INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. [] Yes [] No [] Not Applicable This proposal maintains the development scheme of the Town of Southold, which is "defined by a pattern of open agricultural land interspersed with development clustered around a number of historic hamlet centers...", by concentratincI commercial development in a developed commercial area. The proposed use is compatible with zonin.q and surroundin¢l existin.q development. The site is not located on the water, and therefore the project cannot make beneficial use of a coastal location. A.qain, because of the site location, the proposal "minimizes the adverse effects of developmen¢' by concentratin.q development near existin.q development. SCTM~4544.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department as well as the records available to me, it is my determination that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practices are required to further the policies of the LWRP. POLICY STANDARDS Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: Preserve existing vegetation which contributes to the scenic quality of the landscape. Allow for selective clearing of vegetation to provide public views without impairing values associated with the affected vegetation. 1. To further this policy it is recommended that all trees greater than 6" in diameter measured 4.5' above the grade be retained on-site. All improvements including parking areas and equipment storage areas should be designed to incorporate or avoid trees that meet this criterion. In addition, require that native and drought-tolerant plants be used in landscaping. Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards. Thc following management measures to minimize losses of human life and structures from flooding and erosion hazards arc suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards A drainage ditch is shown on thc castcm portion of thc property. Although the portion of the ditch located within the parking area will be filled. A proposal for thc remaining drainage ditch has not bccn identified, Policy 5. Protect and improve water quality and supply in the Town of Southoid. 5.5 Protect and conserve the quality and quantity of potable water To further this policy and protect ground water quality it is recommended that the Planning Board require the following best management practice for the newly constructed parking areas: 1. Minimize parking surface areas to the greatest extent practical. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed setback from the rear parking area to the fireshwater wetland system is 54'; a minimum setback of 100 feet is required pursuant to Chapter 275 of the Town of Southold Town Code. Please require that the applicant amend the application to meet the above policy to the greatest extent possible. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas.
