The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, August 18, 2010:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #7204 and Coastal Erosion Permit #7204C to authorize the placement
of approximately 122 linear feet of 200-300 lb. toe stone and 6' wide gravel splash pad
landward of new bulkhead; to establish small berm landward of top of bank; and to
stabilize backfill before planting with jute matting (anchored by toe stone), and as
depicted on the revised site plan prepared by EN-Consultants, Inc., last dated July 27,
2010, and stamped approved on August 18, 2010.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trastees adopted at the meeting held on
November 18, 2009, and in consideration of application fee in the sum of $250.00 paid by Estate of Donna

Wetland Permit to construc[ approximately 133 linear feet of vinyl bulkhead
(and 5' easterly return) in place of existing timber bulkhead and restore washed out
portion of bluff face (due to storm-collapsed section of existing wall) with
approximately 450 cubic yards clean sand to be planted with Cape American beach
grass (12" on center), with the condition of the installation of a row of +/- 1 to 2 ton
stone toe armor against the seaward side of the bulkhead, and as depicted on the site
plan. prepared by Eh-Consultants, Inc., last dated December 4, 2009, and stamped
approved on December Ilk 2009.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affLxed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Estate of Donna Levin, residing at 21695 Soundview Avenue, Southold, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released fi.om any and all
damages, or claims for damages, of suits arising directly or indi~ctly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrfint, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and nOn-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no un.reasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low Water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion oftbe work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failUre to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, November 18, 2009 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of ESTATE OF DONNA LEVIN applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southoid Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111
of the Southold Town Code, Coastal Erosion Hazard Areas, application dated October
27, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 18, 2009, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of ESTATE OF
DONNA LEVIN to construct approximately 133 linear feet of vinyl bulkhead (and 5'
eastedy retum) in place of existing timber bulkhead and restore washed out portion of
bluff face (due to storm-collapsed section of existing wall) with approximately 450 cubic
yards clean sand to be planted with Cape American beach grass (12" on center), with

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Project Description: To temporarily place precast concrete blocks at toe of bluff
due to storm induced collapse of existing timber bulkhead. Measure is proposed
as a temporary stop-gap until all regulatory approvals can be obtained to
construct vinyl bulkhead in place of damaged structure.
Findings: The project meets all the requirements for issuance of an Emergency
Wetlands Permit as determined by the Board of Trustees. The issuance of the
Emergency Wetlands Permit allows for the operations as indicated in the
application received on October 19, 2009.
Special Conditions: A full Wetland Permit and Coastal Erosion Permit must be
obtained in order to conduct any further activity on the bulkhead.
This is not a determination from any other agency.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP Program.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The project entails both the ordinary/routine and emergency replacement of a deteriorating and storm-damaged bulkhead, the
partial collapse of which has caused the rapid loss of bluff material between the structure & dwelling. The project will replace a
treated wall with an untreated bulkhead and will restore and revegetate the damaged bluff face. Therefore, the project will have
no significant adveme impact on the adjacent tidal waters of Long Island Sound.

The anticipated impact of the project is the continued retention of the bluff fronting Long Island Sound. Currently,
due to the bowing and leaning of the existing wall, a portion of the structure is in danger of inevitable damage or
failure, and another portion has already collapsed, causing the loss of significant material from the bluff (the natural
protective feature of the site) between the wall and the dwelling. Therefore, the environmental impacts of taking no
action to maintain and replace the structure would be adverse, whereas maintaining the structure and its function
will maintain existing conditions and have no adverse impacts on the adjacent shoreline or adjoining properties,
which are similarly structurally stabilized.

The project is consistent with Policy 4 because currently, due to the bowing and leaning of the existing wall, a portion of the structure is
in danger of inevitable damage or failure, and another portion has already collapsed, causing the loss of significant material from the
bluff(the natural protective feature of the site) between the wall and the dwelling. Therefore, the environmental impacts of taking no
action to maintain and replace the structure would be adverse, whereas maintaining the structure and its function will maintain existing
conditions and have no adverse impacts on the adjacent shoreline or adjoining properties, which are similarly structurally stabilized.
