Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: MarkTerry, Principal Planner ~ LWRP Coordinator Date: November 17, 2009 Re: Proposed Wetland Permit for LEONARD VlTO SESSA SCTM#1000-99-4-27.1 ACE Inc. on behalf of LEONARD VITO SESSA requests a Wetland Permit to replace in-place and elevate 2' an existing 4'X 40' pier with 4'X 40' vinyl grated pier; extend landward to the bulkhead an additional 4'X 40' vinyl grated deck pier secured by 6" dia. pilings landward of the Iow water line and (4) 8" dia. pilings seaward of the Iow water line; replace existing 3'X 16' ramp with a 3'X 18' ramp and replace in place two existing 6'X 20' floats secured by (4) 10" pilings; install (8) 10" mooring pilings; replace in-place existing 30' wood retaining wall; replace existing 10' return with a 20' return; install one new 20' return; replace existing 3'X 4' beach access stairs on easterly side of pier and add one 3'X 4' set of beach access stairs to westerly side of pier. Located: 1505/1525 Naugles Rd., Mattituck. SCTM#99-4-27.1 The subject property is split zoned R-40 and Mil and is currently in residential use. The dock structure is located on the Mil zoned portion of the property. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other /ands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The action proposes to the replacement of (2) 20x6 floats for a total square footage of 360 square feet. Chapter 275, Wetlands and Shorelines permits only one float with a maximum square footage of 180 square feet. § 275-11 Construction and operation standards. Regulations for the placement and configuration of docking facilities. [1] Residential docks. [Amended 10-11-2005 by L.L. No. 17-2005] [b] If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: [i] It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees; [Amended 12-18-2007 by L.L. No. 23-2007] Further the applicant has not demonstrated to the Board that the proposed action complies with 275-11. C (2) Docks outlined below. 275-11. C. (d) Docks (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The area where the dock structure is proposed, is subject to hi.qh use by larqe commercial vessels. The plans fail to show the dock in relation to navi.qation and moorin,q of such vessels. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
