Cammann, as issued on December 16, 2009.

WHEREAS, DECLARANTS are the owners of certain real property located
on Deep Hole Drive, Mattituck, Town of Southold, County of Suffolk, State
of New York, described in the Suffolk County Tax Map as District 1000,
Section 115, Block 12, Lots 21.1 and 21.2, which are more particularly
bounded and described as set forth in Schedule "A" annexed hereto,
hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of
the Board of Trustees of the Town of Southold (hereinafter the "Trustees")
pursuant to Chapter 275 of the Town Code of the Town of Southold or its
successor, and various activities conducted upon the property may thus be
subject to the regulation and approval of the Trustees prior to being
conducted;
WHEREAS, the DECLARANTS therefore made application to the Trustees for
a permit pursuant to the Wetlands Law of the Town of Southold to undertake
certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to
undertake such regulated activities, the Trustees required that a twenty-
five foot wide "nondisturbance buffer" be established adjacent to the tidal
wetlands boundary,
NOW, THEREFORE, the DECLARANTS do hereby covenant and agree as
follows:

There shall be maintained adjacent to the tidal wetlands boundary
on the subject premises a twenty-five foot wide "nondisturbance
buffer" as defined by Chapter 275 of the Town Code; and
2)
These covenants shall run with the land and shall be binding on
the DECLARANTS, their heirs, assigns, purchasers, or successors in
interest and may be modified only upon resolution of the Board of
Trustees.

Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on

pilings, and as depicted on the site plan prepared by Eh-Consultants, Inc., last dated December
7, 2009, and stamped approved on December 16, 2009. Remove existing stoop and concrete
walls from existing dwelling; construct roofed-over attached deck with step-doWn; construct
4'x8' stoop and step in place of existing stoop; install new cellar door; install a drainage system
of drywells; replace existing dirt driveway with pervious gravel driveway and parking area;
clear up to 50' from tidal wetlands boundary; selectively remove individually marked trees
located within 50' of the wetlands boundary; and establish a 25' wide non-disturbance buffer
adjacent to the tidal wetlands boundary with a 4' wide access path to the dock, and aS depicted

The Permittee Charles & Carolyn LoCastro, residing at 1475 & 1500 Deep Hole Drive,
Mattituck, New York as part of the consideration for the issuance of the Permit does
understand and proscribe to the following:
That the said Board of Trnstees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Pennittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold requ'tre the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein:stated without
expenses to the Town of Southold.
The Pennittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized..
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 16, 2009 regarding the above matter:
WHEREAS, En-Consultants, Inc., on behalf of CHARLES & CARYOLYN LoCASTRO
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated November 18, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 & 9.3 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: a 25' non-disturbance buffer
is maintained adjacent to the tidal wetlands boundary with a 4' wide access path to the
dock, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 16, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees. deems the action to be

The proposed action to clear up to 50' from tidal wetlands boundary; selectively remove individually
marked trees located within 50' of the wetlands boundary; and establish a 15' wide non-disturbance
buffer adjacent to the tidal wetlands boundary has been reviewed to Chapter 268, Waterfront
Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the below Policy Standards and
therefore is INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Maintain buffers to ensure tha~ adverse effects of adjacent or nearby development are
avoided:
1. Maintain buffers to achieve a high filtration efficiency of surface runoff.
2. Avoid permanent or unnecessary disturbance within buffer areas.
3. Maintain existing indigenous vegetation within buffer areas.
The applicant proposed to clear up to 50 feet from wetland boundary and remove 16 mature trees on
the property within the Boards jurisdiction.
A 15 foot non-disturbance buffer is proposed. The terms of maintenance have not been defined. It is
recommended that the establishment and terms of the buffer be memorialized in a covenant and
restriction filed with the Suffolk County Clerk. An example definition of a similar type of buffer follows:
NATURAL VEGETATED BUFFER -- a land area of a certain length and width where existing
vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be
maintained to achieve a minimum percent ground cover of ninety-five (95) percent. To achieve the
percent ground cover indigenous, drought tolerant vegetation shall be planted. Survival of planted
vegetation shall be (ninety) 90 percent for a period of three (3) years. Maintenance activities within the
buffer are limited to removing vegetation which are hazardous to life and property, trimminq tree limbs
up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four
foot (4') wide access path or stairs constructed of pervious material for access to the water-body.
The proposed action to construct a fixed timber dock consisting of a 4'X 12' inclined ramp, 4'X 88'
elevated catwalk, 3'X 14' hinged ramp, and a 6'X 20' float secured by (2) 8" dia pilings is also
recommended as INCONSISTENT with the LWRP and below policies:

6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros t'atent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendati,~ns as set forth in Trustee permit
conditions
The applicant has not sufficiently demonstrated that the proposed action meets the following § 275-11
Construction and operation standards. 2. C.
d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel
congestion;
The landform in the area forces the dock structure into the naviqable channel, seaward of the existinq
dock line. Further the width (or representative width) of the vessel moored has not been identified and
therefore, the assessment of how far the dock structure proiects into the channel is unclear. Note, that
to the west of the dock structure across the channel another dock structure with two pilin,qs exists. This
dock must be assessed in relation to the proposed action.

Whether the dock will unduly interfere with the public use of waterways for swimming, boating,
fishing, shellfishing, waterskiing and other water-dependant activities;
[5] Whether the dock will cause degradation of surface water quality and natural resources;
The construction method has not been identified..~ 275-11 Construction and operation
standards requires that all intertidal construction and excavation employ the installation of a silt
boom that will retain all suspended sediments within the immediate project area.

Whether the cumulative impacts of a residential and commercial dock will change the waterway
or the environment and whether alternate design, construction, and location of the dock will
minimize cumulative impacts;
Deep Hole Creek contains one of the hiqhest densities of residential docks in Town Waters. The
cumulative impacts of the proposed action has not been addressed.
[12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge
of waste and rubbish, electrical service and water servica.

Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use,
structure, or facility on public interest in public lands under water.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Dear Mr. King:
As discussed subsequent to the Board's field inspection of the captioned property, please find enclosed (3)
copies ora site plan prepared by Nathan Taft Corwin III, L.S., which has been revised to depict a 25-foot wide
nondisturbance buffer adjacent to the tidal wetlands boundary. The site plan has been thus revised to eliminate
the felling of any trees within 25 feet of the wetlands boundary and to relocate the project-limiting fence and
staked haybales to the landward boundary of the proposed nondisturbanee buffer.
Please also note that as requested by the New York State Deparhnent of Environmental Conservation, the
roofed-over deck proposed on the west side of the house has been shorted from 32' to 30' in order to maintain
the preexisting wetlands setback of 52.5' to the southwest comer of the house.
Also enclosed are four copies of a project plan for the proposed dock prepared by En-Consultants, Inc., last
dated 7 December 2009, which has been revised to depict the wider nondisturbance buffer and an access path
through the buffer to the proposed dock.

The proposed dock would be located in the area of the property where, consistent with "Best Management Practices," the
structure will traverse the least amount of vegetated marsh. The dock is proposed to be constructed with untreated decking,
including open-grate decking with 60% open space over the vegetated marsh, and the supportive framework of the catwalk is
minimized via use of 4" x 4" support posts over the vegetated marsh. As evidenced by the attached aerial photograph, the
adjacent and opposite shorelines of Deep Hole Creek are characterized by mom than a dozen similarly configured private docks.
Neither the proposed dock nor the minor renovations proposed to the existing dwelling (which will be accompanied by the
introduction of a drainage system of drywells to the property and the establishment of a 15' wide, approximately 3,080 s.fi
nondisturbance buffer as mitigation for an approximately 380 square foot increase in lot coverage) will have a significant
adverse impact on the adjacent tidal wetlands or waters of the Town.
