Dear Mr. Tartaglia:
The Southold Town Board of Trustees reviewed the site plan prepared by High Point
Engineering, last dated October 20, 2009, and received on October 22, 2009, and
determined that the removal of (1) gasoline dispenser, installation of (1) 5,000 gallon
double wall steel UL~2085 fire rated A.S.T. with associated piping and relocate three (3)
gasoline dispensers behind the existing wood bulkhead is out of the Wetland jurisdiction
under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The proposed project shall impact the environment in a positive fashion. The proposed
above ground double wall steel gasoline tank with electronic monitoring system
provides increased secudty against tank leakage into the environment. It also satisfies
SCDHS mandate (effective by 2010) that all fuel storage tanks have secondary
containment whereas the existing underground tank is of single wall construction. In
the unlikely event that the primary tank leaks, the fuel will not be in direct
contact with the soil and groundwater as it will be contained within the secondary
space and it's presence identified by the electronic leak detection probe,

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfi:ont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

Although the proposed action introduces an above ground fuel storage tank approximately 33 feet away
from the bulkhead, the proposed above ground tank will be approximately 595' feet away from
Manhasset Avenue and hence will not be visible from the roadway. It's visual impact from the waterway
will be minimized by the buildings in front of/around it as well as the existence of a larger (6,000 gallon)
above ground tank immediately adjacent to it.
