COVENANTS ANO RESTRICTIONS
DECLARATION made this 6th
day of March 1986, by Emily Radziewicz
residing at (no #) Peconic Mill Lane, Peconic, New York, and STELLA B.
MROWKA, residing at 8409 Talbot Street. Kew Gardens, New York, as admin-
istr6trix of the Estate of Thomas Mrowka, deceased, hereinafter called
the "Ovmer";
WHEREAS, the Owner has title to certain lands situate, lying and being
at Peconic, in the Town of Southold, County of Suffolk, and State of New York,
said lands hereinafter being more particularly described in Schedule A
attached hereto;
WHEREAS, it is the intention of the Owner that the aforesaid lands be
subdivided into a minor subdivision as shown on "Minor subdivision made for
Estate of Thomas Mrowka, at Peconic, New York" prepared by Roderick Van Tuyl
P.C. on November 20, 1985; and
WHEREAS, the Planning Board of the Town of Southold did on January 27,
1986 approve the division of the parcel of land set forth on Schedule A
into a minor subdivision; and
WHEREAS, the Planning Board of the Town of Southold resolved on January
27, \986 that there should be placed on the aforesaid subdivision certain
Covenants and Restrictions prior to the Chairman endorsing approval on the
said subdivision platt; and
NOW, THEREFORE, the above described premises shall be subject to the
following Covenants and Restrictions:
I. No lot shall be subdivided or its lot lines changed in any manner at any
future date unless authorized by the Town of Southold Planning Board.

2. Should the 4.95 foot wide by 200 foot long strip of land be sold
to the owner of an adjacent parcel as proposed the'strip of land shall then be
incorporated into the adjacent owner's parcel so that the parcel will not
exist as a single, substandard parcel.
3. Clearing and grading within each lot shall be limited to that
necessary for siting and constructing a house with the intent of preserving
as much of the natural vegetation on the site as possible. Limiting clearing
and grading will minimize stormwater runoff and erosion.

ment of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow into Suffolk County
Recharge Basin No. SO-8, adjacent to the property, and into the nearby
\~etlands.
5. Erosion and sediment control measures shall be required during and
immediately after construction on each lot to insure that stormwater runoff
will not carry eroded and toerh deleterious materials into the adjacent
county recharge basin and the nearby wetlands.
DECLARANT does hereby further warrant, covenant and represent that the
foregoing restrictions and agreements shall bind the undersigned. her heirs.
successors and assigns, and any and all person or persons who shall succeed
to the ownership of said premises or any pan thereof by tralisfer Ul otllelwise.

SCHEDULE A
All that certain plot, piece or parcel of land located at
peconic, in the Town of Southold, County of Suffolk, State of
New York, bounded and described as follows:
BEGINNING at a point on the westerly line of Mill Lane at
the southeasterly corner of land of Bokina, and the northeasterly
corner of the premises herein described; running thence along
said line of Mill Lane, S. 49013'00" East, 354.95 feet to land
of Radziewicz; thence along said land of Radziewicz, three courses:
(1) S. 40047'00" West, 200 feet; thence (2) S. 49013'00" East,
217.80 feet; thence (3) N. 40047'00" East, 200 feet to said line
of Mill Lane; thence along said line of Mill Lane, two courses:
(1) S. 49013'00" East, 67 feet; thence (2) S. 53011'40" East,
8.20 feet to land of Suffolk County; thence along said land of
Suffolk County S. 41057'20" West, 435.20 feet to land of Sfaelos
Realty Corp.; thence along said land of Sfaelos Realty Corp. two
