Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees/ From: Mark Terry, Principal Planner LWRP Coordinator Date: November 13, 2009 .Re: Proposed Wetland Permit for THOMAS O'NEILL SCTM#1000-76-3-10.1 Suffolk Environmental Consulting, Inc. on behalf of THOMAS O'NEILL requests a Wetland Permit to install a 69' Iow-profile bulkhead along the southern shoreline and connect to the existing southwestern- most vinyl bulkhead return; expand the existing fringe of tidal wetlands vegetation along the southern shoreline; and install a section of GeoGrid matting measuring 10' X 7' between the AHW and ALW within the southwestern section of the subject property in order to allow for the launching and retrieving of small boats. Located: 1420 Smith Ddve South, Southold. SCTM#76-3-10.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southeld Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following recommendations to further the below listed policies are implemented. Figure 1 Subject site (white arrow) To fur/her Policy 5, "Protect and improve water quality and supply in the Town of Southold" and protect and improve the water quality and supply in the area; the following best management practices are recommended: 1. Require the installation of a silt boom during construction or structures pursuant to: § 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within thn immediate proiect area. Pursuant to Chapter 268, the Board of Trustees shall cons[der this recommehdation i~ ~)repanng its written determination regarding the consistency of the proposed action. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Furthermore, this proposal will be in harmony with the "..beneficial use of a coastal location..." in that subiect waterfront lot will be enhanced & improved by the installation of the new Iow-sill bulkhead, thereby fully providin.q erosion control over the entire shoreline of subiect property. The "Low" Bulkhead w'dl connect to the existing southwestern-most x;myl bulkhead return and extend 69.0' southwest along the shoreline and terminate at an "Open" Return, which w'fll extend from the "Low" Bulkhead 11.0' northwest to the top of the bank. The "Low'' Bulkhead measuring 69.0' in length will consist of the following: (1) (2) (3) (4) Vinyl Sheathing (C-LOC or similar) (6"x 18"x 8'); Timber Whaler (6" x 6"); Timber Pilings (8" - 10" cb x 14' x 16'); and Timber Deadmen (6" cb x 6'). The top of the "Low" Bulkhead will be at elevation 2.6' + (to match the existing "Low" Bulkhead to the northeast), and will utilize weep holes within the sheathing to allow tidal action to inundate the area landward of the bulkhead to support the existing and proposed additional tidal wetlands therein. The "Open" Return measuring 11.0' in length will consist of the follow'rog: (1) (2) Timber Whaler (6" x 6"); and Timber Pilings (8" - 10" cb x 8'). The top of the "Open" Return w'fll be at elevation 2.6' + (to match the proposed "Low" Bulkhead), and will not include sheathing in order to fully allow tidal action to inundate the area landward of the bulkhead to support the existing and proposed additional tidal wetlands therein, as well as provide stability for the proposed "Low" Bulkhead. PRO}ECT DESCRIPTION ~ PROPOSED WETLANDS INSTALLATION: Applicant proposes to expand the existing fr'mge of tidal wetlands vegetation (i.e., Spartina) along the southern shoreline to fill out the area contained landward of the proposed "Low" Bulkhead and "Open" Return. SPAR TINA The area of wetlands installation contains 300 square feet _+. Approximately, 75 cubic yards of clean fill is proposed to be deposited and graded ~vithin this area. Upon final grooming, Spartina plugs will be planted in this area at 1.0' o/c (300 specimens _+). Weep holes within the v'myl sheathing of the proposed "Low" Bulkhead w'fll allow tidal action to inundate this area in order to support the existing and new areas of tidal wedands therein. PROJECT DESCRIPTION ~ PROPOSED GEOGRID RAMP Applicant proposes to install a section of GeoGrid® matting measuring 10.0' xvide x 7.0' long between the AHW and ALW within the southwestern section of subject property in order to allow for the launching and retrieving of small sailboats (i.e., Sunfish), canoes and/or kayaks.
