SCTM#1000-80-5-4.1
Suffolk Environmental Consulting, Inc. on behalf of NSHE WILLIAMSTON LLC requests a Wetland
Permit to construct a 14'X 35' swimming pool within the western portion of subject property. Located:
220 West Shore Dr., Southold. SCTM#80-5-4.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
.Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and ether lands under their
jurisdiction

The top of bluff line or "bluff line" has not been identified pursuant to § 275-2 Definitions; word usage.
of the Southold Town code which defines a bluff as:
BLUFF - Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body of
water. The waterward limit of a bluff is the landward limit of its waterward natural protective feature.
Where no beach is present, the waterward limit of a bluff is mean Iow water. The landward limit is 25
feet landward of the receding edge or, in those cases where there is no discernible line of active
erosion, 25 feet landward of the point of inflection on the top of the bluff. The point of inflection is that
point along the top of the bluff where the trend of the land slope changes to begin its descent to the
shoreline.

Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section Ill - Policies; Page 2 for evaluation
criteria.

As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the
Town of Southold would result in a loss of the community and landscape character of Southold.", this
proposal is to construct a pool which is a common appurtenance in the Town. The proposal, as desi~lned,
will not result in adverse effects to the surroundin.cl environment in that the oroiect has been desi.qned in
such a way as to maintain or exceed all required re.qulatory conditions associated with pool construction
on a let situated in proximity to the surface waters surroundin.q the Town of Southold. In addition, the
proposed pool will be served by adequate drywells to handle any and all overflow. Accordin.qly, we
believe that this prelect is consistent with this policy.
