A meeting of the Southold Town Conservation Advisory Council was held Wed.,
December 9, 2009 at Down's Farm Preserve.

CALL TO ORDER
The meeting was called to order at 4:30 PM by Acting-Chairman Peter Young.
OLD BUSINESS
Member Jack McGreevy felt strongly that the CAC should be involved in the MIMS
proposal, now before the Planning Board. Jack reviewed the file and discussed his
concerns with zoning issues with the Supervisor.
Acting-Chairman Peter Young spoke to Heather Lanza from the Planning Dept. and
agreed that all applications having an impact on natural resources should be referred to
the CAC, however, the direction must come from the Town Board.
NEW BUSINESS

Member Jack McGreevy recently met with Supervisor Russell and was informed that the
Town Board appointed Audrey Horton to the Conservation Advisory Council, however
there was no mention about an appointment of a student member.
Secretary Lauren Standish will contact Audrey Horton once her contact information has
been obtained.
Acting-Chairman Peter Young stated that there was a discussion last month about
forgoing the issue of the student member for now and re-allocate the money for a special
project.
APPROVAL OF MINUTES
Moved by Doug Hardy seconded by Jack McGreevy, to Approve the Minutes of November
12, 2009.
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL
EROSION PERMIT APPLICATIONS
Moved by Greta Schiller, seconded by Peter Young, it was
RESOLVED to SUPPORT the Wetland Permit application of NSHE WlLLIAMSTON LLC
to construct a 14'X 35' swimming pool within the western portion of subject property.
Located: 220 West Shore Dr., Southold. SCTM#80-5-4.1

The CAC Supports the application with the Condition the location of the pool is modified
an effort to save the large oak tree, which absorbs the water and helps prevent run-off.
Vote of Council: Ayes: All
Motion Carried
Moved by Greta Schiller, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the Wetland Permit application of C JCl CORPORATION to
construct an 80'X 112' two-story building with two (2) dry store units on the south side and
a general industrial unit on the north side; install an attendant sanitary system; and
construct a pervious gravel parking area.

The CAC Supports the application with the Condition a containment facility is installed to
capture any effluent from a catastrophic spillage, either outside, or inside the building.

Moved by Doug Hardy, seconded by Greta Schiller, it was
RESOLVED to SUPPORT the Wetland Permit application of GARY SALICE for the
resurfacing and the squaring-off of the existing rear patio.

Moved by Greta Schiller, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the Wetland Permit application of JOHN & MARIA ZOI'FAS to
construct 4'X 86' stairway down a bluff with steps to the beach.
Located: 5405 The Long Way, East Marion. SCTM#21-5-14

The CAC Supports the application with the recommendation that the applicant consider
realignment to a more favorable gradient and consider shared access with the adjacent
property owner. In an effort preserve the bluff, the CAC further recommends the bluff
stairs are constructed with erosion control devices at the base of the supports and with
best engineering practices.
Vote of Council: Ayes: All
Motion Carried
HARRIET J. MCNAMARA to construct a 14.5'X 8' addition, a 20.5'X 8' enclosed porch,
and to remove the existing deck and balcony.

The CAC did not make an inspection, therefore no recommendation was made.
Moved by Jack McGreevy, seconded by Peter Young, it was
RESOLVED to SUPPORT the Wetland Permit application of SCOTT & SUSAN
AMBROSIO to construct a fixed timber dock consisting of a 4'X 12' inclined ramp, 4'X 88'
fixed elevated catwalk, 3'X 14' hinged ramp and a 6'X 20' float secured by (2) 8" dia.
pilings.

The CAC Supports the application, however, has a concern with the impact issues on a
prime shellfishing area. Reducing the size and number of pilings would possibly mitigate
and minimize the potential impacts.

Moved by Jack McGreevy, seconded by Doug Hardy, it was
RESOLVED to NOT SUPPORT the Wetland Permit application of CHARLES &
CAROLYN LoCASTRO to construct a fixed timber dock consisting of a 4'X 12' inclined
ramp, 4'X 88' elevated catwalk, 3'X 14' hinged ramp, and a 6'X 20' float secured by (2) 8"
dia. pilings. Remove existing stoop and concrete walls from existing dwelling; construct
roofed-over attached deck with step-down; construct 4'X 8' stoop and step in place of
existing stoop; install new cellar door; install a drainage system of drywells; replace
existing dirt driveway with pervious gravel driveway and parking area; clear up to 50' from
tidal wetlands boundary; selectively remove individually marked trees located within 50' of
the wetlands boundary; and establish a 15' wide non-disturbance buffer adjacent to the
tidal wetlands boundary.

The project was not staked, however, CAC does Not Support the application and
recommends gutters are installed on the existing dwelling and connected to drywells, the
floating dock is removed from the wetlands, and there is no removal of trees greater than
8" dbh seaward of the dwelling.

Moved by Doug Hardy, seconded by Greta Schiller, it was
RESOLVED to SUPPORT the Wetland Permit application of KEVlN FAGA to remove the
existing dwelling to top of foundation; repair foundation and elevate to make flood
compliant; rebuild house with addition and square-off house on west side.

The CAC Supports the application subject to the review of best practices and building
codes by the Board of Trustees.

DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND A
WETLAND PERMIT

RESOLVED to SUPPORT the application of STEVEN & OLGA TENEDIOS to Amend
Permit #6973 to construct a 20'X 40' in-ground swimming pool, patio on grade, pool house
and detached two-story framed garage.
Located: 17327 Main Rd., East Marion. SCTM#23-1-14.1

The CAC Supports the application with the Condition of the installation of a pool drywell.

Moved by Jack McGreevy, seconded by Doug Hardy, it was
RESOLVED to SUPPORT the application of ROBERT H. WHELAN to Amend Permit
#1716 to change the dimensions of the permitted 2'X 20' ramp to a 3'X 28' ramp and
replace the existing 4'X 18' floating dock with a 6'X 20' floating dock.

The CAC recommends there is a consideration for erosion control along the bank,
specifically the 15'X 60' area along the entrance to the dock.

Motion Carried
Member Peter Young will attend the next regular meeting of the Board of Trustees
scheduled for Wed., December 16, 2009.
The next meeting of the Conservation Advisory Council has been set for Wed., January
13, 2009 at 4:30 PM at Down's Farm Preserve.
There being no further business to come before the Council, the meeting was adjourned
at 6:30 PM.
