En-Consultants, Inc. on behalf of ESTATE OF DONNA LEVIN requests a Wetland Permit and
Coastal Erosion Permit to construct approx. 133 If. of vinyl bulkhead (and 5' easterly return) in
place of existing timber bulkhead and restore washed out portion of bluff face (due to storm-
collapsed section of existing wall) with approx. 450 cy. clean sand to be planted with Cape
American beach grass (12" on center). Located: 21695 Soundview Ave., Southold.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP Program.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus., each answer must be explained in detail., listing both supporting and non-
suvoortine facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The project is consistent with Policy 4 because currently, due to the bowing and leaning of the existing wail, a portion of the structure is
in danger of inevitable damage or failure, and another portion has already collapsed, causing the loss of significant material from the
bluff(the natural protective feature of the site) between the wall and the dwelling. Therefore, the environmental impacts of taking no
action to maintain and replace the structure would be adverse, whereas maintaining the structure and its function will maintain existing
conditions and have no adverse impacts on the adjacent shoreline or adjoining properties, which are similarly structurally stabilized.
