Dear Mister King, I would like to thank you and all Town Trustees fur coming to Orient August 15 and inspecting our substantial beach erosion, occurred during the February northeastern storm Enclosed please find copies of the original approval permit (issued 8/3/1987) and drawings for the implementation and construction of a bulkhead and platform on my property on Harbor Road in Orient. Since that time we lost several feet of property and are in desperate need to construct the proper protection against any further deterioration/erosion. Rieger 370 Harbor Road Orient, New York 11957 Re: Application No. 533 Dear Mr. R. ieger: The following action was taken by the Board of Town Trustees during their regular meeting held on July 27, 1987 regarding the above matter. WHEREAS, Yan H. Rieger applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 5, 1987 and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on July 27, 1987 at which time all interested persons were given an opportunity to be heard, and ';;[IEllF..AS, ~he ;3uard member~ have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Yan H. Rieger BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: construct a low profile timber retaining wall above the high water mark, and to fill with 60 cu. yds. of fill. This permit is approved with the provision that the toe of the structure is to be armored with stone to be trucked in with no disturbance to any on site stones. Property is located at 370 Harbor Road, Orient. Board of Trustees Page 2. This permit will expire on July 27, 1989 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have'an application pending for the same or similar project. Please remit $10.00 for wetland inspection fees at this time. PLEASE RETURN TO THE BUILDING DEPT. FOR A DETERMINATION ON THE NEED OF ANY OTHER TOWN PERMITS THAT MAY BE REQUIRED. Our review indicates that since the proposed work does not appear to include dredging or construction activities in or over any navigable waters of the United States, the placement of any dredged or fill material in any waters of the United States (including coastal or inland wetlands) or the accomplishment of any work affecting the course, location, condition or capacity of such areas, a Department of the Army permit, in accordance with 33 CFR 320-330, will not be required provided the proposed work is executed in accordance with the referenced material. '- Care should be taken so that any fill or construction materials, including debris, do not enter the waterway to become a drift or pollution hazard. The waterfront part of the following street numbers: 450 owned by Lisa Gilloly, 370 owned by H&F Rieger and 300 owned by F&S Allecia, has been heavily eroded during the last storm and it is necessary to (reconstruct) build a protection wall preventing further loss of our land.
