Located: 5700 Vanston Rd., Cutchogue. SCTM~I 11-10-13.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recemmendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its .written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. The proposed in-place replacement of the bulkhead and retaining wall, as depicted on the same prc~ject plan, are exempt from waterfront consistency review pursuant to Chapter 268-5, as these actions meet one or more of the following definitions of"minor action" defined by Section 268-3 I. "A. Maintenance or repair involving no substantial changes in an existing structure or facility;" 2. "B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire code, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) where structures may not be replaced, rehabilitated, or reconstructed without a permit." 3. "GG. Bulkhead to replace existing bulkhead on the applicant's property in the same location with a silt curtain employed during construction. See LWRP Section Ill - Policies Pages 8 through 16 for evaluation criteria [~ Yes [--'] No [~ Not Applicable Although the site and subject bluff is presently protected by a bulkhead along the shoreline, the most northerly portion of the bluff face is being eroded as a result of a lateral extension of chronic bluff erosion occurring on the adjacent northerly property, causing a diminishment in the natural protective feature's ability to keep the land stabilized and protected from flooding and erosion. The proposed extended return along the northerly property line, together with the proposed sand renourishment and planting of the bluff face, will help to restabilize the bluff face and both restore and protect the function of the natural resource.
