AE 9 ....
The owners will return the non-conforming use of the garage, which pre-existed
their purchase, back to a storage space with half bath as was originally applied for,
again prior to their purchase.

As requested, a site review was conducted at 640 Rabbit Lane in East Marion. The site was evaluated for
potential natural resource concerns regarding the alteration of raising the dwelling and adding a second story to
thc residence. '
At the time of this site visit, June 9, 2009, no natural resources cone. ems were observed. The proporty is situated
on the Oardiners Bay and is somewhat protected by a small bulldaead. The bulkhead and beach axe ettrrently in
good condition. Raising the house 6' seems appropriate for this residence due to the close proximity of the
shoreline.
It is mcommcnded that rc-vegctation of disturbed areas is completed as soon as possiblc after construction with
native plants and grasses. Additionally, the installation of gutters, downspouts, and underground drywells will
addreas stormwater runoff.
No natural resource concerns were observed with regard to the raising thc dwelling and adding a second story to
this residence.

REASONS FOR APPEAL: (additional sheet)
AREA VARL4NCE REASONS:
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted, because:
The requested work, requiring our appeal is to remain within the existing footprint. The row of
homes and cottages in this waterfront community have similar non-conformances and some have
recently been made larger & taller at a similar distance from the bulkhead to what we are
requesting.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because:
The owner wishes to convert the existing dormered second floor bedroom area into a tree second
floor code-conforming space. In order to do so the stairs will also need to be brought up to meet
code and the home will need to be lifted to meet Flood Plain regulations. There are no changes
sought to increase the footprint of the home. Existing State and local laws preclude completing
the second story work being feasible by other means. We are not proposing changes to the pre-
existing, non-conforming setbacks.
(3) The amount of relief requested is not substantial because:
The non-conformance issues are pre-existing, the added non-conformance would be an
approximate increase in the sidewall of the home an additional 3 ½ feet. (if we were not required
to lift the home 4' to required Flood Plain height) The proximity to the bulkhead pre-exists and
shall not be changed.
(4) The variance will not have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because:
There is to be no difference between the existing lot coverage or setbacks due to requested
construction of the second floor. The requested changes' impact would be minimal if not for
requirements of State code & Flood Plain laws. Some of the homes in the immediate vicinity
have had fairly recent additions in height and size and are larger than what we propose and in the
same proximity to the bulkhead. The environmental conditions will improve as the new
construction will require directional containment of all roof nm-off where there currently is none.
(5) Has the alleged difficulty been self-created? ( ) Yes, or ( x ) No. the difficulty pre-existed the
zoning code. The oottages in this area were constructed in the 1920's & 30's as was the bulk head.

A. INSTRUCTIONS
All applicants for permits* intluding Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permit~ not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of Sis form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its sign/ficant
beneficial and adverse effects upon the coastal area (wh/ch includes all of Southold Town).

achievement of the LWRP policy standards and conditions contained in the consistency review taw.
Thus, the action shohld be analyzed in more detail and, if necessary, modified prior to malting a
