Proposed Wetland Permit for RYAN STORK
SCTM#128-6-8
RYAN STORK requests a Wetland Permit to demolish an existing single-family dwelling;
construct a new two-story single-family dwelling approx. 32'X 70' overall, with a full basement,
and in a new location 75' from the bulkhead. Demolish an existing garage/guest house;
construct new garage approx. 22'X 37' overall in new location landward of new dwelling.
Abandon existing on-site sewage disposal system; construct new sewage disposal system in a
new location more than 100' from the wetlands. Located: 3270 Peconic Bay Blvd., Laurel.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the denoted following Policy
Standards and therefore is CONSISTENT with the LWRP provided that the following
recommendations to further the below listed policies are implemented.
Poficy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby
development are avoided:
Maintain buffers to achieve a high filtration efficiency of surface runoff
Avoid permanent or unnecessary disturbance within buffer areas.
Maintain existing indigenous vegetation within buffer areas.
If the action is approved it is recommended that the existinq trees on-site be preserved through
the establishment of a perpetual landscaped buffer landward from the bulkhead. A sample
definition follows:
LANDSCAPED BUFFER -- a land area of a'certain length and width which is planted with
indigenous, drou,qht tolerant, vegetation similar to that found within the immediate proximity of
the parcel. Vegetation shall be installed in sufficient densities to achieve ninety-five (95)
percent ground cover within two years of installation. Survival of planted ve,qetation shall be
(ninety) 90 percent for a period of three years, Maintenance activities within the buffer are
limited to removing veqetation which are hazardous to life and property, trimminq tree limbs up
to a height of fifteen feet (15'1 to maintain viewsheds, replanting of vegetation and establishing
a four foot I4') wide access path constructed of pervious material for access to the water-body.
Further, to further Policy 5, "Protect and improve water quality and supply in the Town of
$outhold" and protect and improve the water quality and supply in the area~; the following best
management practices are recommended:
1. Require the installation of gutters, leader and drywells to minimize storm water
impacts.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its wdtten determination regarding the consistency of the proposed action.

munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

Replacement of an existing waterfront dwelling and accessory structure, resulfmg
in a modest net gain in the area of the footprint is consistent with the character of
the waterfront community, and because the immediate area is heavily developed it
is felt that there is no adverse impact on the desired preservation of open space, in-
fi'astrueture use is not a factor since the project is for the replacement of an existing
structure while retaining the same use. The project is certainly a beneficial use of
the coastal location, and the incremental increase in development in the area is in-
significant.

There is no evidence to indicate that the immediate area of the project includes his-
toric features.

The structures proposed will not be inappropriate in the proposed location. They
are compatible with other existing waterfi, ont structures in the area, and will not
adversely affect the dynamic landscape elements (tidal fluctuations, seasonal vege-
tation changes, changing light) which might contribute to ephemeral visual quali-
ties.

Minimize loss of life, structures, and natural resources from flooding and ero-
sion.

The likelihood of the proposed project contributing to increased hazards which
could result in the losses listed is minimal. Natural protective features will not be
adversely affected; there is an existing bulkhead.

The proposed project will utilize a new Health Department-approved on-site sew-
age disposal system. During construction a line of haybales and/or a silt fence will
be in place to minimi?e the chance of silt entering the bay. There will be no distur-
bance of the bay bottom during constmction~

tem.

There is no wetland vegetation on the site, and as has been mentioned the property
is behind an existing bulkhead and a retaining wall. Steps will be taken to insure
that silt does not enter the bay during construction. The project is not located in a
Significant Coastal Fish and Wildlife Habitat. All statutory and regulatory re-
quirements, at all levels of government, will be strictly complied with. No dredg-
ing, excavating, or filling of the bay bottom is proposed.

The construction or use of the project as proposed will not result in si~maificant

It is not expected that the project as proposed will, over time, result in the genera-
tion of significant additional solid waste; it will be disposed of in accordance with
the required or recommended practices of the Town and the SCDHS. Any handling
and storage of potroleum products will be accomplished through the use of ap-
proved containers and facilities, and approved methods of handling and storage
will be followed.

The planning and construction of the project is, and will be, such that energy effi-
cient design criteria are applied throughout, based upon local and State building
codes. As has been stated, any handling and storage of petroleum products will be
accomplished through the use of containers, facilities and methods of handling and
storage as approved for residential property use and generally accepted as safe.
Site drainage and water control will be designed and accomplished in accordance
with Town policies and requirements. Roof runoff will be retained on-site. Excess
spoil resulting from the basement excavation will be removed to a site at which it
will pose no environmental burden.
